NOW, THEREFORE, BE IT RESOLVED rhat the Planning commission of the city of Rohnert park makes the following findings, determinations and recommendations with respect to the proposed development area plan: section 1. The above recitations are true and correct. Section 2. The planning Commission has recommended City Council approval of the^ Final EIR for this Project, incluãing adoption of associated CEQA Findings, Statement of Oveniding Consideratidns, and the Iútigation Monitoring and Reporting Program, as described in Planning Commission Resolution No. ZO1O-3O, approved on November 16,2010 concurrently with the Planning Commission's approval of this Resolution. T\ W1!oY Glen project shall be developed in accordance with the General plan (GP), Southeast Specific Plan (SESP) including Design Guidelines, Final n.u"loprn"nt Plà (pOp), Mitigation-Me-asures (MM) identified in the Southeast Specifrc Plan Ënvironmental Impact Rãp9rt-(FEIR), Develop1tltlqttement (DA) between the city and Redwood Equities ,LLC,tnó Rohnert Park Municipal code (RPMC) and the Design and Construction Standards' General Requirements l) The applicant shall comply with all documents approved by the City Council and adhere to all verbal r-.pt t.ntutiont un¿ exhibits presentãd by the applcanl at the Planning Commissiorrál¿tor City Council meeting for approval of the Southeast Specific Plan project unless subsequently revised by the City' Z) In case of conflict between the various documents, the following order shall prevail: General plan as amended 2000, Mitigation Measures for the Final Environmental Impact Report (FEIR), Sàutheast Specific Plan (SESP), Final Development Plan (FDP)' Development Área plan @ÁP) and its conditions of approval, Development Agreement (DA), tentative Map and-its ionditions of Approval, RPMC, and Design and Construction Standards. 3) The applicant shall comply with the FEIR. In addition the applicant shall pay the cost to monitor the Mitigation Measures identified in the FEIR for the V/illow Glen project (SCH #2OO3ltZît f ¡ kept on file in the Development Services Department. The requirements contained in the Mitigation Monitoring Program (MYf) shall be incorporated into these conditions ãnd constructed in accordance with the MMP' 4) The applicant agrees to indemniff, hold harmless and defend the City, its offtcers, agents, elected *¿ uppãint"d officials, and employees, from any and all liability or claims that may be Urouöttt against the City arising out of its approval of this DAP save and except that caused by the City's active negligence' 5) By accepting the benefits conferred under this DAP, the applicant acknowledges all the conditions iñrposed and accepts this DAP subject to those conditions with full awareness of the provisiôns of the FDP, as may be amended from time to time, and the RPMC, as apPlicable. 6) The use of the property by th9 applicant/grantee for any activity authorized by this DAP shall constit#acôeptance of atiof tn" cónditions and obligations imposed by the City on this DAP. The signing plan shall be submitted to the City planning staff for review and aPProval. 14) The declaration of covenants, conditions and restrictions (cc&R's) filed for each development shall be prominently displayed in the project sate¡9!fy9 at all times' The CC&R,s shall apply equally to bóth o*ttêrr and renters. The CC&R's shall be written to require renters tã'cå*pty *ith ttt" regulations of the CC&R's, and a copy of the CC&R's shall be given to each renter. l5) The applicant shall provide a master signage program and a o'Master Model Home Signage,, ptog*rn f'or all residential ruUdiuitions in the Willow Glen community' The master rig*ö p-grams shall be reviewed and approved by the Planning Commission' l6) Design and placement of walls and fences for each residential neighborhood and public facility shalibe in accordance with the standards in the FDP and shatl be approved by planning staff. 17) All residential dwellings shall display illuminated street numbers in a prominent location in such a position that ihe numbeÀ are easily visible to approaching emergency vehicles from both directions.
