2008/11/13 Planning Commission ResolutionItem No.: 2 File No.:PL2008-025SR PC RESOLUTION NO. 2008-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA APPROVING A SIGN PROGRAM FOR PROPERTY LOCATED AT 5800 REDWOOD DRIVE (APN 143-040-121), FILE NO. PL 2008-025SR (Tom Pforsich, Freedom Graphics) WHEREAS, the applicant, Tom Pforsich, Freedom Graphics has submitted an application for the review of the Environmental Sign Program for the building located at 5800 Redwood Drive (APN 143-040-121); WHEREAS, Planning Application No. PL2008-025SR was processed in the time and manner prescribed by State and local law; WHEREAS, on November 13, 2008, the Planning Commission held a public meeting at which time interested persons had an opportunity to testify either in support or opposition to the proposal; and WHEREAS, the Planning Commission of the City of Rohnert Park makes the following findings: NOW, THEREFORE BE IT RESOLVED, THAT THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, FIND, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving the sign program proposed in application PL2008-025SR makes the following findings; to wit: 1. That the proposed locations of the signs are in accordance with the objectives of the Zoning Ordinance and the purposes of the district in which the sign is located; Criteria Satisfied. The proposed signage is within an acceptable range of square footage as analyzed in this report and is in accordance with the City's Sign Ordinance; 2. That the proposed locations of the signs and the conditions under which the sign would be operated and maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Criteria Satisfied. The proposed locations of the monument sign, wall signs, and window signs would not impact the public's health, safety and welfare. The work will be completed with the appropriate permits. All signs will be attractive and present an orderly appearance in accordance with the regulations and standards of the 'Zoning Ordinance. 3. The proposed signage is in substantial conformance with the provisions of the Zoning Code. The proposed locations of the signs are in accordance with the Zoning Ordinance and purpose of the "I-L/O" zoning district in which the signage would be located. Section 3. Environmental Clearance. The project is categorically exempt from CEQA, pursuant to Public Resources Code Section 15311 (Class 11 — Accessory Structures). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve the applicant's request for Environmental Sign Program for the building located at 5800 Redwood Drive (APN 143-040-121); subject to the following conditions of approval: 1. Expiration of Approval — Pursuant to the City of Rohnert Park Municipal Code, this approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued for one sign and construction is commenced and diligently pursued or an extension of time is requested prior to the expiration date. 2. Substantial Conformance - All improvements shall be in substantial conformance with the approved Environmental Sign Program that are date stamped received by the City of Rohnert Park September 10, 2008 and shall supersede any previous sign program. 3. Conformance with Municipal Code and Other Agency Plans — All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies. 4. Permits — The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Community Development Departments prior to sign installation. The submitted Environmental Sign Program shall be amended as follows: 1. The first paragraph of the sign program document shall read as follows: Intent: The following program is intended as a criteria for all signs within the complex for future usage; tenants with existing non -conforming signs will not be expected to comply until a use changes or a tenant chooses to alter their sign in some way. 2. Include sections Sign Review and Approval Process and Prohibitions to read as follows: Sign Review and Approval Process Prior to sign installation, the tenant shall submit 3 copies of the detailed shop drawings to the City of Rohnert Park for approval. Minimum information on these drawings shall include: A. A site plan and/or building elevations to which the sign copy is attached. Leased frontage measurement must be clearly identified. B. The letter size, layout and color (include all copy and graphics); C. Materials to be used; D. The method of attachment; and E. The landlords's signature located on the front page of the shop drawings that are submitted to the City of Rohnert Park. Prohibitions A. Animated, flashing, moving and/or audible signs; B. Signs located above the fascia or on the roof. G. Any sign that is not exempt by Rohnert Park Municipal Code or has been specifically approved by the city of Rohnert Park including the placement of temporary banners signs pursuant to Section 17.07.040. 3. Monument Sign section shall be revised as follows: One (1) double sided monument located a minimum of 5' feet from property line, and identified as Al on page SLA "Sign Locations". Monument sign is internally illuminated with opaque aluminum tenant sign faces and push -through acrylic copy (raised). Tenants will be represented on each sign at the discretion of the property owner and may not match on both sides of a given sign. 4. Primary'renant Signs (General) section shall be revised as follows: All primary tenant signs are limited to 16" letter height, overall length not to exceed 75% of the individual leased frontage with total square footage not to exceed one (1) square foot for each one (1) lineal foot of the leased frontage. Secondary tenant signs shall be calculated and included in the overall signage. For signage on Building B (signs C3,4 and C5,6, signage shall not extend beyond the signage bands. Logos will be allowed within the same restrictions. All signs should be located as closely to the center of the leased space as possible and no sign shall encroach within 24" of the limits of the leased space. Multiple lines of copy will be allowed provided all other limitations are adhered to. Tenant lettering shall consist of pan channel letters, either non illuminated or internally illuminated with LEDs. All lettering shall feature black returns & trim caps (face color left to tenant's discretion). 5. Building B (2 -story section) description shall be revised as follows: Building B (2 -story section) (C3,4 and C5,6) — four sign locations are provided on the 2 -story portion of the building (two on the east and two on the north). Signage within this area shall be restricted to placement within the area delineated "Signage Band". The total square footage calculated shall be divided equally between the two stories. Should a single tenant occupy the totality of both floors, two signs are allowed, one facing east and one facing north; should two tenants completely occupy the 2 -story portion of the building, two signs are allowed each tenant (one per tenant on each elevation; should three tenants fully occupy the 2 -story area, the smaller two tenants will each have one sign location and the larger tenant will be allowed two signs; should 4 tenants occupy the entire 2 -story section, each will be allowed one of the four sign locations; should more than four tenants occupy the 2 -story section, the largest four tenants will be allowed the four sign locations and no exterior sign will be allowed any other of the tenants. In general, the largest of the tenants shall be allowed to select among the sign locations, but the location should relate as closely as possible to the leased area (i.e. a first -floor tenant may not locate his sign above the second floor unless that tenant occupies the entire 2 -story area). 6. Building C —(C/13 and C/15) is added to read as follows: Primary sign location for tenants of Building C. The sign program document shall be revised to include a separate sheet{s} for each building which includes and defines ALL signage proposed for that particular building. Staff will work with the applicant to incorporate and achieve consistency in this regard and will review and approve the formatted changes. BE IT FURTHER RESOLVED, that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 calendar days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
