2012/05/10 Planning Commission Resolution (2)PLANNING COMMMISSION RESOLUTION NO. 2012-OI3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR MODIFICATION TO THE BUILDING COLORS AND SIGNS FOR CHILI'S RESTAURANT LOCATED AT 485I REDWOOD DRIVE (APN 04s-0ss-020) (Kristy Tornga, GHA Architects for Chili's Grill and Bar) WHEREAS, the applicant, Kristy Tornga, GHA Architects for Chili's Restaurant, filed Planning Application No. PL20l2-016SR for Site Plan and Architectural Review to allow new building colors and signs for Chili's Restaurant located at 4851 Redwood Drive (APN 045-055- 020), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PL2012-016SR was processed in the time and manner prescribed by State and local law; WHEREAS, public hearing notices were mailed to all property owners within a 300 foot radius of the subject property and to all agencies and interested parties as required by California State Planning Law, and a public hearing notice was published in the Community Voice for a minimum of 10 days prior to the first public hearing; WHEREAS, on May 10,2012, the Planning Commission reviewed Planning Application No. PL2012-0l6SR during a scheduled public meeting at which time interested persons had an opportunity to testify either in support of or opposition to the project; and WHEREAS, at the May 10, 2012, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Planning Commission considered all the facts relating to Planning Application No. PL20l2-016SR; NO\il, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and conect. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PL20l2-016SR, makes the following factors, to wit: A. That the developments general appeorance is compatible with exísting development and enhances the surrounding neighborhood. Criteria Satisfied. The subject property is developed with a Chili's Restaurant that was constructed in 1993. The existing restaurant use is permitted in the C-R Regional Commercial District. The proposed modifications to the exterior of the building and signs will improve the appearance of the building and signage and be an asset to the surrounding commercial uses in the area. B. That the development incorporates a variationfrom adjacent on-site and offsite structures in height, bulk, and area; aruangement on the parcel; openings or brealcs in the façade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The proposed remodeling of the building will result in a bolder appearance to the building and will conform to the neo-Mediterranean architectural theme in this area. The architecture of the building will stand out as an attractive visual element in this commercial complex. C. That the development will be located and oriented in such a mclnner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientatíon. Criteria Satisfied. Chili's Restaurant has been in this location for many years and the location has been convenient to pedestrian and bicycle access. The restaurant is easily accessible to other commercial development in the area and the location of the restaurant at a major commercial hub in the city is easily accessible by automobile. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act, Article 19, Section 15301 (Existing Facilities). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PL20l2-016SR subject to the following conditions: l. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency including, but not limited to, the Federal Communications Commission (FCC) and the Federal Aviation Administration (FAA). 3. The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building for the project. 4. The project is approved as shown in Exhibits A thru L, except as conditioned or modified below. 5. Any landscaping damaged during construction shall be replaced. 6. The applicant shall provide a minimum of four (4) bicycle parking spaces as close as feasible to the front entrance to the restaurant. 7. The LED band shown on Exhibits B and C shall not be installed on the building. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 working days from the date of sãid a.iion. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
