2019/09/24 City Council Resolution 2019-122 RESOLUTION NO. 2019-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK ADOPTING UPDATES TO THE MANUAL OF STANDARDS, DETAILS AND SPECIFICATIONS FOR SMALL WIRELESS FACILITIES ON NON-CITY OWNED POLES WHEREAS,the Federal Communications Commission ("FCC") issued its Declaratory Ruling and Third Report and Order, Order No. 18-133, in In the Matter of Accelerating Wireless Broadband Deployment by Removing Barriers to Infrastructure Investment (the "Order"), which altered federal law regarding use of the public right-of-way for small wireless facilities; and WHEREAS, changes to federal regulations as a result of the Order have triggered a need to ensure that design standards for technology allowed within the public right-of-way are clear and objective; and WHEREAS, establishing design standards for small wireless facilities on non-City owned poles assists with meeting the new FCC requirements along with ensuring safe, consistent infrastructure construction within the City's right-of-way; and WHEREAS, the City Council of the City of Rohnert Park adopted the "Manual of Standards, Details and Specifications" (the "Standards") on January 10, 2006, by Resolution No. 2006-19; and WHEREAS,the City Council of the City of Rohnert Park adopted updates to the Standards in 2009, 2010, and 2014; and WHEREAS,updating and improving the Standards will ensure that new construction is clearly and objectively regulated in order to ensure public health and safety, and minimize adverse aesthetic impacts to the public. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby replace in its entirety the following from the Manual of Standards, Details and Specifications with new documents in substantially similar form as attached hereto and incorporated herein as Exhibits A and B; 1. Volume 1 Title Page and Table of Contents (Exhibit B) BE IT FURTHER RESOLVED that it does hereby add the following section to the Manual of Standards, Details, and Specifications as Exhibit C: 1. Volume 1 Small Wireless Facility Standards (Exhibit C) BE IT FURTHER RESOLVED that except as otherwise specified herein, the Manual of Standards, Details and Specifications shall remain unchanged and in full effect. BE IT FURTHER RESOLVED that adoption of these revised Standards is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines, section 15301 (licensing and minor alteration of existing public or private structures, involving negligible or no expansion of use), section 15303 (construction of new small facilities or structures), section 15305 (issuance of minor encroachment permits), 15311 (construction of minor accessory structures accessory to existing,commercial or industrial facilities) and under section 15061(b)(3), as it can been seen with certainty that there is no possibility that this action will have a significant effect on the environment. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to keep on file the updated Manual of Standards, Details and Specifications on behalf of the City of Rohnert Park. NOTICE TO USERS of the City of Rohnert Park Manual of Standards, Details & Specifications This Notice to Users is made a part of the Manual of Standards, Details & Specifications (hereinafter referred to as Standards). Users of these Standards are cautioned that laws, codes, and regulations are ever-changing and it is the sole responsibility of the User preparing documents for permitting and/or construction to comply with current State and Federal Laws, Codes, and Regulations in the preparation of engineering documents. 1.0 Purpose The purpose of this Manual of Standards, Details & Specifications (Standards) is to provide minimum standards and requirements to be applied to improvements and private works to be dedicated to the public and accepted by the City for maintenance or operations, as well as improvements to be installed within existing right-of-way and easements. This is necessary in order to provide for the orderly and coordinated development of required facilities to be used by and for the public. These Standards shall apply to and regulate the design and preparation of plans for construction of streets, alleys, drainage, sewerage, street lighting, water supply facilities and other related public improvements. 1.1 Responsibilities The responsibilities of the City, Applicant, Applicant's Engineer and/or other User, and Contractor with respect to administrative implementation of an applicant-initiated or other project are defined in the following subsections. The City, the preparer of this document, and the City’s Agents shall be held harmless from any suit, litigation, or action arising out of compliance by the Applicant, Applicant's Engineer and/or other User, and Contractor with all applicable State and Federal Laws, Codes, and Regulations, or application of these standards, details and specifications. 1.2 City Responsibilities The City will be responsible for the review and approval of Improvement Plans and the inspection of all public improvements. 1.3 Applicant Responsibilities The Applicant, as applicable, shall have ultimate responsibility for compliance with requirements specified in these Standards. The Applicant shall be directly responsible for administrative requirements including application, submittal of the required Improvement Plans, bonds and insurance, agreements, and payment of fees. The Applicant shall also be responsible for performance of the Applicant's Engineer in meeting design standards and requirements and for the performance of the Contractor in meeting construction-related requirements. 1.4 Applicant Engineer's or other Users (User) Responsibilities These Standards presented herein provide requirements for the design and construction of public improvements and are intended to be the minimum standards. These Standards are not intended to be a substitute for engineering knowledge, judgment, or experience and shall be applied by the User as appropriate. Proposed deviations to these Standards shall be submitted, in writing, to the City Engineer. All engineering plans, specifications, reports, or other documents (engineering documents) shall be prepared by or under the direction of a State of California registered civil engineer and shall be signed and stamped with the registered engineers seal in accordance with State regulations. An approval signature by the City Engineer on the engineering documents does not in any way relieve the User of the responsibility to use professional engineering practices and to meet all requirements of the City. Proposed revisions to the approved engineering documents are subject to the City Engineers review and approval. It is the responsibility of the User to determine the applicability of each standard. These Standards constitute a minimum requirement for general conditions and may not apply to specific site conditions. 1.5 Contractor Responsibilities The Contractor shall be directly responsible for the means, methods, techniques, sequences, and procedures of construction not otherwise required by these Standards and the Improvement Plans. At all times, the Contractor shall be responsible for compliance with all governing federal, state, and local laws, ordinances, codes, orders, and regulations that in any manner affect those engaged or employed on the jobsite, the materials used in the Work, and the safe conduct of the Work. The Contractor shall also be directly responsible for the compliance of all finished work with these Standards and the Improvement Plans. 1.6 CEQA In conformance with the California Environmental Quality Act (CEQA), all actions by the City in reviewing, approving, issuing, and inspecting Improvement Plans, construction permits, and public improvements for applicant-initiated projects shall be deemed ministerial. It shall be the Applicant's responsibility to comply with the requirements of CEQA and the requirements of the lead agency, which has approved a development project or entitlement, including all mitigation measures that may relate to public improvements under City approval and inspection. The City, the preparer of this document and the City’s Agents shall be held harmless from any suit or action arising out of compliance or non-compliance by the Applicant with CEQA, or performance or lack of performance by the Applicant of any mitigation measure adopted or required by any local government. 1.7 Interpretation of Specifications and Details These Standards are intended to serve as one document. This means that the Specifications and Details contained herein are complementary, and what is called for in one shall be as binding as what is called for in both. In the event of discrepancies, errors, or omissions found in these Standards, or should it appear that there is not sufficient detail to perform the Work, then the User shall promptly submit in writing to the City Engineer a request for clarification or interpretation. 1.8 Deviations A request for a deviation from a City standard contained herein must be submitted in writing to the City Engineer by the User. Such requests shall identify the specific requirement at issue and state the proposed deviation with supporting technical information. Deviations shall be prepared by or under the direction of a State of California registered civil engineer and shall be signed and stamped with the registered engineers seal in accordance with State regulations. WF-2 Design Standards WF-1 Volume 1 for Public Improvements Revised July 2019 SMALL WIRELESS FACILITY DESIGN STANDARDS NON-CITY OWNED POLES GENERAL The purpose of the standards and specifications contained herein is to establish uniform standards for small wireless facilities on non-City owned poles on public streets in the City of Rohnert Park, installed after the date of adoption of these standards. A. These standards do not preclude the application of requirements to address site- specific conditions. B. Encroachment onto any City street, right-of-way, or public utility easement shall require an encroachment permit issued by the City of Rohnert Park. C. Small wireless facilities that co-locate on a non-City utility pole but with a City street light mast arm shall have their own power source. DEFINITIONS “CAMUTCD” California Manual on Uniform Traffic Control Devices City Engineer for the purposes of the Streetlight Standards, shall mean the City Engineer of the City of Rohnert Park. “C.F.R” Code of Federal Regulations “CPUC” California Public Utilities Commission .KMZ is a file extension for a placemark file used by Google Earth. RF-EME Report is a Radio Frequency – Electromagnetic Energy Compliance Report containing the following information: • Antenna Inventory • Site Plan with antenna locations • Antenna inventory with relevant parameters for theoretical modeling • Graphical representation of recommended signage and/or barriers Primary use is to determine compliance with FCC regulations in terms of exposure limits, and/or if RF hazard mitigation measures are in place. Small Wireless Facility has the definition set forth in 47 C.F.R. § 1.6002(l). “FCC” Federal Communications Commission FCC OET Bulletin 65 Design Standards WF-2 Volume 1 for Public Improvements Revised July 2019 “PG&E” Pacific Gas and Electric Company General Order 95 is defined by the CPUC regarding overhead electric line construction Small Wireless Facilities on Non-City Owned Pole Requirements 1. Design and Installation Requirements A. GENERAL a. All installations shall comply with City’s encroachment permit requirements, General Order 95, adopted codes, and shall meet all relevant state and federal regulations and rules. Applications submitted for an encroachment permit shall include following items: -RF-EME Report -Visual simulation of pole with feature -Encroachment permit application and documents associated with the application b. Maximum Height: New wireless communication facilities installed on a non-City owned pole in the Public Right of Way may add no more than 12 additional feet in height to the existing pole. Height limits may be exceeded only where pre-empted by state or federal law, including where necessary to avoid an effective prohibition on service. c. Wireless communication facilities installed on a non-City owned poles shall comply with all state and federal accessibility and clearance requirements and shall not conflict with requirements imposed under the California Manual on Uniform Traffic Control Devices. Wireless communication facilities on non-City owned poles shall not obstruct line- of-sight to any intersection, signage, other directional markings, or traffic control devices. The wireless communication facilities shall be placed in a location that would not cause any physical or visual obstruction to pedestrian or vehicular traffic, conflict with existing uses of the right-of- way, or pose safety hazards to pedestrians, bicyclists or motorists. In no case shall any pole-mounted wireless communication facilities be located within the space between ground level and 10 feet in height above sidewalks, and between ground level and 17 feet in height above streets on the street side of the pole. d. Proposed locations for all wireless communications facilities will not be permitted if they necessitate the removal or modification of existing City street trees beyond minor pruning. Design Standards WF-3 Volume 1 for Public Improvements Revised July 2019 e. Antenna elements shall be mounted in compliance with General Order 95 separation requirements. f. Each antenna associated with a wireless communication facility on a non- City owned pole in the public rights‐of‐way shall not exceed six (6) cubic feet in volume, and no more than 16” in diameter. For the purposes in this Section f, “volume” shall include any shroud, radome or other concealment device used in connection with the antenna. g. All wireless communication facilities on a non-City owned pole shall be constructed and operated in such a manner as to comply with the stationary noise standards as specified in the City’s Noise Ordinance. h. All conduits, conduit attachments, cables, wires and other connectors within reach of the public must be properly and safely protected. The cumulative volume for all non‐antenna accessory equipment associated with a wireless facility in the public rights‐of‐way shall not exceed twenty-eight (28) cubic feet, and the edge of the equipment furthest away from the pole shall not extend from the pole by more than 24 inches in any direction, to minimize impacts to the visual profile. For the purposes in this Section, “volume” shall include any shroud, cabinet, housing or other concealment device used in connection with the accessory equipment, but shall not include any equipment or other improvements installed below ground level or any cables or connectors placed within the pole or other support structure. i. All wireless communications facilities shall employ and maintain camouflage design or other screening techniques to minimize visual impacts, to the extent feasible. This includes minimizing use of visible external wiring and conduit, and placement of antennas and accessory equipment within enclosures where feasible. E. Records a. As-built drawings in electronic format shall be submitted at project closeout b. A shape file compatible with mapping software shall be submitted along with the following attribute information prior to application approval: i. “Points” file for locations points (with lat/long) ii.
