2008/08/28 Planning Commission Resolution (2)Resolution 2008-32 Date: August 28, 2008 PC RESOLUTION NO. 2008-32 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL THE PREZONING TO "SPECIFIC PLAN DISTRICT" OF PROPERTY LOCATED ON EACH SIDE OF WILFRED AVENUE, EAST OF DOWDELL AVENUE, AND NORTH, EAST, AND SOUTH OF THE CURRENT CITY LIMITS IN THE VICINITY OF THE INTERSECTION OF REDWOOD DRIVE AND WILFRED AVENUE (APN 045-055-007,045- 075-001 THROUGH 045-075-003, 045-075-005, 045-075-006, 045-075-008, AND 045-075-009 THROUGH 045-075-012) (City of Rohnert Park) WHEREAS, the City of Rohnert Park ("Applicant) intends to prezone an approximately 24.77 acre area located on each side of Wilfred Avenue, east of Dowdell Avenue, and north, east, and south of the current City limits in the vicinity of the intersection of Redwood Drive and Wilfred Avenue (APN 045-055-007, 045-075-001 through 045-075-003, 045-075-005, 045-075-006, 045- 075-008, and 045-075-009 through 045-075-012); WHEREAS, pursuant to California State Law and the Rohnert Park Municipal Code, public hearing notices were mailed to all property owners within a 1,000 foot radius of the subject property, public hearing notice signs were posted on the property, and a public hearing was published for a minimum of 10 days prior to the first public hearing in the Community oice; WHEREAS, on August 28, 2008, the Planning Commission held a public hearing at which time interested persons had an opportunity to provide public testimony either in support of or opposition to the proposal; WHEREAS, the Planning Commission reviewed and considered the Final Environmental Impact Report prepared for the project; recommended its certification by the City Council; and has otherwise carried out all requirements of the California Environmental Quality Act. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in recommending approval of Planning Application 1799 (Prezoning) makes the following findings in accordance with Rohnert Park Municipal Code Section 17.25.073; to wit Prezone 1799 1. That the proposed preaoning is consistent with the General Plan. Criteria Satisfied. The General Plan Land Use Map's designation for the project site is Regional Commercial; the area is identified in Figure 2-4.1 as a Specific Plan Area. General Plan Land Use Policy LU -32 requires that the area be developed in accordance with a specific plan. That the proposed prezoning will be beneficial to and not detrimental to the public health, safety, or welfare. Criteria Satisfied. The prezoning will allow the Wilfred/Dowdell Village Specific Plan to be implemented to meet the goals of the General Plan concerning this property. It will permit the integrated development of multiple properties in accordance with General Plan Land Use Policy LU -101) and integration with the adjacent Northwest Specific Plan Area in accordance with LU - 33. The ultimate development of the site would be of benefit to the City in that it would allow for additional commercial development immediately adjacent to existing commercial development and in close proximity to future freeway interchange improvements. 3. That with the proposed prezoning, adequate and available sites remain to mitigate the loss of any residential density on the subject property to accommodate the City's "Pair Share" regional housing needs used by the State Department of Housing and Development in determining compliance with Housing Element Law pursuant to Government Code Section 65863(b). Criteria Satisfied. The land has not been designated under either the County of Sonoma or City of Rohnert Park Housing Elements as a location for housing; Prezoning, annexation, and development of the site for commercial uses would be consistent with the City's General Plan and there would be no loss of residential density. 4. That a duly noticed public hearing has been held to receive and consider public testimony regarding the proposed prezoning. Criteria Satisfied. A duly noticed public hearing regarding this Prezone application was held by the Planning Commission on August 28, 2008. Section 3. Environmental Clearance. The Planning Commission of the City of Rohnert Park has recommended that the City Council certify the Final EIR and, if and when the Project is approved, recommends that the City Council direct the filing of a Notice of Determination with the County Clerk. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby recommend approval to the City Council of Application No. 1799 - Prezoning to "Specific Plan District" for an approximately 24.77 acre area located on each side of Wilfred Avenue, east of Dowdell Avenue, and north, east, and south of the current City limits in the vicinity of the intersection of Redwood Drive and Wilfred Avenue (APN 045-055-007, 045-075-001 through 045-075-003, 045- 075-005, 045-075-006, 045-075-008, and 045-075-009 through 045-075-012). BE IT FURTHER RESOLVED that any interested person may appeal this Resolution of the Planning Commission to the City Council within 10 calendar days of its passage pursuant to Rohnert Park Municipal Code ("RPMC") Section 17.25.123. Any such appeal shall be in the form provided by RPMC section 17.25.124 and with the payment of the fee established by the City.
