2008/01/10 Planning Commission ResolutionN Item No.: 7/ File No.:PL2007-042SR PC RESOLUTION NO. 2008-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA APPROVING THE ENVIRONMENTAL SIGN PROGRAM FOR THE BUILDING LOCATED AT 6085 STATE FARM DRIVE (APN 143-021-078), FILE NO. PL 2007-042SR. WHEREAS, on the applicant, Tom Pforsich, has submitted an application for the review of the Environmental Sign Program for the building located at 6085 State Farm Drive (APN143- 021-078); WHEREAS, Planning Application No. PL2007-042SR was processed in the time and manner prescribed by State and local law; WHEREAS, on January 10, 2008, the Planning Commission held a public meeting at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and WHEREAS, the Planning Commission of the City of Rohnert Park makes the following findings: NOW, THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Rohnert Park does resolve, determine and order as follows: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving the signage proposed in application PL2007-042SR makes the following findings; to wit: 1. That the proposed locations of the signs are in accordance with the objectives of the Zoning Ordinance and the purposes of the district in which the sign is located; Criteria Satisfied. The proposed signage is within an acceptable range of square footage as analyzed in this report and does not exceed the maximum of 200 square feet permitted in the "I-L/O" zoning district. 2. That the proposed locations of the signs and the conditions under which the sign would be operated and maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Criteria Satisfied. The proposed locations of the monument sign, wall signs, and window signs will continue to maintain the public's health, safety and welfare. The work will be completed with the appropriate permits. All signs will be attractive and present an orderly appearance in accordance with the regulations and standards of the Zoning Ordinance. 3. The proposed signage is in substantial conformance with the provisions of the Zoning Code. The proposed locations of the signs are in accordance with the Zoning Ordinance and purpose of the "I-L/O" zoning district in which the sign is located. Section 3. Environmental Clearance. The project is categorically exempt from CEQA, pursuant to Public Resources Code Section 15301 (Class 1 — Minor Alterations to Existing Facilities). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve the applicant's request for Environmental Sign Program for the building located at 6085 State Farm Drive File No.: PL2007-042SR (APN: 143-021-078), subject to the following conditions of approval: Expiration of Approval — Pursuant to the City of Rohnert Park Municipal Code, this approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued or an extension of time is requested prior to the expiration date. Substantial Conformance - All improvements shall be in substantial conformance with approved Environmental Sign Program plans that are date stamped received by the City of Rohnert Park December 13, 2007. 2. Conformance with Municipal Code and Other Agency. P� — All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 3. Permits — The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Community Development Departments prior sign installation. BE IT FURTHER RESOLVED, that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
