2009/07/23 Planning Commission ResolutionResolution 2009-18 Date: 7/23/09 PC RESOLUTION NO. 2009-18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, MAKING A FINDING OF GENERAL PLAN CONFORMITY FOR THE FUTURE SALE OF TWO CITY -OWNED PROPERTIES LOCATED ON THE WEST SIDE OF REDWOOD DRIVE, IMMEDIATELY NORTH AND SOUTH OF WILFRED AVENUE (APN 045-081-007 AND 045-082-053) (City of Rohnert Park) WHEREAS, the properties located on the west side of Redwood Drive, immediately north and south of Wilfred Avenue, are designated "Regional Commercial" on the City's General Plan Land Use Diagram; WHEREAS, the properties are of limited size and shape to support standalone developments consistent with the sites' General Plan designation; WHEREAS, the subject properties are adjacent to the "Wilfred/Dowdell Specific Plan" area that is proposed for future commercial development, so there is a potential for merger with the properties to the immediate west so to increase those properties' developability; WHEREAS, Planning Application No. 2009-018GP, General Plan Conformity Finding, was processed in the time and manner prescribed by State and local law; WHEREAS, on July 23, 2009, the Planning Commission reviewed Planning Application No. 2009-018GP, General Plan Conformity Finding, during a scheduled public meeting; and WHEREAS, at the July 23, 2009 Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. 2009- 018GP, General Plan Conformity Finding. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Finding. The Planning Commission makes the following Finding of General Plan Conformity for the future sale of properties located west side of Redwood Drive, immediately north and south of Wilfred Avenue (APN 045-081-007 and 045-082-053, respectively): The City of Rohnert Park's future sale of Assessor's Parcel Numbers 045-081-007 and 045-082-053 is consistent with the City's General Plan and its designation of the subject sites as "Regional Commercial," as the sites are intended to be developed with commercial uses and their sale to the adjacent properties within the "Wilfred/Dowdell Specific Plan" would maximize the developability of the subject properties. Resolution 2009-18 Date: 7/23/09 Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act, pursuant to California Code of Regulations Title 14, Chapter 3, Section 15332 (Class 32 — In -Fill Development Projects).
