SOP-28 Criminal Intel DatabasePolice Services Division SOP-28 June 25, 2019 SUBJECT: USE OF CRIMINAL INTELLIGENCE DATABASES/NETWORKS PURPOSE: To establish guidelines for Rohnert Park Department of Public Safety personnel regarding the use of criminal intelligence databases for crime analysis, situational assessments/awareness, criminal intelligence development, and in the support of criminal investigations; and to ensure that those databases are used only for a valid law enforcement purpose. DEFINITIONS Crime Analysis and Situational Assessment/Awareness: Analytic activities to identify and understand trends, causes, and potential indicia of criminal activity, including terrorism. Criminal Intelligence Information: Data which meets criminal intelligence collection criteria and which has been evaluated and determined to be relevant to the identification of criminal activity engaged in by individuals or organizations which are reasonably suspected of involvement in criminal activity. Valid Law Enforcement Purpose: Information/intelligence gathering development, or collection, use, retention, or sharing that furthers the authorized functions and activities of a law enforcement agency, which may include the prevention of crime, ensuring the safety of the public, furthering officer safety, and homeland and national security, while adhering to law and agency policy designed to protect the privacy, civil rights, and civil liberties of individuals or organizations. PROCEDURES 1. RPDPS personnel will only utilize criminal intelligence databases to seek, retain, or share information that is based upon a criminal predicate, threat to public safety; or is based upon reasonable suspicion that an identifiable individual, regardless of citizenship or U.S. residency status, or organization has committed an identifiable criminal offense, or is involved in or is planning criminal conduct or activity that presents a threat to an individual, or the community, and the information is relevant to the criminal conduct. 2. RPDPS personnel will not utilize criminal intelligence databases to seek or retain information about an individuals or organizations solely on the basis of their religious, political, social views or activities; an individual’s participation in a particular non- criminal organization or lawful event; an individual’s race, ethnicity, citizenship, place of origin, disability, gender, or sexual orientation unless such information is relevant to the individual’s criminal conduct or activity or if required to identify the individual; or an individual’s age other than to determine if someone is a minor. 3. The maintenance, dissemination, and destruction of any criminal intelligence information will be conducted pursuant to all applicable state and federal laws; such as 28 CFR Part 23. 4. Any documents or printouts of intelligence information obtained from criminal intelligence databases shall be for investigative purposes only, and will not be attached to or included with any report created by RPDPS personnel. REGIONAL INFORMATION SHARING SYSTEMS NETWORK (RISS) A. RPDPS authorized users of the RISS Network should query or submit criminal intelligence information via RISSIntel to WSIN (800-952-5258), NCHIDTA/NCRIC (866-367-884), or LACLEAR (877-550-2532) when conducting a criminal investigation that may cross jurisdictions to other Law Enforcement agencies, in order to share that information or ensure no conflict with other current investigations. These investigations include but are not limited to narcotics trafficking, terrorist acts, or school violence. B. RPDPS authorized users of the RISS Network should post critical events or planned operations such as search warrants or undercover operations that may cross jurisdictions via the RISS Officer Safety Event Deconfliction System (RISSSafe) to WSIN (800-952-5258), NCHIDTA/NCRIC (866-367-884), or LACLEAR (877-550-2532) in order to provide information to outside Law Enforcement agencies for officer safety and operational purposes.
