A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK CALIFORNIA, APPROVING SITE PLAN AND
ARCHITECTURAL REVIEW FOR THE EXTERIOR BUILDING MODIFICATIONS
FOR THE 99É ONLY STORE AT 415 ROHNERT PARK EXPRESSWAY

\ryHEREAS, the applicant, Ken McCracken, PM Design Group Architects for 99(, Only
Stores, filed Planning Application No. PL20l2-0l8SR for Site Plan and Architectural Review to
allow the exterior remodel of an existing building for 99þ Only Stores on property located at 415
Rohnert Park Expressway (APN 143-391-042), in accordance with the City of Rohnert Park
Municipal Code;
WHEREAS, Planning Application No. PL20l2-0l8SR was processed in the time and
manner prescribed by State and local law;
WHEREAS, on May 24,2012, the Planning Commission reviewed Planning Application
No. PL2012-0l8SR during a scheduled public meeting at which time interested persons had an
opportunity to testify either in support of or opposition to the project; and,
\ryHEREAS, at the May 24,2012, Planning Commission meeting, upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PL20l2-0l8SR;
NO\il, THEREFOREO THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors considered. The Planning Commission, in approving Planning
Application No. PL20l2-0l8SR, makes the following factors, to wit:
A. That the developments general appearance ís compatible with exísting development and
enhances the surrounding neíghborhood.
Criteria Satisfied. The subject property is developed with a shopping center and the
building the applicant will occupy is also the location of Burlington Coat Factory, Target
Store and JoAnn's Fabrics and Crafts. The proposed use is permitted in the C-R
Regional Commercial District. The proposed modifications to the exterior of the
building and site will improve the appearance of the building and be an asset to the
surrounding commercial uses in the area.
B. That the development incorporates a variationfrom adjacent on-site and oín5¡s
stnrctures ín heíght, bulk, and area; arrangement on the parcel; openings or breaks in
the façade facing the street; and/or the line and pitch of the roof.
Criteria Satisfred. The proposed remodeling of the building will result in a variation in
the roof line of the building consisting of a raised area over the applicant's store front
with the tenant's name providing articulation in the building façade. The architecture of .
the building will stand out as an attractive visual element in this commercial complex.
C. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and oríentatíon.
Criteria Satisfied. This shopping center is easily accessible from Rohnert Park
Expressway and Redwood Drive. There are bicycle lanes on both streets for the
convenience of those riding bicycles to the center. The property is also easily accessible
to other shopping facilities to the west of the subject property.
Section 3. Environmental Clearance. The project is categorically exempt from the
California Environmental Quality Act, Article 19, Section 15301 (Existing Facilities).
NOW THEREFORE BE IT RESOLVED' that the Planning Commission does hereby
approve Planning Application No. PL2012-0l8SR subject to the following conditions:
1. The Site Plan and Architectural Review approval shall expire one year from the Planning
Commission approval date, unless prior to the expiration a building permit is issued and
construction is commenced and diligently pursued toward completion and the use is
initiated, or an extension is requested and approved.
2. The facility shall comply with any and all applicable provisions of the Rohnert Park
Municipal Code and any state or federal agency.
3. Any landscaping damaged during construction shall be replaced.
4. The applicant shall provide a minimum of four (4) bicycle parking spaces adjacent to the
entrance to the building.
5. When the store is not open, any shopping carts that cannot be accommodated in the cart
storage corral shall be stored within the building.
6. The existing building walls along the applicant's building frontage shall be painted to
match the colors of the new portion of the building.
7. Any damaged wood trim at the rear of the building shall be repaired and/or replaced.
8. The slats in the chain link fence enclosing the pallet storage area shall be replaced and
painted to match the building walls.
9. The entire rear building wall under lease to the applicant shall be painted to match the
existing walls of the building.
10. The refuse containers shall be kept in the refuse enclosure at all times with the access
gates closed.
I l. The metal canopy roofs at the rear of the building shall be painted the same blue color as
the standing seam metal roof on the front of the building.
12. The engines of delivery trucks shall be turned off if the truck stands idling for more than
ten (10) minutes.
13. Merchandise for sale shall not be displayed on the exterior of the building in the sidewalk
across the applicant's building frontage.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 24th day of May, 2012 by the City of
Rohnert Park Planning Commission by the following vote:
