2020/08/11 City Council Resolution 2020-076 RESOLUTION NO. 2020-076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING AMENDMENT EIGHT TO THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF ROHNERT PARK AND THE ROHNERT PARK PUBLIC SAFETY OFFICERS' ASSOCIATION (RPPSOA) REGARDING STAND BY PAY WHEREAS,on March 28, 2017, the City Council adopted Resolution No. 2017-035 approving and adopting a Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS,on April 24, 2018, the City Council adopted Resolution No. 2018-051 approving and adopting Amendment One to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on May 8, 2018, the City Council adopted Resolution No. 2018-068 approving and adopting Amendment Two to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on June 12, 2018,the City Council adopted Resolution No. 2018-078 approving and adopting Amendment Three to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on August 28, 2018, the City Council adopted Resolution No. 2018-117 approving and adopting Amendment Four to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on October 23, 2018, the City Council adopted Resolution No. 2018-133 approving and adopting Amendment Five to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, on March 12, 2019, the City Council adopted Resolution No. 2019-025 approving and adopting Amendment Six to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association(RPPSOA); and WHEREAS, on November 26, 2019,the City Council adopted Resolution No. 2019-146 approving and adopting Amendment Seven to the Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS,the RPPSOA and City staff have met and conferred in good faith to amend certain terms and conditions of the Agreement effective August 11, 2020; and WHEREAS, staff prepared the attached Amendment Eight (Side Letter Agreement dated August 11, 2020) to the Memorandum of Agreement; and WHEREAS, the attached Amendment Eight(Side Letter Agreement dated August 11, 2020) has been approved by representatives of RPPSOA. NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve Amendment Eight (Side Letter Agreement dated August 11, 2020)to the Memorandum of Agreement for the RPPSOA, effective August 11, 2020, which is attached hereto as Exhibit"A"and incorporated by this reference. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute documents pertaining to same for and on behalf of the City of Rohnert Park. ABSTAIN: (ere Resolution 2020-076 2 EXHIBIT A SIDE LETTER AGREEMENT City Of Rohnert Park and the Rohnert Park Public Safety Officers' Association August 11, 2020 The City of Rohnert Park ("City") and the Rohnert Park Public Safety Officers' Association ("RPPSOA") are parties to a Memorandum of Agreement ("MOA") effective April 2, 2017-June 30, 2021. Section 2.4(a) provides as follows: Stand-By That whenever stand-by is mandatory, employees will be compensated as described in Section 3 for each hour of stand- by, unless otherwise mutually agreed to by the employee and representative of the City. Section 3 provides as follows: Overtime Calculation Overtime worked by an employee shall be calculated at the employee’s regular rate of pay utilizing the Police Division base pay and all applicable premiums. Effective August 11, 2020, the parties agree to amend Section 2.4(a) of the current MOA to clarify the correct calculation for stand-by compensation consistent with previous MOAs and our current practice amending Section 2.4(a) as follows: Section 2.4(a) Stand-By That whenever stand-by is mandatory, employees will be compensated at the rate of one-half (1/2) the employee’s regular rate of pay utilizing the Police Division base pay and all applicable premiums, for each hour of stand-by, unless otherwise mutually agreed to by the employee and representative of the City.
