City of Rohnert Park PLANNING COMMISSION STAFF REPORT Meeting Date: May 24, 2018 Agenda Item No: 8.1 Subject: File No. PLTU18-0007 — Temporary Conditional Use Permit (TCUP) for University District Specific Plan (UDSP) Juniper Neighborhood Model Home Complex Master Sign Program. Location: Within the University District Specific Plan (approximately 300 acres located south of Keiser Avenue, west of Petaluma Hill Road, north of Sonoma State University ("SSU") and Copeland Creek) Applicant: Richmond American Homes SUBJECT Matters relating to development within the University District Specific Plan (UDSP) Project: a proposed mixed-use community on approximately 300 acres with a maximum of 1,645 residential units (excluding second residential units); 100,000 square feet of mixed use/commercial uses; parks; and open space. 1. Resolution No. 2018-31 Approving a Temporary Conditional Use Permit for the Juniper Development at University District Specific Plan (UDSP) Vast Oaks East (VOE) Development Area Plan Phase II (DAP II) Model Homes Temporary Master Sign Program. BACKGROUND The UDSP is one of five specific plan areas designated in the City's General Plan for future development. The UDSP includes approximately 300 acres of lands owned by five property owners (University District LLC, Vast Oak Properties, Cotati-Rohnert Park Unified School District, Gee, and Linden) in the City of Rohnert Park. In 2006, the UDSP document (the "Specific Plan") was approved and associated General Plan amendments were adopted and implemented. The Specific Plan addresses the land use and development standards for the UDSP area, which was annexed to the City in 2006. An Environmental Impact Report (EIR) was prepared and adopted by the City in conjunction with the 2006 approval of the Specific Plan. In 2014, the City Council approved revisions to the adopted Specific Plan, including the Development Standards and Design Guidelines. The changes to the Specific Plan resulted in an alteration in the number of residential units by land use designation, the gross acreage and configuration for each designation, and reduced the total commercial building area. An addendum to the UDSP EIR was prepared and adopted by the City Council in conjunction with the Specific Plan revisions. In 2014 and 2015, the City Council approved DAPs for the Vast Oak West Land Development for 399 single family homes and Hinebaugh Creek Class I Bike Trail, West Detention Basin, and Rohnert Park Expressway landscaping, walls, fences and entry features. Portions of the Vast Oak West area of the UDSP are currently under construction. On July 11, 2017, the City Council approved a DAP for the Vast Oak East Land Development Phase I (VOE, DAP I), which included parkways and walls and Phase 1I (VOE, DAP II), which included development of Cypress, Sycamore, Live Oak and Juniper neighborhoods. PROPOSED PROJECT Temporary signage will be installed for the purpose of announcing that sales are open to the public. Signs will remain on the property only during the sales phase of the project. Signs will be removed when sales are complete. These signs will be located solely on the Richmond American Homes property. Signs will consist of "Model" home sign at each model home, for a total of three (3) signs. At the Sales Center site, there will be one (1) "Sales Center" sign, and two (2) "Water Conservation" signs. Other Model Home signage includes; one (1) directional "Parking Sign", one (1) Juniper Neighborhood home details "Project Signage", one (1) "Grand Opening" banner sign, two (2) "Watch Your Step Sign", one (1) American Flag on a galvanized steel pole, and one (1) "Welcome Sign" with brochure box. Signage details are provided as Exhibit 1 to the Resolution and are summarized as follows: • The three (3) individual "Model" home signs would consist of a 4 -foot by 2 -foot single faced sign panel mounted on base. The signs will be located in front of the three model homes on Lots 4, 5, and 6. • The "Sales Center" sign would be 3 feet by 5 feet, double faced sign indicating the location of the Sales Center. The "Sales Center" sign would be placed in front of the Lot 6 model home, where the Sales Office will be located in the garage. • The "Welcome Sign and Brochure Box" sign would be located in front of the Lot 6 model home near the Sales Center. • The two (2) "Water Conservation" signs would be approximately 2 feet by 2 feet sign supported by two 36 -inch support posts. The sign would be placed adjacent to the drought tolerant landscaping in front of the Lot 6 and Lot 4 model homes. • The proposed 2 -foot by 3 -foot "Parking" sign would be located at the entrance to the Lots 1, 2, and 3 parking area adjacent to the Kingwood Road entrance to the model home complex. • The 1.5 foot by 15 foot "Grand Opening" banner sign will be located on the fence along Kingwood Road adjacent to the Lot 6 model home. • The 5 foot by 4 foot "Project Signage" sign with Juniper neighborhood homes details would be located on Lot 1 in the parking area along Kingwood Road. • The America flag pole would be placed on Lot 1 adjacent to the sidewalk along Kingwood Road. STAFF ANALYSIS The Juniper neighborhood model home complex temporary sign proposal consists of a moderate number of signs to direct customers to and from the model homes and overall Richmond American Homes development. For the most part, the signs are located along the Kingwood Road main entry to the Juniper neighborhood development, and on the main model home access driveways in the model home complex. ENVIRONMENTAL DETERMINATION The proposed Sign program is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) under Article 19 Categorically Exemptions Section 15311 Accessory Structures Class II (a) On -Premises signs. No further action is required pertaining to environmental review. FINDINGS Findings for the Temporary Sign Program are included in the attached resolution. PUBLIC NOTIFICATION This item has been duly noticed by publication in the Community Voice for the Temporary Conditional Use Permit and posted at the prescribed locations in Rohnert Park. Property owners within 300 feet of the project were mailed notices of the proposed application. STAFF RECOMMENDATION Based on the analysis of this report and the attached resolution, Staff recommends that the Planning Commission, by motion, adopt Resolution No. 2018-31 approving a Temporary Conditional Use Permit for a Temporary Sign Program for the Juniper neighborhood model home complex, subject to the Conditions of Approval. PUBLIC NOTIFICATION AND INFORMATION A public hearing notice denoting the time, date, and location of this hearing was published in the Community Voice on May 11, 2018. Property owners within 300 feet of the project site and interested parties requesting notification were also mailed notices, and the notice was posted pursuant to State law. RECOMMENDED ACTIONS Staff recommends that the Planning Commission: 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PLTU18-0007, makes the following factors, to wit: A. That the proposed location of the temporary use is consistent with the objectives of the Zoning Ordinance and the purposes of the district in which the site is located; The proposed signs will direct the public to the model home complexes in Juniper neighborhood of the University District Specific Plan (UDSP) area. They will also inform potential home purchasers to the location of the model homes development within the Juniper neighborhood. The signs are located on the major surrounding streets bordering the development for the convenience of potential home buyers. R That the proposed location of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity, and that the operation and maintenance of the Conditional Use will be compatible with the surrounding uses. The signs are located to safely direct potential home buyers to the model home complexes within the development. They are in locations that will not obstruct construction activities in the development. C. The proposed temporary use will comply with each of the applicable provisions of this title. The proposed signs are consistent with the University District Specific Plan Development Area Plan as approved by the City Council. Section 3. Environmental Clearance. The proposed Sign program is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) under Article 19 Categorically Exemptions Section 15311 Accessory Structures Class Il (a) On -Premises signs. No further action is required pertaining to environmental review. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLTU18-0007 subject to the following conditions: 1) The Temporary Conditional Use Permit is approved for up to 48 months from the Planning Commission approval date of May 24, 2018, subject to an annual review by Development Services staff for compliance with application provisions and conditions of approval. A report on the status and compliance with conditions shall be submitted to the Planning Commission. After reviewing the report the Planning Commission may determine if further review of the permit is necessary. 2) Temporary signage shall be installed as shown on the Juniper Neighborhood Model Home Complex Master Sign Program Exhibits except as hereinafter modified. 3) Any graffiti or damage to signs shall be promptly repaired. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals. Summary The Planning Commission is charged with the responsibility for ensuring that adopted plans are consistent with goals and policies of the adopted General Plan. The Planning Commission is being requested to review the attached proposed FY 2018-19 Capital Improvements Program (CIP) to determine consistency with the General Plan. The proposed FY 2018-19 CIP will be considered for adoption by the Rohnert Park City Council with the FY 2018-2019 City Budget. Discussion The CIP is a document that addresses the long-term capital improvement needs of the City (i.e. public facilities, infrastructure improvements, and capital equipment needs). The CIP provides a relatively long-term (five-year) strategy for physical facility and infrastructure investment, to be approved annually in concept by the City Council. Every year, the City Council also considers for approval, a budget for the first year of the five-year CIP. Section 65401 of the California Government Code requires that for agencies that have adopted a general plan, a "coordinated program of proposed public works ensuing fiscal year" (i.e. a capital improvement plan) is to be "submitted to the city planning agency for review... as to conformity with the adopted general plan or part thereof." The Planning Commission has been charged with this responsibility by the City Council. The determination of consistency (or "conformity" as it is sometimes called) is needed prior to the City Council's adoption of the CIP as part of the budget process. The Council will use the Commission's determination for this purpose. The proposed FY 2018-19 CIP is attached for the Commission's reference. Staff has reviewed these projects and recommends adoption of the attached resolution on finding the CIP consistent with the General Plan. A discussion of the General Plan policies pertaining to the proposed Capital Improvement Program projects follows. General Plan Consistency The CIP has been reviewed for consistency with the goals and policies of the Rohnert Park General Plan 2000 and has been found to be consistent. The following paragraphs summarize the findings of consistency with the General Plan for each of the program areas in the CIP. City Facilities. The FY 2018-19 CIP includes the re -design of a Public Safety station west of Highway 101 to serve the Stadium Lands Planned Development, Wilfred Dowdell Specific Plan, and Northwest Specific Plan, as well as existing residents and businesses; the construction of the Copeland Creek Detention Basin and Steelhead Refugia for flood control and watershed protection; capital renovations to the Rohnert Park Cotati Community Library, Rohnert Park Animal Shelter, Gold Ridge Community Center, and Public Safety Headquarters. These projects are consistent with the following General Plan goals and policies: LU -10-C: Permit hospitals, schools, police and fire stations, parks and other facilities that serve a vital public interest, subject to findings and necessary environmental review to be located in a specific plan area, even if a specific plan for the area has not been adopted. EC -F: Enhance the quality of surface water and groundwater resources and prevent their contamination EC -H: Where feasible, given flood control requirements, maintain the natural condition of waterways and flood plains and protect watersheds to ensure adequate groundwater recharge and water quality. HS -B: Minimize the risk to life and property from flooding. General: Maintaining the ability of the City to maintain its facilities and provide adequate services to its residents is consistent with the overall intent of both the public facilities and health and safety elements of the General Plan. Parks and Recreation. The CIP includes major maintenance and capital replacement projects for parks and recreation facilities throughout the City, including projects at the Sports Center, Performing Arts Center, Senior Center; upgrade of various park restroom facilities; improvements at Sunrise Park; replacement of playground structures; resurfacing of sports courts throughout the City; and reconstruction of off-street bicycle/pedestrian pathways. The CIP also includes construction of new recreational facilities, including a new bocce ball court at the Sports Center and a new multi -use trail to Crane Creek Regional Park to provide access from the urbanized area of Rohnert Park to nearby open space resources. This project is consistent with the following General Plan goals and policies: OS -B: Maintain land surrounding the city as open space for the enjoyment of scenic beauty, recreation, and protection of natural resources of the community. OS -E: Maintain publicly owned open space areas in their natural state; provide public access in a manner that is compatible with the conservation of habitat. OS -F: Provide an integrated system of parks and trails throughout the City to meet the community's recreational needs. OS -H Ensure adequate funding for parks and recreation facilities acquisition, development, and maintenance. Transportation. The FY 2018-19 CIP includes street, bike and pedestrian facility improvements including pavement preservation projects such as slurry sealing and overlays; street reconstruction projects; bicycle and pedestrian path reconstruction; sidewalk reconstruction; including accessibility upgrades; traffic signal system improvements; and intersection improvements for optimizing traffic flow. These improvements are consistent with the following General Plan goals and policies: LU -44 Support creation of a pedestrian -oriented downtown, adjacent to the SMART rail station. CD -I Ensure that neighborhood streets provide an attractive physical environment for motorists, pedestrians, and cyclists. CD -J Maintain the character of existing neighborhoods while undertaking streetscape and signage improvements in selected areas. CD -K Provide safe, convenient, and comfortable pedestrian connections within commercial centers and between commercial centers and adjacent sites and residential neighborhoods. TR -A: Promote safe and efficient vehicular circulation throughout Rohnert Park. TR -B: Maintain high levels of mobility along all major street segments and at major intersections. TR -C: Build new roads and improve existing roadways, where necessary, in conjunction with new development. TR -F: Encourage alternative modes of travel.... TR -2: Ensure that mitigation measures are coordinated with roadway improvements programmed for funding through transportation -related impact fees. TR -6, TR -11, and TR -12: Use the City's Capital Improvement Program as a means to prioritize and undertake roadway improvements....; to prioritize and undertake the intersection improvements....; and to establish priorities for roadway improvements and prepare an action program for implementation. TR -N: Promote safe, efficient, and comfortable circulation for cyclists and pedestrians throughout Rohnert Park. TR -R: Continue to develop a comprehensive network of bikeways that promote bicycle riding for transportation and recreation. TR -T Balance the need of arterial and collector roadways to efficiently carry traffic, with establishing Central Rohnert Park as a walkable, bikable community, with pedestrian - oriented streets, centers, and mixed-use subareas. TR -47 Retrofit existing streets as complete streets, in addition to providing vehicular access that supports safe and continuous bike and pedestrian facilities and landscape improvements. Water System. The proposed CIP includes various improvements to the water system, including construction of a new water tank and pipelines to serve new development and upgrade of controls and telemetry to better monitor well production and overall distribution and flow water supply and fire suppression. These projects are consistent with the following General Plan goals and policies: PF -E: Provide sufficient quantities of water for Rohnert Park residents and businesses, while ensuring that safe groundwater is not exceeded. PF -11: monitor the operation of the municipal well field on a monthly basis to ensure that production does not exceed the recharge rates.... Wastewater System. The proposed CIP includes projects that preserve the sewer collection system such as sewer pipe lining and manhole rehabilitation to and the rehabilitation of the pump station's wet wells. These projects are consistent with the following General Plan goals and policies: PF -D: Ensure that adequate wastewater facilities and services are available to meet the needs of existing and new development. Environmental The recommended finding of consistency is not a project pursuant to Section 15378 of the California Environmental Quality Act Guidelines (CEQA) and additionally, since this is a consistency finding the previous environmental documentation for the General Plan is adequate CEQA documentation. Public Notification Pursuant to Government Code Section 65401 and City Ordinance, no public hearing is required to report on the Capital Improvement Program's consistency with the General Plan. Recommendation Based on the analysis and findings of this report and the attached resolution, Staff recommends that the Planning Commission, by motion, adopt Planning Commission Resolution No. 2018-32 reporting to the City Council that the proposed FY 2018-19 Capital Improvements Program is consistent with the Rohnert Park General Plan 2020.
