2019/04/11 Planning Commission Resolution (2) 1 PLANNING COMMISSION RESOLUTION NO. 2019-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK, CALIFORNIA, CONDITIONALLY APPROVING FILE NO. PLUP19-0001: USE PERMIT TO ALLOW A LARGE FAMILY DAYCARE/GARAGE CONVERSION HOME IN A SINGLE-FAMILY RESIDENCE LOCATED AT 1180 ELVERA STREET (Dawn Marie Warwick, Applicant) WHEREAS, the applicant, Dawn Marie Warwick filed Planning Application No. PLUP1 9-0001 for approval of a Conditional Use Permit to allow a large family daycare operation/garage conversion in a single-family residence located at 1180 Elvera Street (APN143- 900-030) in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PLUP19-0001 was processed in the time and manner prescribed by State and local law; WHEREAS, public hearing notices were mailed to all property owners within a 300 foot radius of the subject property and to all agencies and interested parties as required by California State Planning Law, and a public hearing was published for a minimum of 10 days prior to the first public hearing in the Community Voice; WHEREAS, on April 11, 2019, the Planning Commission reviewed Planning Application No. PLUP19-0001 during a scheduled public meeting at which time interested persons had an opportunity to testify either in support or opposition to the project; and, WHEREAS, at the April 11, 2019 Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLUP19-0001; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in approving Planning Application No. PLUP19-0001 makes the following findings, to wit; 1. That the proposed location of the condition use is in accord with the objectives of the City of Rohnert Park Zoning Ordinance and the purposes of the district in which the site is located. Criteria Satisfied: The State Legislature has declared that daycare is to be allowed as an accessory use to a residence so that daycare may be provided in a traditional neighborhood setting. The proposed location is a residence; therefore the use is an appropriate one at this location and furthers the State’s intent regarding such uses. I am a Mom of 2 children and a wife of 6 years. I am currently a Small Home Licensed Daycare Provider who is currently caring for 6 children Monday- Friday. My business hours are 7:30am-5pm. My main morning drop off time is in-between 7:30am and 8:30am. My main afternoon pick up times vary each day from 3-5pm. My program is play based with some loose curriculum. We start the morning having breakfast together, having some free play in the Daycare followed by morning circle with songs and story time. Each day the children have the option to play outside from 10:30-11:30. During the warm months the children eat lunch outside and enfoy water play activities. After naps, normally around 3pm the children have the option to play outside, weather permitting. Due to the popular demand for childcare in Rohnert Park. I am in the process of applying to the State License Department and the City of Rohnert Park for an expansion of my current License. This will allow me to care for up to 12 to 14 children per day with a qualified assistant. To be licensed in the State of California, I have agreed to abide by specific guidelines while caring for children. State licensing requires detailed home inspections, current CPR, first aid, Health & Safety course, finger printing and background check for myself, my family and any employees I may have prior to license or employment. I now need my neighbors help to make this happen! The City of Rohnert Park requires my neighbors approval/acceptance for my business expansion. My children have been attending Miss Dawn's Daycare for approximately ten months. They attend four full days per week. To date, I have been highly impressed with the caring and nurturing environment my children are in each day. Parents want to know that their children are safe, well taken care of and are being provided with as much of a loving home -like experience as possible. Miss Dawn's is the embodiment of what parents are looking for in a daycare provider. Miss Dawn's daycare is run in her personal home; the home is always clean, sanitary and in great condition. As a law enforcement officer, I have been in many homes where daycares are being operated. Being that I have been exposed to many different operations, I can declare without any hesitation that Miss Dawn's daycare is one of the finest I have witnessed, presents no safety issues and that Miss Dawn cares for the children as if they were her own. Miss Dawn's Daycare is the second daycare provider for my children. Our first daycare provider unexpectedly closed her operation in December 2017, and we were forced to find another provider. Our first interview was with Miss Dawn. Within fifteen minutes of our tour, we knew Miss Dawn's Daycare was the best location for our children and did not bother checking any others. My children are provided with healthy meals, multiple recreational opportunities and educational activities that have greatly helped to advance their cognitive and social abilities to their fullest potential. She was always so organized, friendly, and managed children of all different ages and maturities well. She would design age appropriate activities that were fun and enriching. Parents need to notify me anytime the child has been sick prior to attending. Please DO NOT medicate your child prior to coming to childcare to mask symptoms of an illness such as a fever reducer or cold/cough medication. Please let me know if your child has taken any medication prior to coming for teething. Keeping your child home during the contagious stages of an illness is VERY important both for your child, other children in my care and for myself. If your child brings an illness to daycare, you risk the health and safety of other children in my care, my family and myself. Staying home for one or two days to prevent the spread of an illness helps keep my own children's and my sick days to a minimum as well. If my children or myself become sick we will be closed to prevent spread. All my sick days will be paid. Your child's sick days will be paid as well. If you are notified that your child is sick while in my care, you must pick them up ASAP. If you are not able to get here in a timely manner it is your responsibility to make a call to a local friend or family member available to get them. I will provide care for children with a minor cold or cough but not in the early stages of the illness. Children who exhibit the following symptoms will be excluded from care regardless of why they have these symptoms: • Diarrhea, more than one occurrence or combined with other symptoms • Vomiting or nausea • Excessively runny nose and or colored mucus, especially in children who are not able to wipe or blow their own nose. • Excessive cough, coughing to the point of gagging/vomiting or a barking cough. • Painful diaper rash • Rash or hives Eye discharge • Fever, more than 100*f - or over 99*f combined with other symptoms • Any illness being treated with antibiotics. The child needs to be on antibiotics for a FULL 24 HRS and symptom free before they can return to daycare. • Unusual temperament, such as excessive crying/unable to participate in normal activity, not their typical disposition. I will not dispense any medication, OTC or Rx for any illness. If your child requires medication they need to be home. I will however dispense OTC medication for teething babies with a doctor's authorization. Those medications must be in the original container and packaging. Also if your child requires an inhaler I will dispense that as well if needed. In the instances of gastroenteritis (or stomach flu) where YOU or your child have been vomiting, unable to keep down fluids, diarrhea, lethargy, etc. You must keep your child home. Infants and small children are more likely to become dehydrated and could require a trip to the emergency dept. Children need to stay home for 2 DAYS following this virus. They need to be eating, drinking and urinating close to their usual intake and output. If someone in your home or an alternate caretaker has symptoms of gastroenteritis please use caution when bringing your child. If mom, dad or siblings have this virus your enrolled child or children need to stay home. Due to the highly contagious nature of this illness and severity in which it can take, it's best to err on the side of caution when dealing with babies and small children. Vacation: Miss Dawn is taking 2 weeks paid vacation time. I will provide at least a 1 month notice of our vacation time. If parent's takes a vacation, it is required you give at least two weeks notice. Any vacation time is paid at the full contracted rate and is due prior to leaving for vacation, NO EXCEPTIONS. This is to hold the child's spot while they are gone. Food: I will provide breakfast, lunch and two nutritious snacks as needed. Please do not send treats or snacks unless there is enough for everyone. Parents of infants are asked to provide formula or breast milk until they can eat other foods. Emergency Plan: In the case of an emergency I will call 911 and have your child transported to the nearest emergency facility. I will then contact you as soon as possible. In the case that we must evacuate the premises, I will be at the nearest shelter (Evergreen Elementary School) and leave a note on the door with directions to our location. Please leave children under the age of 1 -year with their car seat as we do not have any for emergencies. Authorized Pick -Ups: Your child will be picked up only by those persons authorized by you in writing. If they are not listed, a phone call is necessary to inform me who will be picking up the child and a photo ID will be asked for upon arrival. I would also like a list of unauthorized pick-ups. Supplies: There is a $15/per child Material and Supply fee per month to help fund art supplies, purchase new outdoor equipment and maintain existing equipment. Fee is due the 15t week of the month. Can be paid in cash or added to your invoice if requested. I will provide supplies and toys as needed for my childcare home, including wipes (Kirkland Brand), food and cow's milk. One change of clothes is to either stay at my home or brought with the child daily. Please DO NOT bring toys from home. If there is a special blanket or stuffed animal needed that will be fine. Outdoor Play: Weather permitting, we will spend time outdoors. Please make sure to dress your child accordingly. Please do not send your child in clothes that you do not want to get dirty. During winter months feel free to send them with rain boots and rain coats. We have water play activities on hot days; please send your child with a bathing suit for these days. Discipline: I encourage positive discipline. I do not use the word "no"; instead I redirect a child and show them what is acceptable. I do not do time outs, but if a child is consistently not listening they will have "quiet time" away from the group until they are ready to cooperate. Behavior Contracts: If your child is consistently having behavior issues . I will put them on a behavior contract as well as a parent meeting. If the behavior contract is broken the child will be terminated from my daycare. NSF: Payments may be made by check, but please be aware that if a check is returned to me for non -sufficient funds, you will be required to pay all the fees that are incurred as a result of the returned check, plus a $25.00 fee. Childcare services will be immediately halted until full payment and NSF charges have been made, in cash. In addition, I reserve the right to request cash payment from that point forward. Withdrawing A Child: A written notice two weeks in advance is required if a parent terminates this contract, or two weeks' pay is required. As the provider I may terminate this contract with no notice if a situation arises, but will do my best to give a 2 - week notice. Parent Participation: State Regulations permit on demand access to this daycare during our hours Of operation. You are encouraged to stop by anytime your child is here, even if it is just to say hello. Open door policies are only in effect when your child is in daycare. If you need to meet with me after your daycare hours, please call first. By signing this contract, all parties agree to the terms and conditions of the policies. The provider may amend the policies by giving the parents a copy of the new or changed policies at least 2 -weeks before they go into effect.
