PLANNING COMMISSION RESOLUTION NO. 2019-01
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SITE PLAN AND
ARCHITECTURAL REVIEW FOR EXTERIOR REMODEL OF KENTUCKY FRIED
CHICKEN/A&W AT 6700 COMMERCE BOULEVARD
(APN 143-061-003)
WHEREAS, the applicant, Victoria Benham, filed Planning Application No. PLSR17-
0006 for Site Plan and Architectural Review for an exterior remodel of an existing Kentucky
Fried Chicken/ A&W commercial building, in accordance with the City of Rohnert Park
Municipal Code;
WHEREAS, on July 13, 2017 the Planning Commission reviewed the project and
determined that a study session should be held regarding the proposed project; and
WHEREAS, on July 27, 2017 a study session was held before the Planning Commission
where the applicant received feedback on the proposed design; and
WHEREAS, on November 27, 2018 the applicant submitted plans which addressed all
previously raised concerns; and
WHEREAS, Application No. PLSR17-0006 was processed in the time and manner
prescribed by State and local law; and
WHEREAS, on January 10, 2019, the Planning Commission reviewed Planning
Application No. PLSR17-0006 at which time interested persons had an opportunity to testify
either in support of or opposition to the project; and
WHEREAS, at the January 10, 2019, Planning Commission meeting, upon considering
all testimony and arguments, if any, of all persons desiring to be heard, the Commission
considered all the facts relating to Planning Application No. PLSR17-0006.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors Considered. The Planning Commission, in approving Planning
Application No. PLSR17-0006, makes the following factors, to wit:
A. That the developments general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied. The project proposes to remodel the exterior façade with new
architectural elements. The changes to the building and color palette blend well with the
surrounding buildings. No expansion or other exterior changes are proposed to the drive-
through, paved parking facilities, and driveway; therefore, the development would remain
compatible with existing surrounding commercial development.
B.That the development incorporates a variationfrom adjacent on-site and offs;ss
structures in height, bulk, and area; orrangement on the parcel; openings or breaks in
the fagade facing the street; and/or the line and pitch of the roof.
Criteria Satisfied. The project proposes to remodel the exterior fagade. The proposal
leaves the tower which is consistent with the design guidelines. The bulk of the building
will not change with the improve architecture. The proposed fagade maintains the same
amount of fenestration as the original design. This criteria is met.
C.That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and orientation.
Criteria Satisfied. The project proposes to remodel the exterior fagade. The project
involves exterior modifications to an existing building and therefore no changes to the
building orientation, setbacks, or parking on the site. The applicant is proposing to install
bicycle parking which meets City code. The site as currently designed is consistent with
this criteria.
Section 3. Environmental Clearance. The project has been analyzed for compliance with
the requirements of the California Environmental Quality Act (CEQA) and found to be
categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further
action is required pertaining to environmental review.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve
Planning Application No. PLSRl7-0006 subject to the following Conditions of Approval:
1. A landscape plan shall be submitted with the building permit application.
2. The existing trash enclosure shall be covered and the interior floor drain plumbed to
the sanitary sewer.
3. Construction affecting exterior elements must have construction fencing protecting
the public from any construction area.
Occupancy of the structure will be restricted while interior construction is on-going.
A trash receptacle to be placed at the southem end of the property.
6. Install 2LED lights that are equally spaced apart at the southem end of the property
to help light the creek pathway.
7. Match the existing paint that covers the body of the building.

BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 10th day of January, 2019by the City of
Rohnert Park Planning Commission by the following vote:
