2010/02/25 Planning Commission ResolutionPC RESOLUTION NO. 2O1O-03 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA APPROVING AMENDMENTS TO EXISTING SIGN PROGRAM FOR PROPERTY LOCATED AT 6591.6599 COMMERCE BOULEVARD (APN 143-0sl -0 I 2) (Malcolm BoothAtrAMO Co., LLC) WHEREAS, the applicant, Malcolm Booth, NAMO Co., LLC) has submitted an application for the review of the Rohnert Park Mall Sign Program for the building located at 659 I -6599 Commerce Boulevard (APN I 43 -05 I -012); WHEREAS, Planning Application No. PL20l0-00lSR was processed in the time and manner prescribed by State and local law; \ryHEREAS, on February 25, 2010, the Planning Commission held a public meeting at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and \ilHEREAS, the Planning Commission of the City of Rohnert Park makes the following findings: NOW, THEREFORE BE IT RESOLVED, THAT THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, FIND, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving the sign program proposed in application PL2010-001SR makes the following findings; to wit: 1. That the proposed locations of the signs are in accordance with the objectives of the Zoning Ordinance and the purposes of the distríct ín which the sign is located; Criteria Satisfied. The proposed signage is within an acceptable range of square footage as analyzed in this report and is in accordance with the City's Sign Ordinance; 2. That the proposed locatíons of the signs and the conditions under which the sign would be operated and maintained will not be detrimental to the publíc health, safety, or welfare, or materially injurious to properties or ímprovements in the vicinity. Criteria Satisfied. The proposed locations of the monument sign, wall signs, directory sign and window signs would not impact the public's health, safety and welfare. The work will be completed with the appropriate permits. All signs will be attractive and present an orderly appearance in accordance with the regulations and standards of the Zoning Ordinance. 3. The proposed signage is in substantial conþrmance with the provisions of the Zoning Code. Criteria Satisfied. The signage is appropriately sized, located, and designed. The proposed locations of the signs are in accordance with the Zoning Ordinance and purpose of the *C-R" Regional Commercial zoning district in which the signage would be located. Section 3. Environmental Clearance. The project is categorically exempt from CEQA, pursuant to Public Resources Code Section l53l I (Class 1 I - Accessory Structures). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve the applicant's request for revisions to the Master Sign Program for the building located at 6591-6599 Commerce Boulevard (APN 143-051-012); subject to the following conditions of approval: 1 . Expiration of Approval - Pursuant to the City of Rohnert Park Municipal Code, this approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued for one sign and construction is commenced and diligently pursued or an extension of time is requested prior to the expiration date. 2. Substantial Conformance - All improvements shall be in substantial conformance with the approved Rohnert Park Mall Updated Master Sign Program that is date stamped received by the City of Rohnert Park January 27,2010 and shall supersede any previous sign program. 3. Conformance with Municipal Code and Other Agency Plans - All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 4. Permits - The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Development Services Department prior to sign installation. 5. A table that provides a calculation of all on-site signage (including freeway, monument, wall and directory) shall be submitted for any future sign installation/revisions to demonstrate that on-site signage does not exceed 480 square feet total. BE IT FURTHER RESOLVED, that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be l0 calendar days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
