2012/09/27 Planning Commission ResolutionPLANNING COMMMISSION RESOLUTION NO. 2012.24 A RESOLUTION OF THE PLANNING COMMISSION OF THE crTY oF ROHNERT PARK CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, SITE PLAN REVIE\il AND ARCHITECTURAL REVIE}V FOR A WALGREENS AT 628s COMMERCE BOULEVARD (APN 143-0s1-083) (David Johnson, Johnson Lyman Architects for PMB Development Company) WHEREAS, the applicant, David Johnson, for PMB Development Company, filed Planning Application No. PL2012-035UP/SR for a Conditional Use Permit, Site Plan Review and Architectural Review to allow a Walgreens with a drive-thru pharmacy window located at 6285 Commerce Boulevard (APN 143-051-083), in accordance with the City of Rohnert Park Municipal Code; \ryHEREAS, Planning Application No. PL2012-035UP/SR was processed in the time and manner prescribed by State and local law; WHEREAS, public hearing notices for the Conditional Use Permit were mailed to all property owners within a 300 foot radius of the subject property and to all agencies and interested parties as required by California State Planning Law, and a public hearing notice was published in the Community Voice for a minimum of 10 days prior to the first public hearing; \ryHEREAS, on September 27,2012, the Planning Commission reviewed Planning Application No. PL20I2-035UP/SR during a scheduled public meeting at which time interested persons had an opportunity to testify either in support of or opposition to the project; and, WHEREAS, at the September 27,2012, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PL20L2-035UP/SR; NOW' THEREFORE' THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PL20I2-035UP/SR makes the following factors, to wit: A. That the developments general appearance is compatible with exísting development and enhances the surrounding neighborhood. Criteria Satisfied. The appearance of the proposed Walgreens building will be compatible with the remaining commercial building in the shopping center. The area around the new building will be attractively landscaped to add to the appearance of the new building and the shopping center. The design details of the new building conform to the recently adopted Design Guidelines. B.That the development íncorporates a variatíonfrom adjacent on-site and offsite structures in heíght, bulk, and area; arrangement on the parcel; openings or breaks ín thefaçadefacing the street; and/or the line and pítch of the roof, Criteria Satisfied. The proposed building will result in a variation in the roof line of the building including tower elements at the comers of the building, articulation in the façade including fabric awnings, accent wall lights and a decorative stone veneer to enhance the appearance of the Walgreens building. The architecture of the building will stand out as an attractive visual element in this commercial complex. That the development will be locøted and oríented in such a manner so as to provide pedestrían, bicycle and vehicular connectíons with adjacent properties, as appropriate, and avoids indiscrimínate location and orientation. Criteria Satisfied. The Sonoma Gateway Center has been in this location for many years and the location has been conducive to vehicular, pedestrian and bicycle access. The Walgreens will be easily accessible to other commercial development in the area and the location at a major commercial hub in the city is easily accessible by automobile. Section 3. Findines. The Planning Commission, in approving Planning Application No. PL20|2-035UP/SR makes the following findings, to wit; That the proposed location of the conditional is consístent wíth the objectíves of the Zoníng Ordinance and the purposes of the distríct in which the site is located. The proposed location is zoned C-R Regional Commercial which permits a Walgreens with a drive-thru pharmacy window subject to conditional use approval. The use will have little or no impact on the existing businesses in the shopping center and will improve the appearance of the Sonoma Gateway Center from Commerce Boulevard and Rohnert Park Expressway. That the proposed location of the condítíonal use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or ímprovements in the viciníty, and that the operation and maintenance of the Condítíonal Use wíll be compatible with the sumounding uses. The Walgreens drive-thru will not have a detrimental impact on the surrounding commercial uses in the shopping center. The drive-thru will provide adequate queuing for vehicles and Walgreens will be providing the required parking for the use. An escape lane will be provided for those customers who wish to exit the drive-thru window driveway prior to the window location. That the proposed conditional use will comply with each of the applicable provísions of this Title. C. A. B. C. D. As discussed in the staff report, the project will comply with all applicable standards in the Zoning Ordinance. Section 4. Environmental Clearance. This proposal is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) Section 15302 Class 2 (c) Replacement of a commercial structure with a new structure of substantially the same size, purpose and capacity. No further action is required pertaining to environmental review. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PL2012-03UP/SR subject to the following conditions: 1. The Conditional Use, Site Plan Review and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration, a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code and any state or federal agency requirements. Prior to the installation of any signs, Walgreens shall amend the existing Sign Program for the shopping center. All refuse and recyclables shall be maintained in the compactor enclosure areas at all times and shall not be stored in such a manner that they are visible from the exterior of the building. All materials in the storage enclosure at the rear of the building shall be retained in the enclosure at all times with the gates closed. 6. All landscaping on the site shall be maintained in an attractive weed free condition at all times. 7. The landscape plan shall include some native trees, details subject to Development Services approval. 8. The applicant shall landscape, irrigate and maintain the area under the ownership of Caltrans between the rear of the property and the Rohnert Park Expressway right-of- way, details subject to Development Services staff and CalTrans approval. 9. All shopping carts for Walgreens shall be stored within the building. 10. Prior to offering health services in the V/algreens facility, Walgreens shall provide Development Services with details on the operation including services offered, hours of operation, number of employees and a detailed floor plan of the portion of the building that will be devoted to that service. I l. The proposed redevelopment of the subject site shall address all existing utilities and easements which are in conflict with the proposed building. For example, including but not limited to the existing Access Easement in favor of Lot l-A shown on city of Rohnert Park Parcel Map No. 179 and existing water and sewer pipes shown on Rohnert Park Retail improvement plan. There may be other conflicts than what is previously described with the proposed building and if so, all conflicts shall be addressed prior to issuance of a building permit. 12. The proposed curb on the easterly side of the property shall be designed and constructed entirely on the subject property. J. 4. 5. 13. 14. 15. Site plans shall be designed by a California registered Civil Engineer, submitted and approved prior to issuance of a building permit. Per the ZoningOrdinance requirements, the applicant shall provide three (3) bicycle parking spaces. Walgreens hours of operation: Store Monday- Saturday 8:00 a.m. to 10:00 p.m. Sunday 9:00 a.m. to 10:00 p.m. Pharmacy/Clinic Pharmacy Monday-Friday Sat and Sunday 9:00 a.m. to 9:00 p.m. l0:00 a.m. to 6:00 p.m. Any expansion of the hours shall be subject to Development Services Department approval. BE IT FURTHER RESOLVED that said action shall not be deerned final until the appeal period has expired and that the appeal period shall be l0 working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
