A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARK, CALIF'ORNIA, APPROVING FILE NO. PL2010-079UP: USE PERMIT TO
ALLO\ry A FREEWAY ORIENTED SIGN FOR RUG\ryORKS LOCATED AT 5879
COMMERCE BOULEVARD (APN 143-021-039)
WHEREAS, the applicant, Signall Systems representing Rugworks, has filed Planning
Application No. PL20I0-079UP for Use Permit approval to allow a freeway oriented wall sign in
an l-LlO Industrial/Office Overlay District on property located at 5879 Commerce Boulevard
(143-021-039) in accordance with the City of Rohnert Park Municipal Code;
\ilHEREAS, Planning Application No. PL2010-079UP was processed in the time and
manner prescribed by State and local law;
WI:fEREAS, public hearing notices were transmitted to all property owners within a 300
foot radius of the subject property and to all agencies and interested parties as required by
California State Planning Law, and a public hearing notice was published in the Communitv
Voice for a minimum of 10 days prior to the first public hearing;
WIIEREAS, on January 27, 2011, the Planning Commission reviewed Planning
Application No. PL2010-079UP during a scheduled public meeting at which time interested
persons had an opportunity to testify either in support or opposition to the project; and
WHEREAS, at the January 27,2011 Plaruring Commission meeting, upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PL20l0-079UP;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Findines. The Planning Commission, in approving Planning Application
No. PL2010-072UP makes the following findings, to wit:
L The proposed location of the conditional use is consistent with the objectives of the Zoning
Ordinance and the purpose of the district inwhich the site is located.
The proposed location is within the I-LIO Industrial/Office Overlay District, which allows
freeway oriented signs subject to a conditionally permiued use. The applicant has applied for
the required conditional use permit.
2. That the proposed location of the use and the conditions under which ít would be operated or
maintained will not be detrimental to the public health, safety, or welfare, or materiolly
ínjurious to properties or improvements in the vicinity and that the operation and
maintenance of the use wíll be compatíble with the surrounding uses; and
The project will not have a negative effect on the public health, safety, or welfare or be
materially injurious to properties or improvements in the vicinity. The proposed sign will
only be visible from motorists traveling on Highway l0l. It will not be visible from adjacent
properties or from Commerce Boulevard.
3. The proposed use will comply with each of the applicable provisions of this title.
The proposal will be approved under the conditional use permit process. Under the
conditional use, the size and height of the sign is approved as submitted by the applicant.
The size, color and illumination of the sign conforms with the purpose of the Chapter 17.27
of the Zorung Ordinance regarding signs in that the proposal for the freeway oriented sign is
appropriately scaled and in harmony with the character and appearance of the building.
Section 3. Environrlrental Clearance. The project is categorically exempt from the
California Environmental Quality Act, pursuant to California Code of Regulations, Article 19
Categorically Exemptions, Section 15311 Accessory Structures (a) On- premises signs
NO\il THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PL20I0-079UP to allow a freeway oriented sign at 5879
Commerce Boulevard (APN 143-021-039), subject to the following conditions:
1. Expiration of Approval - Pursuant to the Cþ of Rohnert Park Municipal Code, this
approval shall expire one yerir from the Planning Commission approval date, unless prior
to the expiration a sign permit is issued (if required) for the sign and construction is
conìmeneed and diligently pursued toward completion, or an extension is requested and
approved.
2. Conformance with Municipal Code and Other Agency Plans - All improvements shall
comply with all applicable sections of the City of Rohnert Park Municipal Code a¡d any
other applicable relevant plans of aflected agencies.
3. The applicant shall obtain all necessary permits and clearances from the Rohnert Park
Building Department.
4. This sign shall be maintained in a neat and attractive condition at all times.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be 10 working days from the date of
said action. No sign permits shall be issued until the appeal period has expired, providing there
are no appeals.
DULY AND REGULARLY ADOPTED on the 27th day of January, 2011, by the City
of Rohnert Park Planning Commission by the following vote:
