2019/11/26 City Council Resolution 2019-146RESOLUTION NO. 2019-146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING AMENDMENT SEVEN TO THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF ROHNERT PARI( AND THE ROHNERT PARK PUBLIC SAFETY OFFICERS' ASSOCIATION (RPPSOA) REGARDING ACTING PAY ASSIGNMENTS WHEREAS, on March 28,2017, the City Council adopted Resolution No. 2017-035 approving and adopting a Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and \MHEREAS, on April 24,2018, the City Council adopted Resolution No. 2018-051 approving and adopting Amendment One to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on May 8, 2018, the City Council adopted Resolution No. 2018-068 approving and adopting Amendment Two to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on June 12,2018, the City Council adopted Resolution No. 2018-078 approving and adopting Amendment Three to the Memorandum of Agreement with the Rohnert Park Public Safety Offtcers' Association (RPPSOA); and WHEREAS, on August 28, 2018, the City Council adopted Resolution No. 2018-117 approving and adopting Amendment Four to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on Octob er 23,2018, the City Council adopted Resolution No. 2018-133 approving and adopting Amendment Five to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on March 12,2019, the City Council adopted Resolution No. 2019-025 approving and adopting Amendment Six to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, the RPPSOA and City staff have met and confened in good faith to amend certain terms and conditions of the Agreement effective September 1,2019; and WHEREAS, staff prepared the attached Amendment Seven (Side Letter Agreement dated September I,2019) to the Memorandum of Agreement; and WHEREAS, the attached Amendment Seven (Side Letter Agreement dated September 1, 2019) has been approved by representatives of RPPSOA. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve Amendment Seven (Side Letter Agreement dated September l,2}l9) to the Memorandum of Agreement for the RPPSOA, effective September 1, 2019, which is attached hereto as Exhibit ooA" and incorporated by this reference. BE IT FURTHER RESOLVED that the Cþ Manager is hereby authorized and directed to execute documents pertaining to same for and on behalf of the Cþ of Rohnert Park. Section 10.4(d) provides as follows: Acting Supervisor/Watch Commander Pay: Public Safety Officers who have passed an eligibility testing process approved by the Director of Public Safety shall be eligible to serve as an Acting Supervisor/Watch Commander. As a specific decision- making role and authority is delegated with this assignment, this assignment may be made for a period of any length, up to three months. Continuous assignment for periods exceeding one pay period will be made in writing. Acting Supervisor/Watch Commander assignments will be compensated by a 5Vo actingpay for all hours actually worked as an Acting Supervisor/lVatch Commander. An Acting Supervisor/Watch Commander assignment may be compensated by a l\Yo acting pay to ensure against loss of income to the assigned Public Safety Officer if other assignment- based compensation is removed due to the Acting Supervisor/Watch Commander assignment. Effective September I,2019, the parties desire to modify Section 10.4(d) as follows: Section 10.4(d) 1. ActingSupervisor/WatchCommander: Public Safety Officers who have passed an eligibilþ testing process approved by the Director of Public Safety shall be eligible to serve as an Acting Supervisor/Watch Commander. This assignment can be intermittent-on an as needed basis, or for up to 960 hours per fiscal year for a position that is vacant during recruitment for a permanent appointment or 12 months for an Acting Supervisor/Watch Commander assignment temporarily available due to another employee's leave of absence. Continuous assignment for periods exceeding one pay period will be made in writing. Page 1 of2 2. Acting Sergeant Assignment: Public Safety Officers who have expressed an interest in promoting to Sergeant and who have been approved by the Director of Public Safety may be eligible to serve in an Acting Sergeant assignment for a designated rotation with an assigned patrol shift. An Acting Sergeant assignment for a rotation will not exceed 960 hours per fiscal year, including overtime hours. This is a training assignment with additional supervision and oversight by Command Staff. 3. Compensation for Acting Assignments An Acting Assignment will be compensatedby 5o/o acting pay for the duration of the assignment. This acting pay may be adjusted upon assignment if necessary to ensure against loss of income to the assigned Public Safety Officer if other assignment-based compensation is removed due to the Acting Assignment. The exact amount of the acting pay shall be calculated to most closely match 5o/o above the Public Safety Officer's current base pay plus stipends and shall not exceed l5%. Acting Assignments will be paid acting pay for all hours actually worked in an Acting Assignment. A Public Safety Officer receiving acting pay may sign up for routine overtime offered to all Public Safety Officers but shall not be paid acting pay for such overtime hours worked.
