PL2010-051SR: SITE PLAN REVIE\ry AND ARCHITECTURAL REVIEW TO ALLO\ry RENOVATION OF NORTH BAY CENTRE INCLUDING 24 HOUR FITNESS AND A NEW 2,500 SQUARE FOOT COMMERCIAL BUILDING LOCATED AT 6335 COMMERCE BOULEVARD \ilHEREAS, the applicant, Colin Russell, Russell Architects on behalf of Steven Jaeger, NBC Partners, LLC, has frled Planning Application No. PL2010-05lSR for Site Plan Review and Architectural Review approval to allow the renovation of North Bay Centre Shopping Centre including a new 2,500 square foot commercial building and tenant improvements for 24 Hour fitness in the former Rite Aid portion of the building in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PL2010-051SR was processed in the time and manner prescribed by State and local law; WHEREAS, on October 14, 2010, the Planning Commission reviewed Planning Application No. PL2010-05ISR during a scheduled public meeting at which time interested persons had an opportunity to testify either in support or opposition to the project; WHEREAS, At the October 14,2010, Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Planning Commission considered all the facts relating to Planning Application No. PL20l0-05lSR; NOW' THEREFORE, THE PLANNING COMMISSION OF THE CITY OF' ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLO\ilS: Section 1. That the above recitations are true and correct. Section 2. Factors Considered. The Planning Commission, in approving Planning Application No. PL2010-05lSR, makes the following factors, to wit: l. The development's general appearance is compatible with existing development and enhances the surrounding neighborhood; The proposed renovation of the shopping center will enhance its appearance and give it a more contemporary look compared to the existing dated architecture of the center. The revisions to the shopping center will stand out as a major improvement to this key commercial area. 2. That the development incorporates a varíation from adjacent on-site and offsite structures ín height, bulk, and area; arrangement on the parcel; openings or breaks in the façade facing the street; and/or the line and pitch of the roof; and The renovation of the existing buildings on the site will include new entry elements for the existing grocery store and for 24 Hour Fitness both located in the main building on the site. The two raised roof elements will provide a more interesting roof line for the building and emphasize the entry to these two businesses. The new 2,500 square foot commercial building will have variations in the roof line and awnings to break up the building walls. The use of metal roofing and a new color scheme for all buildings on the site will enhance the appearance of the center. 3. That the development will be located and oriented in such a manner so as to províde pedestrian, bicycle and vehícle connections with adjacent properties, os appropriate, and avoids indiscriminate location and orientation. There will be a marked pedestrian passage way from the bus stop on the Commerce Boulevard frontage of the property to the new commercial building and will continue on to the walkway along the front of the main building. Bicycle parking will be provided in the center including a secure bicycle storage building for 24 Hour Fitness. There is pedestrian and vehicle connection to the shopping center to the south of this property and a signal giving pedestrian and vehicle access to the Safeway center across Commerce Boulevard. Section 3. Environmental Clearance. This item is exempt under CEQA Article 19, Categorical Exemptions Section 15301 Existing Facilities Class I consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alternation of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination and Section 15303 Class 3 consists of construction and location of limited numbers of new, small facilities or structures not exceeding2,50D square feet in floor area. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PL2010-05lSR to allow the renovation of North Bay Centre Shopping Center including a new 2,500 square foot commercial building and tenant improvements for 24 Hour Fitness in the former Rite Aid portion of the building: l. Expiration of Approval - Pursuant to the City of Rohnert Park Municipal Code, this approval shall expire one year from the Planning Commission approval date, unless prior to the expiration, a building permit is issued (if required) for any improvements and construction is commenced and diligently pursued toward completion and/or the use is initiated, or an extension is requested and approved. 2. Conformance with Municipal Code and Other Agency Plans - All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 3. The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building Department. 4. The project is approved as shown in Exhibits A thru P, except as conditioned or modified below. 5. All utilities shall be shown on the drawings for a Building Permit. 6. Prior to issuance of a Building Permit, there is a drainage easement under the location of the proposed new commercial building that will have to be relocated, details subject to approval of the City Engineer. 7. All sewer lines will have to be inspected prior to any new connections. 8. The new commercial building and 24 Hour Fitness shall utilize water-conserving devices including but not limited to low-flush toilets and low-flow showers and faucets where applicable. 9. Improvement plans shall be submitted showing how the proposed pad building is planned to be served by water, sewer and storm drain utilities. 10. The appropriate Public Art Fee shall be paid at the time of Building Permit issuance, with the final fee amount to be determined at that time, based on the most current construction cost estimate for the project. I 1. All alterations and new construction where a permit is required shall comply with the City of Rohnert Park Green Building requirements as specified in Rohnert Park City Ordinance782. 12. All improvements shall be in substantial conformance with the approved site plan, exterior elevations and colors and materials board, except as modified herein. 13. The project shall comply with all applicable accessibility requirements. All crosswalks and pedestrian paths within the parking areas shall be constructed of a decorative paving material, subject to staff approval. 14. The new retail building shall be sprinklered as directed by Public Safety and all applicable building codes. 1 5. The sprinkler system in the portion of the building to be occupied by 24 Hour Fitness shall be upgraded per the requirements of the Development Services Building Division and Public Safety. 16. Fire access to all portions of the site shall be as determined by Public Safety. 17. All mechanical equipment shall be screened from public view, with final design subject to staff approval. 18. Handicap parking shall be provided in accordance with the current ADA requirements. 19. Adequate space and racks for bicycle parking shall be provided in compliance with the Municipal Code. 20.The new trash enclosures shall be finished to match the new retail building and renovated building and shall be provided with a decorative trim cap. The enclosures shall be designed so that it is large enough to accommodate recycling bins. The gates of the refr¡se enclosures shall be solid metal. 21. Prior to issuance of any building permits, landscape and irrigation plans shall be submitted for review and approval of the Planning Staff and City Engineer. 22. Any new trses within 5 feet of the public right-of-way shall have root barriers that are approved by the City Engineer. 23. Apermanent automatic sprinkler system shall be installed for all landscaped areas. 24. All exterior lighting shall be subject to approval of Public Safety. 25. ASign Program shall be submitted to the Planning Commission for its consideration. The sign program shall include wall signs and the proposed new monument sign. 26. All utilities shall be placed underground. 27. Allparking aroas, driveways and open storage areas shall be paved with asphalt surfacing. All site work including curbs, gutters, sidewalks and berms separating landscape areas from parking areas shall be concrete. All plans shall be prepared in accordance with City standards and submitted to the City Engineer for review and approval. 28. The parking lot for the shopping center shall be restriped prior to Certificate of Occupancy for24 Hour fitness, details subject to approval of the City Engineer. 29.The on-site drainage system shall be designed in accordance with the Sonoma County Water Agency's Flood Control Design Standards, details subject to approval of the City Engineer. 30. The developer shall comply with the construction hours pursuant to Municipal Code Section 9.44.120. 31. Video cameras shall be placed on the rear and front of that portion of the building occupied by 24 Hour Fitness showing the parking lot in the front and rear of the building including the access to the bicycle storage building. The video shall be monitored at the main entrance desk in 24Hour Fitness ona24 hour basis. 32. All structures including the existing north and south buildings shall be renovated with paint, roofing and architectural features consistent with the renovation of the westerly building. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 working days from the date of said action. No building permits shall be issued nor shall the use be initiated until the appeal period has expired, providing there are no appeals.
