PL 2011.017SR \ilHEREAS, the applicant, Lori Wintçr, Explore Creative, has submitted an application for the review of the Sign Program for the shopping center located at6335 Commerce Boulevard (APNl43-051-073); WHEREAS' Planning Application No. PL2011-017SR was processed in the time and manner prescribed by State and local law; \ryHEREAS, on May 26,20ll,the Planning Commission held a public meeting at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and NO\ry, THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Rohnert Park does resolve, determine and order as follows: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving the signage proposed in application PL20|1-017SR makes the following findings; to wit: L That the proposed locations of the signs are in accordance wíth the objectives of the Zoning Ordinance and the purposes of the district in which the sign is located; The proposed signage is within an acceptable range of square footage as analyzed in this report and will not exceed the maximum sign area for wall signs or for the monument sign as permitted in the C-R Regional Commercial zoning district. 2. That the proposed locations of the signs and the conditíons under which the sign would be operated and maintained will not be detrimental to the publíc health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. The proposed locations of the monument sign, wall signs, and window signs will continue to maintain the public's health, safety and welfare. The work will be completed with the appropriate permits. All signs will be attractive and present an orderly appearance in accordance with the regulations and standards of the Zoning Ordinance. 3. The proposed signage is in substantial conformonce with the provisions of the Zoning Ordinance. The signage is appropriately sized, located, and designed based on the scale of the building. The proposed locations of the signs are in accordance with the Zoning Ordinance and purpose of the C-R Regional Commercial Zoning District in which the signs are located. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to Public Resources Code Section 1531 I (Class I I (a) On-premise signs. NO\ry THEREFORE BE IT RESOLVED, thatthe Planning Commission does hereby approve the applicant's request for a Sign Program for the building located at 6335 Commerce Boulevard File No. PL2011-0l7SR (APN: 143-051-073), subject to the following conditions of approval: l. Expiration of Approval - Pursuant to the City of Rohnert Park Municipal Code, a Sign Program approval shall expire one year from its date of issuance unless the sign or at least one sign in an approved Sign Program has been installed in accordance with the conditions of approval. Prior to expiration, the applicant may apply for an extension of up to one additional year. The extension shall be reviewed by the review authority that acted on the original request. Conformance - All improvements shall be in conformance with the approved North Bay Center Sign Program plans that are date stamped received by the City of Rohnert Park May 26,2011. 2. Conformance with Municipal Code and Other Agency Plans - All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 3. Permits - The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Development Services Departments prior to installation of the signs. 4. All window signs shall consist of white vinyl letters or equivalent. BE IT FURTHER RESOLVED, that said actiort shall not be deemed final until the appeal period has expired and that the appeal period shall be l0 working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
