2008/01/24 Planning Commission Resolution (2)Item No.: 4 File No.:PL2007-038SR PC RESOLUTION NO. 2008-05 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA APPROVING THE PARK PLAZA SIGN PROGRAM FOR THE BUILDINGS LOCATED BETWEEN 6314 AND 6420 COMMERCE BOULEVARD (APNS 143-051-028, 029, 032, 033, 067, 068 AND 069), FILE NO. PL 2007-038SR. WHEREAS, on November 5, 2007, the applicant submitted an application for the review of the Park Plaza Shopping Center Sign Program located between 6314 and 6420 Commerce Boulevard (APNS 143-051-028, 029, 032, 033, 067, 068 AND 069); WHEREAS, Planning Application No. PL2007-038SR was processed in the time and manner prescribed by State and local law; WHEREAS, on January 24, 2008, the Planning Commission held a public meeting at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and NOW, THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Rohnert Park does resolve, find, determine and order as follows: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving the signage proposed in application PL2007-038SR makes the following findings; to wit: 1. That the proposed locations of the signs are in accordance with the objectives of the Zoning Ordinance and the purposes of the district in which the sign is located,- Criteria ocated,Criteria Satisfied. The proposed signage is within an acceptable range of square footage as analyzed in this report; 2. That the proposed locations of the signs and the conditions under which the sign would be operated and maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Criteria Satisfied. The proposed locations of the monument sign, wall signs, and window signs will continue to maintain the public's health, safety and welfare. The work will be completed with the appropriate permits. All signs will be attractive and present an orderly appearance in accordance with the regulations and standards of the Zoning Ordinance. 3. The proposed signage is in substantial conformance with the provisions of the Zoning Code. Criteria Satisfied. The signage is appropriately sized, located, and designed. The proposed locations of the signs are in accordance with the Zoning Ordinance and purpose of the "C-R" zoning district in which the sign is located. The project is categorically exempt from CEQA, pursuant to Public Resources Code Section 15301 (Class 1 — Minor Alterations to Existing Facilities). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve the applicant's request for Environmental Sign Program for the building located at 6314 and 6420 Commerce Boulevard (APNS 143-051-028, 029, 032, 033, 067, 068 AND 069); subject to the following conditions of approval: 1. Substantial Conformance - All improvements shall be in substantial conformance with approved Park Plaza Sign Program plans that are date stamped received by the City of Rohnert Park Nov 5, 2007 and shall supersede any previous sign program. 2. Conformance with Municipal Code and Other Agency P� — All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 3. Permits — The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Community Development Departments prior sign installation. BE IT FURTHER RESOLVED, that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 calendar days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
