2020/02/13 Planning Commission Resolution (5)PLANNING COMMMISSION RESOLUTION NO. 2020-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK CONDITIONALLY APPROVING FILE NO. PLUP19-0006: USE PERMIT TO ALLOW FOR CATERING AND EVENTS AT 5625 STATE FARM DRIVE (STE. 17, 18, 21, AND 35) (APN 143-021-031) (Tom Edwards, Old Caz Beer) WHEREAS, the applicant, Tom Edwards, filed Planning Application No. PLUP19-0006 for a Conditional Use Permit for the property located at 5625 State Farm Drive (APN 143-021- 031), in accordance with the City of Rohnert Park Municipal Code; WHEREAS, Planning Application No. PLUP19-0006 was processed in the time and manner prescribed by State and local law; WHEREAS, public hearing notices were mailed to all property owners within a 300 foot radius of the subject property and to all agencies and interested parties as required by California State Planning Law, and a public hearing was published for a minimum of 10 days prior to the first public hearing in the Community Voice; WHEREAS, on February 13, 2020, the Planning Commission reviewed Planning Application No. PLUP19-0006 during a scheduled public meeting at which time interested persons had an opportunity to testify either in support or opposition to the project; and, WHEREAS, at the February 13, 2020 Planning Commission meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Commission considered all the facts relating to Planning Application No. PLUP19-0006; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Factors considered. The Planning Commission, in approving Planning Application No. PLUP19-0006 makes the following factors, to wit: 1. That the proposed location of the condition use is in accord with the objectives of the City of Rohnert Park Zoning Ordinance and the purposes of the district in which the site is located. Criteria Satisfied: The I-L zoning district supports a broad range of intensive activities that are meant to contain noise, illumination, and traffic. Due to the limited nature of the proposed events, the I-L district can support the intensified use on an infrequent basis. As well, the regular catering is limited in size and shall be contained with conditions to a small space within the parking lot. The conditions provided herein shall ensure that the purpose of the I-L district will be maintained. 2 Reso 2020-02 2. That the proposed location of the conditional use and the conditions under which it is operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Criteria Satisfied: The project, as conditioned, will not have a negative effect on the public health, safety or welfare; or be materially injurious to properties or improvements in the vicinity. The applicant shall be required to secure all necessary permits from the State to allow the operation. In addition, conditions will be imposed by the use permit that should mitigate any concerns related to the facility with regard to building, fire and life safety. 3. That the proposed conditional use will comply with each of the applicable provisions of Title 17 of the City of Rohnert Park Municipal Code. Criteria Satisfied: The project will comply with all applicable Zoning Ordinance standards. Section 4. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to Public Resources Code Section 15301 (Class 1 – Existing Facilities). NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLUP19-0006 subject to the following conditions: 1. The Planning department shall be notified of all proposed events on site at least two weeks prior to the event occurring. 2. Proposed events shall not occur during times where other on-site businesses would be open. 3. The site shall be returned to its original condition after any events or catering. Clean up of the event area shall occur immediately following the event. 4. The site shall be kept free of any litter or debris. 5. Any heat-producing machines, such as barbeques, grills, etc. shall be operated 10 feet from any structure or flammable material. A fire extinguisher shall be present at the site and all items must be readily removable for an ambulance or fire truck. 6. Prior to the expansion of any alcoholic beverage sales or consumption on site, the applicant shall obtain the required alcoholic use permit (s) as required by Chapter 8.34 (Use Permits for Alcoholic Beverage Establishments) of the Municipal Code. 7. The applicant shall provide evidence of approval for a “host facility” with the Sonoma County Department of Environmental Health & Safety. 8. Catering shall not obstruct any traffic or block any parking spaces. 9. The applicant must comply with the City of Rohnert Park Municipal Code Chapter 17.12 (17.12.030) Noise Standards. Further, the applicant agrees to and shall ensure that uses and activities are conducted in a manner that protects the public health and safety and does not produce adverse impacts on surrounding properties or the community at large. The City of Rohnert Park Public Safety Department shall have final authority over the reasonableness of the sound and its unnecessary, excessive or annoying effects to the area. 10. All prior building permits must be finalized prior to construction of brewery/use approved under this application. 1 1 .
