A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARKO CALIFORNIA APPROVING A SIGN PROGRAM FOR THE ARBORS
COMMERCTAL TENANTS LOCATED AT 440-490 CITY CENTER DRrVE (APN 143-
051-081), FILE NO. PL2012-020SR
\ryHEREAS, the applicant, Tony Anthony Holland for Burbank Housing, has submitted
an application for the review of the Sign Program for the Arbors Commercial Tenants 440-490
City Center Drive (APN I 43-05 1 -08 I );
WHEREAS, Planning Application No. PL2012-020SR was processed in the time and
manner prescribed by State and local law;
WHEREAS, on June 14,2012, the Planning Commission held a public meeting at which
time interested persons had an opportunity to testify either in support or opposition to the
proposal; and
NOW, THEREFORE BE IT RESOLVED, that the Planning Commission of the City
of Rohnert Park does resolve, determine and order as follows:
Section 1. That the above recitations are true and correct.
Section 2. Findings. The Planning Commission, in approving the signage proposed in
application PL20|2-020SR makes the following findings; to wit:
I. That the proposed locatíons of the signs are ín accordance with the objectíves of the
Zoníng Ordínance and the purposes of the district ín which the sign is located;
The proposed signage is within an acceptable range of square footage as analyzed in this
report and will not exceed the maximum sign area for wall signs as permitted in the M-U
Mixed Use zoning district.
2. That the proposed locations of the sígns and the conditíons under which the sign would
be operated and maintaíned will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the vicinity.
The proposed location of the wall signs and window signs will continue to maintain the
public's health, safety and welfare. The work will be completed with the appropriate permits.
All signs will be attractive and present an orderly appearance in accordance with the
regulations and standards of the ZoningOrdinance.
3. The proposed signage ís ín substantial conformance wíth the provisions of the Zoning
Ordinance.
The signage is appropriately sized, located, and designed based on the scale of the building.
The proposed locations of the signs are in accordance with the Zoning Ordinance and
purpose of the M-U Mixed Use ZoningDistrict in which the signs are located.
Section 3. Environmental Clearance. The project is categorically exempt from the
California Environmental Quality Act (CEQA), pursuant to Public Resources Code Section
l53l 1 Class 1 I (a) On-premise signs.
NO\il THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve the applicant's request for a Sign Program for the building located at 440-490 City
Center Drive File No. PL2OL2-020SR (APN: 143-051-81), subject to the following conditions of
approval:
1. Expi_ration of Approval - Pursuant to the City of Rohnert Park Municipal Code, a Sign
Program approval shall expire one year from its date of issuance unless the sign or at least
one sign in an approved Sign Program has been installed in accordance with the conditions of
approval. Prior to expiration, the applicant may apply for an extension of up to one
additional year. The extension shall be reviewed by the review authority that acted on the
original request.
Substantial Conformance - All improvements shall be in substantial conformance with
approved Arbors Commercial Sign Program plans that are date stamped received by the City
of Rohnert Park May 16,2012.
2. Conformance with Municipal Code and Other Aggncy Plans - All improvements shall
comply with all applicable sections of the City of Rohnert Park Municipal Code and any
other applicable relevant plans ofaffected agencies.
3. Permits - The applicant shall obtain all necessary permits and clearances from the Rohnert
Park Building and Development Services Departments prior to installation of the signs.
4. All window signs shall conform to the requirements of Zoning Ordinance Section
17 .27 8.080L V/indow Signs.
BE IT FURTHER RESOLVED, that said action shall not be deemed frnal until the
appeal period has expired and that the appeal period shall be l0 working days from the date of
said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this l4th day of June, 2012, by the City of
Rohnert Park Planning Commission by the following vote:
