RECOMMENDATION
Staff recommends that the Planning Commission approve Resolution 2018-18, Conditional Use
Permit to allow an adult day care facility in an existing multi -tenant industrial/commercial
building located at 5420 State Farm Drive. A day care center (nonresidential) requires a
Conditional Use Permit in the Industrial/Regional Commercial overlay district.
SUMMARY
The subject property is a 0.86 acre parcel that is developed with an 8680 square foot multi -tenant
industrial/commercial building. The applicant, Amani Day Services, is proposing a day care
facility for developmentally disabled adults which will occupy a 3472 square foot tenant space
(Suite A) of the existing four (4) suite commercial building. The Amani Day Services program
is designed to support adults with intellectual/development disabilities and encourages
participants to be actively engaged in a variety of activities designed to build and maintain skills
as well as encourage cognitive engagement. The program will reinforce existing activities of
daily living skills and identify supports and accommodations that will help program participants
maintain independence and choice within their lives.

The Industrial, I -L/C -R overlay designations support a broad range of commercial activity,
including commercial uses that provides goods and services that serve the community and
outlying areas within an eight to twenty mile radius. The proposed use is consistent with this
designation in that the adult day care use will provide a needed service to the existing
community.

BACKGROUND
The proposed adult day care center would occupy a 3472 square foot tenant space within an
existing commercial/industrial building. The day care facility would operate Monday through
Friday, 7:00 am to 5:00 pm and is designed to serve up to 15-30 individuals throughout each day
with 8 to 14 employees. When at full capacity, there will be no less than 14 direct support staff;
however staffing could range between 8-14 employees depending on the number of staff
required to provide one-to-one services at any given time.
Program participants would be transported to and from the care facility via a handicapped
accessible van. The day care facility will offer programs that will engage the clients in
education/training and recreational activity. Such activity would include book reading, current
events, art, simple cooking and active games such as basketball. Activities would also include
attention to personal services such as a manicure, hairdressing etc. A complete summary of the
adult day program operation is attached for the Planning Commission's reference.
The applicant has proposed interior modifications that will include the addition of a bathroom,
reworking of all existing electrical, plumbing and mechanical systems as well as replacement of
interior finishes and minor reconfiguration of the existing space. The project does not propose
modifications to the building foot print or exterior fagade to accommodate the use and the
applicant has been informed that any signage would require administrative review by Planning
staff. Additionally, conditions of approval have been added to assure compliance with all ADA,
Fire and Building Code requirements.
The floor plan submitted and attached in the applicant's proposal, includes several activity
training rooms, small programming rooms dedicated to multi -sensory stimulation and physical
education as well as small office space for administrative staff and additional development
support activities that may include occasional training exercises for family, volunteers and
support staff members. Also shown is a generous size kitchen/dining area that includes a stove
top, washer and dryer, refrigerator and designated area for snack and lunch preparation and
casual dining.
ANALYSIS
In addition to social and daily living skill development programming, a schedule of community
outings, volunteer opportunities and job related activities would be offered enabling individuals
the opportunity to better participate in the community in which they live. As indicated
previously, individuals served do not own their own vehicles, or drive, so the program will
provide pick up and drop off services as well as transportation to community events. This would
ensure that on-site parking is reserved for support staff, occasional visits by family and the three
remaining tenants that occupy the commercial building. An analysis of the parking ratio and
supply is discussed below.
Parkin
At the required parking ratio of 1 per employee on the largest shift plus 1 per 10 children (adult),
the day care use would require a total of seventeen (17) spaces. The parking supply for this

location includes a total of 53 parking spaces. Given that the day program facility provides for
the transportation needs of individuals participating in the program, the existing parking supply
is more than adequate to serve the operational needs of the proposed use and that of the three
remaining tenants.
Staff would like to note that there is an existing handicap accessible parking stall and ramp
immediately fronting the subject day care facility that will easily accommodate the drop off and
pick up activity. An existing accessible parking stall is also located in the rear of the building
adjacent to the rear roll -up access door for the day care facility tenant space. Staff has informed
the applicant that a condition of approval has been added requiring that the rear parking stall be
used for daytime/overnight parking and when the transport van is not in use for drop off or pick
UP.
REQUIRED FINDINGS
Per RPMC 17.25.014 the Planning Commission shall approve or conditionally approve a
conditional use permit application if, on the basis of the application, supporting materials, and
written and oral testimony submitted at the hearing, the Planning Commission makes each of the
following findings. The findings and the basis for making each in the affirmative are found in
the attached resolution of approval:
1. That the proposed location of the conditional use is consistent with the objectives of the
zoning ordinance and the purposes of the district in which the site is located;
2. That the proposed location of the conditional use and the conditions under which it would
be operated or maintained will not be detrimental to the public health, safety, or welfare,
or materially injurious to properties or improvements in the vicinity, and that the operation
and maintenance of the conditional use will be compatible with the surrounding uses; and
3. The proposed conditional use will comply with each of the applicable provisions of this
title (the zoning ordinance).
NOTIFICATION
A public hearing notice denoting the time, date, and location of the proposal's hearing was
published in the Community Voice on February 23, 2018. Property owners within 300 feet of
the project site were mailed notices, and the notice was posted pursuant to State Planning Law.
ENVIRONMENTAL DETERMINATION
The project is categorically exempt from the California Environmental Quality Act, pursuant to
Public Resources Code Section 15301 (Class 1 — Existing Facilities).
RECOMMENDATION
Based on the findings of this report, staff recommends that the Planning Commission, by motion,
adopt Planning Commission Resolution No. 2018-18, approving File No. PLUP18-0001,
Conditional Use Permit for an adult day care facility, as conditioned.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT FOR TO ALLOW AN ADULT DAY CARE FACILITY IN AN EXISTING
MULTI TENANT SPACE LOCATED AT 5420 STATE FARM DRIVE
(APN 143-021-046)
WHEREAS, the applicant, Maribeth Lucero, Amani Day Service, filed Planning
Application No. PLUP18-0001 for a Conditional Use Permit to allow an adult day care facility at
5420 State Farm Drive (APN143-021-046, in accordance with the City of Rohnert Park
Municipal Code;
WHEREAS, Planning Application No. PLUP18-0001 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on March 8, 2018, the Planning Commission reviewed Planning
Application No. PLUP18-0001 during a scheduled and duly noticed public hearing at which time
interested persons had an opportunity to testify either in support of or opposition to the project;
and
WHEREAS, at the March 8, 2018, Planning Commission meeting, upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PLUP18-0001;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. 1~indins. The Planning Commission, in approving Planning Application No.
PLUP18-000 makes the following findings, as required by Municipal Code section 17.25.014
(finding for conditional use permits), to wit:
A. That the proposed location of the conditional use is consistent with the objectives of the
zoning ordinance and the purpose of the district in which the site is located.
Criteria Satisfied. The, I -L/C -R overlay zoning designation supports a broad range of
commercial activity, including commercial uses that provides goods and services that
serve the community and outlying areas within an eight to twenty mile radius. The day
care facility proposal is consistent with this designation in that it will provide a
convenient and needed service to families residing or working in this area that desire a
personal enrichment service for special needs adults.
B. That the proposed location of the conditional use and the conditions under which it
would be operated or maintained will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the vicinity, and that the
operation and maintenance of the conditional use will be compatible with the
surrounding uses.
Criteria Satisfied. The project will be limited in nature and will not have a negative
effect on the public health, safety, or welfare or be materially injurious to properties or
improvements in the vicinity. The proposed adult day care center would occupy tenant
space within an existing building and does not propose expansion of floor area or new
construction of structures. The adult day program also provides a pick-up and drop-off
transportation service for all clients participating in the program which will ensure that
the on-site parking supply is more than adequate for this use. Sufficient staffing is also
available to monitor all day to day program activity.
C. The proposed conditional use will comply with each of the applicable provisions of this
title.
Criteria Satisfied. The day care facility will adhere to any and all conditions of approval.
Section 4. Environmental Clearance. The project is categorically exempt from the California
Environmental Quality Act, pursuant to Public Resources Code Section 15301 (Class 1 —
Existing Facilities).
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLUP17-0003 subject to the following conditions:
Planning
1. Expiration of Approval - Pursuant to the City of Rohnert Park Municipal Code, this
approval shall expire one year from the Planning Commission approval date, unless prior
to the expiration a building permit is issued for any tenant improvements and
construction is commenced and diligently pursued toward completion AND/OR the use is
initiated, or an extension is requested and approved.
2. Conformance with Municipal Code and Other Agency Plans — All improvements shall
comply with all applicable sections of the City of Rohnert Park Municipal Code and any
other applicable relevant plans of affected agencies including the State Department of
Social Services/Community Care licensing.
3. The applicant shall obtain all necessary permits and clearances from the Rohnert Park
Building and Public Safety Departments for any modifications to the interior or exterior
of the building.
4. All activities associated with the day care use shall be conducted indoors.
5. The handicap accessible parking stall at the rear of the property shall be used for
daytime/overnight parking and when the transport van is not in use for drop off or pick
UP.
6. The use shall be operated in a manner that does not create a public or private nuisance.
Any such nuisance must be abated immediately upon notice by the City.
7. The site and surrounding area shall be maintained free of litter, refuse, and debris.
Building, Engineering, and Public Safety
8. Prior to occupancy, the fire sprinklers require a current 5 year certification by a licensed
servicing contractor.
9. All work shall comply with all codes, ordinances or standards, whether shown on the
plans or not.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.

Activities at the Program: The program will reinforce existing activities of daily living skills and identify supports and accommodations that will help our program participants maintain
independence and choice within their lives.
Sample Schedule of the Day will be like:
8:30am — 9:00 am —Assembly or announcement ( all participants and staff that is in the site will be involved)
9:OOam—10:OOam — Activities like ( Drawing, exercises, spa day ( Manicure, hair fixing), table top games)
10:OOam- 11:OOam — Snack time ( Food bought from outside or prepare at their homes) — Staff will assist them
11:OOam-12:OOpm — Activities like — Cooking , baking, current event, book reading
12:OOpm- 1:OOpm — Lunch time — Food they cook at the program, food that they bring from home or from a restaurant or outside.
1:OOpm- 2:30pm- Activities — Movies, active games like basketball etc...
2:30pm-3:30pm — If there is participants at the program —We will offer activities of their choice- until they got pick up.

Amani Day Services, to be located in Sonoma County, is designed to support adults with intellectual/developmental disabilities. We believe in a person centered approach that develops
programming based on what is important to each of our program participants. We can support individuals who may have mild to moderate behavior support needs, and/or minimal to full
personal care and dining support needs. All participants at Amani will receive up to an average of 2 consulting hours per month based on individual needs. Consultation may include nurse
consulting, behavioral consulting, music therapy, art therapy or other areas as identified.
The program focuses on three primary areas: Community, Independence, and Engagement:
Community: We believe that disabilities should not prevent someone from creating their own community or being a part of their surrounding community outside of the program. Involvement
in the community may include but is not limited to: volunteer work, shopping, movies, restaurants, museums, etc. We will also provide opportunities for senior specific programs within the
local community. Examples include classes and events at the Bennet Valley Senior Center, Person Senior Wing (part of the Finley Community Center), and the Older Adult Senior Program at
Santa Rosa Junior College. Additionally, the community will be invited to join us in our monthly Family, Friends, and Community (FFC) event. These events may include bingo, a coffee and
game morning, or a joint volunteer project between family, friends, community members and program participants.
Independence: The program will reinforce existing activities of daily living skills and identify supports and accommodations that will help our program participants maintain independence and
choice within their lives. In addition, the program will reinforce self -advocacy and choice. The person -centered techniques used are designed to help a person have a voice in their own life so
even if the person is unable to fully take care of their own support needs, he/she can say what he/she want in life instead of relying on others to make all choices.
Engagement: Our program participants will be encouraged to be actively engaged in a variety of activities designed to build and maintain skill as well as encourage cognitive engagement.
Multi -sensory activities will offered for individuals who may be experience sensory impairments or sensory overstimulation. Community and site-based activities are designed to incorporate
a variety of sensory stimuli to enhance day-to-day activities (i.e. gardening, cooking with fragrant citrus, making home-made play dough packets to distribute to a local Head Start program,
etc.). Music Therapy will be offered to facilitate interactions, help with stress and anxiety management, and to encourage multi -sensory engagement.

Consideration of a Temporary Conditional Use Permit for Model Homes,
Sales Office, and Temporary Sales Trailer for the Juniper Neighborhood at

Plan Phase II
Location: Within the University District Specific Plan (approximately 300 acres
located south of Keiser Avenue, west of Petaluma Hill Road, north of
Sonoma State University ("SSU") and Copeland Creek)
Applicant: Richmond American Homes
SUBJECT
Matters relating to development within the University District Specific Plan (UDSP) Project: a
proposed mixed-use community on approximately 300 acres with a maximum of 1,645 residential
units (excluding second residential units); 100,000 square feet of mixed use/commercial uses;
parks; and open space.
1. Resolution No. 2018-19 Approving a Temporary Conditional Use Permit for the Juniper
Development at University District Specific Plan (UDSP) Vast Oaks East (VOE)
Development Area Plan Phase II (DAP II) Model Homes, Sales Office and Sales Trailer
BACKGROUND
The UDSP is one of five specific plan areas designated in the City's General Plan for future
development. The UDSP includes approximately 300 acres of lands owned by five property
owners (University District LLC, Vast Oak Properties, Cotati-Rohnert Park Unified School
District, Gee, and Linden) in the City of Rohnert Park. In 2006, the UDSP document (the "Specific
Plan") was approved and associated General Plan amendments were adopted and implemented.
The Specific Plan addresses the land use and development standards for the UDSP area, which
Each of the model homes would be two -stories and would represent the different floor plans,
exterior elevations and colors, as included in the approved DAP. Refer to Exhibit 2 Juniper Front
Elevations for the approved home exterior elevations. As shown on Sheets L-1.1, L-2.0 and L-2.1
of Exhibit 1, the components of each of the proposed model homes would be as follows:
• Lot 7 would be the location of the temporary sale trailer and ADA accessible bathroom.
The temporary sales trailer would include parking for seven vehicles, temporary accessible
ramp/landings, temporary stairs/landing, and a detached temporary accessible bathroom.
Once construction of the model homes is complete, the temporary sales trailer will be
removed from Lot 7. The seven parking stalls would remain for customer use.
• Lot 4 would represent Plan 3 (Farmhouse). This model backyard includes scored concrete
patio, green screens, built-in stainless-steel barbeque and counter, reflecting pond with a
stone veneer linear wall, outdoor furniture, and potted plants.
• Lot 5 would represent Plan 2 (Wine Country). This model backyard includes paver
concrete patio, green screens, built-in stainless-steel barbeque with counter and sink, wall
fountain, outdoor furniture, and potted plants.
• Lot 6 would represent Plan 1 (Craftsman). This model home would include a sales office
in the garage area of the home. This model backyard includes paver concrete patio, green
screens, outdoor furniture, and potted plants.
Seven parking stalls, including one ADA accessible stall, would be constructed on Lot 7 to serve
the proposed temporary sales trailer. An accessible path of travel would provide access from the
parking lot to the ADA accessible temporary sales trailer. Seven parking stalls, including one ADA
accessible stall, would be constructed on Lots 1, 2 and 3 to serve the proposed model home
complex. An accessible path of travel would provide access from the parking lot to the sales office
and model homes and ADA accessible bathroom.
Landscaping would be installed along the streetscape, within the front and back yards of the model
homes, and surrounding the temporary parking lot (Refer to Sheets L-2.0, L-2.1, and L-4.0 of
Exhibit 1. Six-foot wooden fencing would be constructed on the interior lot boundaries (Refer to
Sheet L-1.1 of Exhibit 1).
Project Signage
As shown on Sheet L-5.0 of Exhibit 1, conceptual project signage includes eight 9.5 -foot by 3 -
foot sales center rigid banner signs on a 19 -foot galvanized steel pole painted white and one 4 -foot
by 6.5 -foot American flag on a 26 -foot galvanized steel pole painted white. Of the eight sales
center banner signs, five would be placed along Kingwood Road and three along the Lots 1, 2, and
3 western property line. The America flag pole would be placed on Lot 1 adjacent to the sidewalk
along Kingwood Road (see Sheet L-1.1 of Exhibit 1).
As shown on Sheet L-1.1 of Exhibit 1, one of the 3 -foot by 1 -foot "Welcome Sign and Brochure
Box" signs would be located on Lot 1 at the entrance to the Lots 1, 2, and 3 parking area and the
other would be located on Lot 7 near the entrance to the temporary sales trailer. The proposed 2 -
foot by 3 -foot "Parking" sign would be located at the entrance to the Lots 1, 2, and 3 parking area.
Of the two proposed 3 -foot by 4 -foot "Sales Center" signs, one would be located on Lot 1 and the

PLANNING COMMMISSION RESOLUTION NO. 2018-19
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING A TEMPORARY
CONDITIONAL USE PERMIT FOR UNIVERSITY DISTRICT VAST OAK EAST
LAND DEVELOPMENT PHASE II JUNIPER MODEL HOME COMPLEX
WHEREAS, the applicant, Richmond American Homes, filed Planning Application No.
PLTU18-0002 for a Temporary Conditional Use Permit for the construction of the Model
Homes, Sales Offices and Sales Trailer in Juniper neighborhood within the Vast Oak East Land
Development Phase II within the University District Specific Plan in accordance with the City of
Rohnert Park Municipal Code (RPMC); and
WHEREAS, Planning Application No PLTU18-0002 was processed in the time and
manner prescribed by State and local law; and
WHEREAS, pursuant to California State Law and the RPMC, public hearing notices
were mailed to all property owners within an area exceeding a three hundred foot radius of the
subject property and a public hearing was published for a minimum of 10 days prior to the first
public hearing in the Community Voice; and
WHEREAS, on March 8, 2018 the Planning Commission reviewed Planning Application
No. PLTU18-0002 at which time interested persons had an opportunity to testify either in
support of or opposition to the project; and,
WHEREAS, at the March 8, 2018, Planning Commission meeting, upon considering all
testimony and arguments, if any, of all persons desiring to be heard, the Commission considered
all the facts relating to Planning Application No. PLTU18-0002.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors considered. The Planning Commission, in approving Planning
Application No. PLTU18-0002, makes the following factors, to wit:
A. That the proposed location of the Temporary Conditional Use is consistent with the
objectives of the Zoning Ordinance and the purposes of the district in which the site is
located;
The proposed use will comply with the Development Standards in the University District
Specific Plan, Tentative Map and Development Area Plan for University District Vast
Oak East Land Development Phase Il. The creation of a model home complex is
authorized by the Conditions of Approval contained with the Vast Oak East,
Development Area Plan entitlement documents. A model home complex is an appropriate
use within the University District Specific Plan, residential districts.
B. That the proposed location of the Temporary Conditional Use and the conditions under
which it would be operated or maintained will not be detrimental to the public health,
safety or welfare, or materially injurious to properties or improvements in the vicinity,
and that the operation and maintenance of the Conditional Use will be compatible with
the surrounding uses.
The model homes, sales offices and sales trailer will be located on seven (7) lots within
the Juniper neighborhood. The model homes will be appropriately located within lots to
meet all development standards for eventual sale. The temporary sales trailer, accessible
ramps and stairs will be constructed according to California Building Code standards.
Prior to operation of the proposed sales trailer and model homes roads, sidewalks and
street lighting will be completed. Public access on the site will be limited to the
temporary sales trailer and the model home complex. Construction operations will be
separated from the sales facilities.
C. The proposed Temporary Conditional Use will comply with each of the applicable
provisions of this title.
The model homes, streetscape and landscaping proposed are consistent with the
Development Area Plan for Development Phase II as approved by the City Council.
Temporary facilities such as the sales trailer, parking, ADA compliance, fencing and
restrooms comply with Model Home requirements. Vehicular and pedestrian access is
adequate. Fencing will prohibit visitors from entering construction areas.
Section 3. Environmental Clearance. An Environmental Impact Report (SCH No.
2003122014) was prepared for the University District Specific Plan. An Addendum to the
Environmental Impact Report was completed in 2014 reflecting the updated Specific Plan and
related entitlements, including the construction of residential units.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLTU2015-0032 subject to the following conditions:
Conditions of Approval
The Temporary Conditional Use Permit is approved for up to 48 months from the Planning
Commission approval date subject to an annual review by City's Planning Division for
compliance with application provisions and conditions of approval. A report on the status and
compliance with conditions shall be submitted to the Planning Commission. After reviewing
the report the Planning Commission may determine if further review of the permit is
necessary.
2. The temporary Sales Trailer and Model Home Complex for the Juniper neighborhood and the
related improvements are limited to Lots 1, 2, 3, 4, 5, 6 and 7. Parking, signage and sign
poles, temporary fencing, temporary structures and other improvements, excepting homes for
future sale on Lots 4, 5 and 6 shall be removed upon completion of sales for the Juniper
neighborhood or before expiration of this Use Permit.
3. Hours of operation for the temporary Sales Trailer and Model Home Sales Office for the
Juniper Neighborhood are limited to 9:00 AM to 6:00 PM.
4. In order to review, site grading and drainage for the model home complex, please submit a
site improvement and grading plan to the City's Engineering Division for review and
approval.
5. In order to review the accessible features for the temporary sales trailer, please submit
building plans for review and approval by the City's Building Division.
6. The applicant shall comply with all applicable sections of the Rohnert Park Municipal Code
and the California Building Code, shall obtain all necessary permits from the Building
Division and Public Safety Department prior to commencement of operation of the
temporary sales trailer and model home complex.
7. Implement § 492.16 of the Water Efficient Landscape Ordinance which requires that all
landscaping for model homes shall use signs and written information to demonstrate the
principles of water efficient landscapes. The design of signs and written materials shall be
approved by the City's Planning Division prior to installation. Signs shall be installed and
written materials available prior to occupancy or operation of any sales office.
8. Prior to occupancy and opening of the sales trailer, model homes, and sales office, a phased
occupancy plan shall be approved by the City's Planning Division. The plan shall delineate
those areas that will be open to the public (vehicle traffic and pedestrian traffic) and the
means of separating construction activity from the public (fences, etc). The phasing plan
shall delineate the neighborhood streets that will be open to the sales trailer and model home
sales traffic, future resident traffic and construction traffic. The phasing plan will show the
fencing and other means of separation between construction access, active and storage, from
sales and future resident activity. All streets and other areas open to the public shall be free of
construction activity, including storage of material, staging/ unloading, and operation of
equipment.
9. Prior to start of combustible construction of the temporary sales trailer and model home
complex, the water system and fire hydrants serving the development shall be installed,
cleaned, pressure tested, disinfected and otherwise operational per City requirements. Streets
serving the Juniper neighborhood model home complex shall be graded, lime -treated, and
rocked to provide and all-weather surface. Compliance with these requirements shall be
demonstrated to the satisfaction of the City's Engineering Division and Public Safety
Department.
10. Any ADA accessible restrooms shall have a horn strobe added to them.
11. Prior to occupancy and opening of the temporary sales trailer, model homes, and sales office,
the streets serving each neighborhood model home complex shall be paved and striped.
12. Prior to occupancy and opening of the temporary sales trailer, model homes, and sales office
to the public, sidewalks and other street improvements serving the Juniper neighborhood
model home complex shall be completed.
13. Prior to occupancy and opening of the temporary sales trailer, model homes, and sales office
to the public, sidewalks and other street improvements serving the Juniper neighborhood
model home complex shall have completed and operational streetlights.
14. Prior to start of home construction, a surety bond shall be posted, covering the cost of
removing parking and other temporary improvements associated with the complex (the
model homes and landscaping on the model home sites, which are permanent features, shall
be excluded from the surety bond) and providing for the conversion/ completion of work
needed to ready the homes in the complex for sale.
15. All landscaping and water efficient irrigation will be consistent with the approved landscape
plans in the University District Development Area Plan II.
16. Signage shall be installed as shown on the proposed sales trailer and model home complex
site plans, but no other signage has been requested or approved outside of the area within the
three model home complexes.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.

Appointments — Term of office — Compensation - Vacancies, Changing the Term of Office for
Commissioners from Two Years to Four Years and Extending the Terms of Office of Existing
Commissioners.

City Council identified potential continuity issues for City Commissions, Committees, and
Boards (CCB) due to the lack of staggered terms; consequently in December 2016, City Council
established an ad hoc committee to review the current practices. Mayor Mackenzie and Vice
Mayor Stafford were appointed to the ad hoc committee in January 2017. The Committee's goal
was to establish CCB continuity and preserve City Council's practice of synchronizing CCB
terms of office with the appointing councilmember's term.
Staggered terms of office prevent appointee terms from expiring at the same time thus reducing
the possibility that all appointees on a particular CCB would be new and without experience
which is undesirable. Four year terms of office that coincide with the appointing
councilmember's term of office keeps CCB member terms from expiring in the same year.

Therefore, in August 2017 the Committee recommended to the City Council to change all terms
of office to four years that coincide with the appointing councilmember's term of office. City
Council unanimously supported the Committee's recommendation and directed staff to move
forward with implementation. Implementation includes communicating with the CCB members,
amending various resolutions and ordinances, and updating procedures.
Staff Analysis
RPMC 17.25.091(A) states Members of the Planning Commission shall be appointed by the City
Council. Each councilperson may nominate one resident of the City of Rohnert Park for
appointment to the Planning Commission. The term of each commission member shall be for
two years expiring on December 31.
Currently the five member Planning Commission have two year terms that do not coincide with
the appointing councilmember's term of office. RPMC section 17.25.091(A) needs to be
amended in order to implement a four year term.
The chart below demonstrates what the proposed change looks like in relation to the current

The proposed ordinance would change the term of office for commission members from two
years to four years. The proposed ordinance would also change the terms of office for existing
commission members so that they coincide with the appointment councilmember's term of office
as follows:
Daniel Blanquie: Mr. Blanquie's term of office will remain unchanged because it already
coincides with Mayor Stafford's term of office. In December of 2018, Mr. Blanquie's
term will expire and either Mayor Stafford (if re-elected) or Mayor Stafford's successor
(if not re-elected) will appoint a commissioner to a four year term of office.
Susan Adams: Ms. Adam's term of office will remain unchanged because it already
coincides with Councilmember Ahanotu's term of office. In December of 2018, Ms.
Adam's term will expire and either Councilmember Ahanotu (if re-elected) or
Councilmember Ahanotu's successor (if not re-elected) will appoint a commissioner to a
four year term of office.

Susan Haydon: Ms. Haydon's term of office is set to expire in December of 2018. Ms.
Haydon's term of office will be extended by an additional two years to December 2020 to
coincide with Councilmember Mackenzie's term of office.
Gerard Giudice: Mr. Giudice's term of office is set to expire in December of 2018. Mr.
Giudice's term of office will be extended by an additional two years to December 2020 to
coincide with Councilmember Belforte's term of office.
John E. Borba: Mr. Borba's term of office is set to expire in December of 2018. Mr.
Borba's term of office will be extended by an additional two years to December 2020 to
coincide with Vice Mayor Callinan's term of office.
Currently Section 17.25.091(A) of the Rohnert Park Municipal Code reads as follows:
"Members of the planning commission shall be appointed by the city council. Each
councilperson may nominate one resident of the city of Rohnert Park for appointment
to the planning commission. The term of each commission member shall be for two
years expiring on December thirty first."
The proposed amendment reads as follows:
""Members of the planning commission shall be appointed by the city council. Each
councilperson may nominate one resident of the city of Rohnert Park for appointment to the
planning commission. The term of each commission member shall be for four years expiring
on December thirty first."
Environmental Determination
The proposed amendments are not subject to CEQA pursuant to Section 13060(c) (2) (the
activity will not result in a direct or reasonable foreseeable indirect physical change to the
environment) and 15060(c) (3) (the activity is not a project as defined in Section 15378 of the
CEQA Guidelines, because it has no potential for resulting in a physical change to the
environment, directly or indirectly).
General Plan Consistency
The proposed amendments would be consistent with the goals, policies and implementation
measures contained in the General Plan.
Findings
The recommended findings to approve the amendment to the Zoning Ordinance are included in
the attached resolution.
Public Notification
Since this is a change to Chapter 17 of the Municipal Code a public hearing is required before
the Planning Commission. This item has been duly noticed by publication in the Community
Voice for amendments to the Municipal Code.
Staff Recommendation
Staff recommends that the Planning Commission, by motion, adopt Resolution 2018-20,
recommending to the City Council amendments to Chapter 17.25.091(A) of the Rohnert Park

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARK, CALIFORNIA RECOMMENDING TO THE CITY COUNCIL AMENDMENTS
TO MUNICIPAL CODE TITLE 17, ZONING TO PROVIDE FOR A CHANGE TO
PLANNING COMMISSIONERS' TERM OF OFFICE
WHEREAS, the applicant, the City of Rohnert Park, filed Planning Application No.
PLMC18-0002 proposing to amend the Rohnert Park Municipal Code ("RPMC") by amending
Sections 17.25.091 (A) — Planning Commission Appointments — Terms of Office — Compensation
— Vacancies;
WHEREAS, City Council Protocols Section XI.A.2 states "For City commissions,
committees and boards with (5) members, each Councilmember shall be entitled to appoint one
member;" and
WHEREAS, each of the current commissioners on the Commission were appointed by a
current member of the City Council; and
WHEREAS, on August 8, 2017, the City Council of the City of Rohnert Park directed
staff to implement a four year term of office that coincides with the appointing councilmember's
term of office for commissioners from two years to four years; and
WHEREAS, the proposed changes to Title 17 Zoning are attached hereto as Exhibit A;
WHEREAS, on March 8, 2018 the Planning Commission held a public hearing at which
time interested persons had an opportunity testify either in support of or opposition to the proposal;
WHEREAS, pursuant to California State Law and the Rohnert Park Municipal Code, a
public notice was published in the Community Voice for a minimum of 10 days prior to the first
public hearing; and
WHEREAS; the Planning Commission has reviewed and considered the information
contained in Planning Application No. PLMC 18-0002 for the proposed amendments to Title 17
Zoning of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Rohnert Park makes the following findings, determinations and recommendations with respect
to the proposed amendments to Sections 17.25.091(A) — Planning Commission Appointments —
Term of office — Compensation — Vacancies:
Section 1. The above recitations are true and correct.
Section 2. Findings. The Planning Commission hereby makes the following findings
concerning Sections 17.25.091(A) — Planning Commission Appointments — Term of office —
Compensation — Vacancies of the Municipal Code:
1. That the proposed amendments to the Municipal Code are consistent with the
General Plan 2020.
Criteria Satisfied. The proposed amendments to the Municipal Code are consistent
with the General Plan 2020 Goals by providing the basis for establishing and setting
priorities and maintaining consistency with the City Council protocols in
implementing programs, such as the Zoning Ordinance and specific plans.
2. That the proposed amendment to the Zoning Ordinance will be beneficial to the
public health, safety or welfare.
Criteria Satisfied. The proposed amendments to the Municipal Code will provide
for the health, safety and welfare of individuals living in Rohnert Park by coinciding
term limits with the City Council that will allow for outlining a vision of long range
physical and economic development and resource conservation that reflects the
aspirations of the community in a more comprehensive manner.
Section 3. Environmental Clearance
The proposed amendments are not subject to CEQA pursuant to Section 13060(c) (2) (the
activity will not result in a direct or reasonable foreseeable indirect physical change to the
environment) and 15060(c) (3) (the activity is not a project as defined in Section 15378 of the
CEQA Guidelines, because it has no potential for resulting in a physical change to the

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission
does hereby recommend that the City Council adopt the Findings stated hereinabove and adopt
this Amendment to the RPMC to amend Section 17.25.091(A) — Planning Commission
Appointments — Term of office — Compensation — Vacancies in the form provided in Exhibit A.

A. Members of the planning commission shall be appointed by the city council. Each councilperson may
nominate one resident of the city of Rohnert Park for appointment to the planning commission. The

B. Each member shall serve at the pleasure of the city council and until his successor is appointed and
qualified.
