2012/04/26 Planning Commission Resolution (3)PLANNING COMMMISSION RESOLUTION NO. 2OI2-II A RESOLUTION OF'THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, SITE PLAN REVIE\ü AND ARCHITECTURAL REVIEW FOR A STARBUCKS COF'F'EE STORE WITH A DRIVE.THRU AT 6277 COMMERCE BOULEVARD (APN 143-0s1-056) (Rich ard s ambucettt, "*T' ff;lf;li Ë1"ïîr fo r rerry Johns on, WHEREAS, the dpplicant, Richard Sambucetti, for Terry Johnson, Best Development Group, filed Planning Application No. PL20L2-007SR for a Conditional Use Permit, Site Plan Review and Architectural Review to allow a Starbucks Coffee shop with a drive-thru located at 6277 Commerce Boulevard (APN 143-051-056), in accordance with the City of Rohnert Park Municipal Code; \ryHEREAS, Planning Application No. PL2012-007SR was processed in the time and manner prescribed by State and local law; WHEREAS, public hearing notices for the Conditional Use Permit were mailed to all property o\ilners within a 300 foot radius of the subject property and to all agencies and interested parties as required by California State Planning Law, and a public hearing notice was I'ublished in the Press Democrat for a minimum of l0 days prior to the first public hearing; WHEREAS, on April 26,2072, the Planning Commission reviewed Planning Application No. PL20|2-007SR during a scheduled public meeting at which time interested persons had an opportunity to testify either in support of or opposition to the project; and WHEREAS, at the Apúl,26,2012, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PL20I2-007SR; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:, Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PL20I2-007SR makes the following factors, to wit: A. That the developments general appearance is compatible wíth existing development and enhance s the surrounding neighborhood. Criteria Satisfied. The appearance of the proposed Starbucks building will be compatible with the two largs existing commercial builAings in the shopping center. The area around the new building will be attractively landscaped to add to the appearance of the new building and the shopPing center. B. That the development incorporates ø variationfrom adiacent on-site and off-síte structures n hà6ht, butk, and. area; arrangement on the parcel; openings or breaks in thefaçadefacing the street; and/or the líne and pitch of the roof, Criteria Satisfied. The proposed building will result in a variation in the roof line of the brtldittg t*t"dtrg a towerilement, articulation in the façade including cloth awnings, accent wall lights and a tower element to enhance the appearance of the restaurant building. The architecturé of the building will stand out as an attractive visual element in this commercial comPlex. C. That the development will be located and oriented ín such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropríate, and avoíds índiscrimínate locatíon and oríentation. Criteria Satisfied. The Sonoma Gateway Center has been in this location for many years *¿ ttrr location has been conducive to vehicular, pedestrian and bicycle access. The Starbucks Coffee shop will be easily accessible to other commercial development in the area and the location at a major commercial hub in the city is easily accessible by automobile. Section 3. Findings. The Planning Commission, in approving Planning Application No. PL20121-007SR makes the following findings, to wit; A. That the proposed locatíon of the condítional is consistent with the objectives of the Zoníng Oid¡nance ønd the purposes of the district ín which the site is located. The proposed location is zoned C-R Regional Commercial which permits a coffee store with a drive-thru window subject to conditional use approval. The use will have little or no impact on the existing businesses in the shopping cente-r and will improve the appearance of the Sonoma Gateway center from Commerce Boulevard. B. That the proposed location of the condítional use and the conditions under which it would be-operated or maíntained. will not be detrirnental to the publíc health, saþty, or welfare, or materially injurious to properties or ímprovements in the vícínity, and that the operation and. maíntenance of the Conditional Use will be compatíble with the surrounding uses. The Starbucks with a drive-thru will not have a detrimental impact on the surrounding commercial uses in the shopping center. The drive-thru wilt provide more than the required qqeuing for vehicleJ and Starbucks will be providing more than the required parking for the use. C. That the proposed conditíonal use will comply with each of the applicable provisions of thís Title. As discussed in the staff report, the project will comply with all applicable standards in the Zoning Ordinance. Section 4. Environmental Clearance. This proposal is categorically exempt from the requirements of the California Environmental Quality Act CEQA Class I Section 15303 (c) A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area. No further action is required pertaining to environmental review. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PL20I2-007SR subject to the following conditions: l. The Site Plan Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency. 3. The outdoor patio area shall be appropriately furnished with outdoor seating and trash receptacles. 4. The speaker system for the drive-thru window shall emit no more than fifty decibels four feet between the vehicle and the window and shall not be audible above daytime ambient noise levels beyond the property boundaries. 5. The plans that are submitted for building permit shall include a minimum of five (5) bicycle parking spaces location subject to approval of the Development Services Department. 6. All signs for Starbucks shall conform to the Rohnert Park Retail Center Master Sign Program. 7. All refuse containers shall be kept in the refuse enclosure at all times with the access gates in a closed position. 8. If vehicles in the drive-thru lane result in vehicles stacking up into Commerce Boulevard, Starbucks shall take any necessary steps including placing an employee at the drive-thru lane entrance to direct traffic, details subject to approval of the Development Services Department. 9. All landscaping on the Starbucks site shall be maintained in a weed free litter free condition at all times. 10. The landscape area shall be provided with an automatic irrigation system for 100% coverage. 11. The project shall be developed in accordance with attachments I through 9 attached to this resolution. BE IT FURTHER RESOLVED that said action shall not be deemed frnal until the appeal period has expired and that the appeal period shall be 10 working days from the date of rãí¿ uriion. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
