A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK,
CALIFORNIA, APPROVING A MODIFICATION OF THE EXTERIOR ELEVATIONS, AN
ADDITION OF 1,203 SQUARE FOOT FOR A GARDEN CENTER AND A NEW SIGN
PROGRAM FOR "ROHNERT PARK MALL" LOCATED AT 6595 COMMERCE
BOULEVARD, FILE NO. PL2006-014 SR (APN: 143-051-012)
WHEREAS, an application was filed by Tierney/FigueiredoArchitects on August 12, 2008 for a
revision to the exterior elevations of an existing commercial building, the addition of a 1,203 square foot
garden center, and new sign program for property located at 6595 Commerce Boulevard (APN 143-051-
012) based on plans date stamped received by the City of Rohnert Park on August 18, 2008; and
WHEREAS, Planning Application No. PL2006-014SR (revised) was processed in the time and
manner prescribed by State and local law; and
WHEREAS, public hearing notices were not required because the project is a design review/sign
program application and neither state law or city ordinance require a public hearing notice; and
WHEREAS, on August 28, 2008, the Planning Commission reviewed the Planning Application
No.PL2006-014SR during a scheduled public meetings at which time interested persons had an opportunity
to comment, either in support or opposition to, the project; and
WHEREAS, on August 28, 2008, the Planning Commission, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, the Commission did consider all of the
facts relating to Planning Application No. PL2006-014SR.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Findings. The Planning Commission, in approving Planning Application No.
PL2006-014SR/SP (Revised) makes the following findings:
Site Plan and Architectural Review
That the development's general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied: The proposed architectural modifications will be compatible with existing
development and the revisions will continue to enhance the City of Rohnert Park. The proposed
new signage program will be consistent with other sign programs in the area and within the
same zoning districts.
2. That the development incorporates a variation from adjacent ore -site and oJJ=site structures in
height, bulk and area, openings or breaks in the fagade facing the street, and/or line and pitch
of the roof.
Criteria Satisfied: The height of the structure, bulk and area are consistent with the Zoning
Ordinance requirements and standards. The proposed colors, minor architectural modifications

and signage will be proportionate to the building and neighborhood and signage will provide
effective visibility for the tenants without being obtrusive. The new, horizontal metal fascia
will allow the signage to be attached without visible raceways (conduits) and as tenants change
over time the material will maintain its integrity.
3. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and
avoids indiscriminate location and orientation.
Criteria Satisfied: Upon approval of the parking reduction the project will require a minimum
of 1 I Bicycle spaces. There are adequately dimensioned sidewalks located in front of the
commercial structure to accommodate pedestrians.

4. That the proposed location of the use is in accordance with the objectives of the Zoning
Ordinance and the purposes of the district in which the sign is located.
Criteria Satisfied: Any use that goes into the commercial building will only be allowed if it is
permitted or conditionally permitted in the "C-R" zoning district.
S. That the proposed location of the sign and the conditions under which the sign would be
operated and maintained will not be detrimental to the public health, safety, and welfare, or
materially injurious to properties or improvements in the vicinity.
Criteria Satisfied: The sign program is designed to maintain an appropriate level of signage that
is fair and equitable and does not create a public nuisance.
6. The proposed sign is in substantial conformance with the provisions of the Zoning Code.
Criteria Satisfied: The proposed sign program is consistent with the standards, requirements
and prohibitions contained in the Zoning Code.
Section 3. Environmental Clearance. The project is categorically exempt from the California
.Environmental Quality Act, pursuant to California Code of Regulations, Title 14, Chapter 3, Section 15301
(Class 1 — Existing Facilities).
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve
Application No. PL2006-014SR: proposed Rohnert Park Mall modification to the Site Plan and
Architectural Review and Sign Program, project located at 6595 Commerce Boulevard (APN 143-051-012).
Approval is subject to the following conditions based on plans and exhibits submitted by
Tierney/Figueiredo Architects date stamped received by the City of Rolmert Park on August 18, 2008:
1. Expiration of Approval — Pursuant to the City of Rohnert Park Municipal Code, the design
review approval shall expire one year from the Planning Commission approval dated, unless
prior to the expiration a building permit for the proposed exterior building modifications or
signage revisions is issued and construction is commenced and diligently pursued toward
completion or an extension is formally requested prior to the expiration of this application.
2. Conformance with Municipal Code and Other Agency Plans — The Rohnert Park Mall
project, as depicted on plans date stamp received by the City of Rohnert Park on August
18, 2008, shall comply with all applicable sections of the City of Rohnert Park Municipal Code

and any other applicable relevant plans of affected agencies, including but not limited to the
Green Building Ordinance, the Public Art Ordinance, and the Affordable Housing Linkage Fee
Ordinance.
3. Garden Center Approval is Contingent upon the Councils' adoption of an Ordinance that
reduces the parking ratio for commercial shopping centers to 1 parking space per each 300
square feet of leasable commercial area.

4. The commercial tenant space windows shall maintain transparency and may not be obstructed
by shelving units or other similar materials.
5. Pursuant to Section 17.17 Off-street Loading Standards prior to the issuance of a building
permit, loading zones shall be constructed on the project site that are consistent with the
requirements of the Zoning Code.
6. Pursuant to Section 17.16.130 Shopping Cart Storage, prior to the issuance of a building permit
for any tenant improvement for any use that may utilize shopping carts, a cart storage area shall
be constructed/designated on the project site in a location that is consistent with the
requirements of the Zoning Code.
7. Pursuant to Section 17.16.090 A. Design Standards for Parking Lots and Stnictures parking
areas may not be used for: vehicle sales, renting, leasing, storage, repair work, dismantling, or
outdoor open sales displays. Exceptions may be granted for special temporary outdoor events.
Building and Public Safety
8. The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building
and Public Safety Departments prior to initiation of construction at this location.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period,
which is 10 working days from the date of said action, has expired. No building permits shall be issued until
the appeal period has expired, provided no appeals have been filed.
