PLAP20-0007 – Lili Shan – Consideration of Resolution No. 2020-0019 denying an
Administrative Use Permit for the conversion of the garage for purposes of workout
space located at 1530 Marcel Place (APN 047-600-048).
Planning Manager, Jeff Beiswenger, presented the item, and answered questions from the
Commission including: if a replacement space is required; construction details of the wall; if
the room contains a closet; the presence and installation of utilities; details about the garage
door; the City’s policy on the number of occupants permitted; if any violations have been
issued for this address; if the owners are also the applicants; and if the item can be continued
to gather more information. Recommended Action(s): adopt Resolution No. 2020-0019 to
deny an Administrative Use Permit for the conversion of the garage for purposes of workout
space located at 1530 Marcel Place (APN 047-600-048).
Sr. Code Compliance Office Kirk joined the meeting to answer questions from the
Commission including: if the use of the garage as a gym is a violation of the code; the number
of garage doors; consideration of the electrical load during building inspections; and if
complaints had occurred from the owners’ other rental home(s).
Building Official Bradford joined the meeting to answer questions from the Commission
including: building violations of other properties and details on the construction of the wall.
Applicant Representative Kristin Schaal, read a comment on behalf of applicant Lili Shan, and
answered questions from the Commission including: what additions have been made to the
garage, including if any windows or electrical have been added; if the garage door is
operative; the tenancy of the current occupants; actions the applicant has made regarding the
noise complaints; if the applicants are residents of Sonoma County; and, the reason building
permits weren’t applied for prior to construction.
Deputy City Attorney Bazzano joined the meeting to answer questions from the Commission,
including a legal perspective on the application.
Public Hearing Opened.
An anonymous commenter expressed concern that approval of the permit would exacerbate
the current issues with parties and noise.
Henry Clark, Michael Giacomini, Andrew Walters, Matthew Stuber, Kristin Schaal, JC
Zhang, Larry Rawson, Kara Baer, Keith Schaal, Connor Schaal, Xie Lei, and Hayden Dall
expressed support of the garage conversion into an office/gym to allow the tenants to manage
their health under the conditions of a pandemic and a housing shortage. A few commenters
also expressed actions had been taken to work with surrounding neighbors on noise
complaints.
Public Hearing Closed.

Old Caz is going to make it through the pandemic.

Applicant: Joseph Callinan/Callinan Construction
RECOMMENDED ACTION: Staff recommends that the Planning Commission adopt
Resolution No. 2020-020 approving Site Plan and Architectural Review for the addition of a
second story located at 636 Martin Avenue. This proposal is consistent with the Industrial land
use designation in the General Plan and the associated I-L: Industrial Zoning District.
BACKGROUND: The subject property is a .18 acre parcel located on the south side of the
northern most end of Martin Avenue. The project is part of a 90,000 square foot commercial
condominium property that includes the addresses of 636, 638, 640 and 642 Martin Avenue (See
Figure 1). There are five parcels situated on the property with the last parcel being the common
space and access parcel. The four existing commercial buildings are currently single story
structures.
The 636 Martin Avenue parcel is currently developed with a single story, 7,800 square foot
industrial building occupied and owned by Reyff Electric. The applicant, Joseph Callinan,
proposes to add a 5,222 square foot second floor addition and a 1,012 square foot covered roof
deck.

ANALYSIS: The property is located on the south side of the northern most end of Martin
Avenue. The property is setback from Martin Avenue with a 55 foot wide mature landscaping
zone. Mature landscaping exists within established planters located around the complex.
Project circulation within the community consists of private two-way drive aisles that circulate
throughout the subdivision with two existing 24 foot wide entry drives from Martin Avenue. All
of the businesses within the complex are accessible by pedestrian sidewalks that connect the
buildings to each other and to the public right of way. There are two existing trash enclosures
located at opposite corners of the property.
The four existing buildings are composed of smooth stucco with built-out stucco reveal columns,
horizontal lap sided wood building entry elements, metal store front windows and door panels,
metal roll-up garage doors and metal man doors. The two-tone wood and stucco features are
painted with custom Kelly Moore colors. The proposed upper floor addition has features that are
consistent with the existing building and will include a new shaded outdoor eating and rest area
for the building employees (see Figure 2).

Parking for the complex consists of 66 existing standard spaces and 7 accessible spaces, which
are located appropriately throughout the parking area. Per Section 17.16.030 of the Rohnert Park
Municipal Code, a total of 26 dedicated parking spaces would be required for the Reyff Electric
operation. Current uses throughout the site are industrial in nature and similar to the Reyff
Electric operation (AE Nelson Construction, Redhawk Glass, Biomarker Technologies, Pasta
Sonoma).
A reduction of up to twenty-five percent of the spaces required for a combination of uses may be
allowed where findings are made indicating that the uses share a common parking area and the
demand for parking occurs over different time periods, thereby making the full requirement
unnecessary. Staff feels comfortable in applying this standard in this instance. The following
table outlines the parking ratio for each building using the ratio of 1 space per 500 square feet of
gross floor area for Household Services/Contractor/Manufacturing/Processing and
Warehouse/Distribution. The 25% reduction rule applies since this business share a parking lot
with a range of other business types:

Current Parking Supply – 66 Standard, 7 Handicap
Staff feels the parking supply is sufficient for the addition of the second story at this location and
is in concert with the parking needs of each of the current owners and land uses.
The applicant has proposed architecture consistent with the City adopted Design Guidelines
which identifies a modern architectural style as one that consists of a variety of materials and
textures that would be used to achieve visual interest. Exterior wall cladding materials may
include metal siding, fiber cement siding, stone or terra-cotta cladding, wood siding, stucco or
concrete. The use of natural materials is also encouraged; materials should accentuate natural
colors and textures. The proposed project architecture boasts several different façade treatments,
rustic wood siding, metal storefront panels, and stucco with stucco reveal trim throughout.
The review of the project is also guided by RPMC Section 17.25.033, factors to
consider/conditions. The applicant has put forward a design consistent with existing conditions.
Staff has evaluated each of the criteria required in RPMC 17.25.033 and has prepared the
appropriate findings recommending approval with conditions in the resolution attached.
ENVIRONMENTAL DETERMINATION: The project has been analyzed for compliance
with the requirements of the California Environmental Quality Act (CEQA) and found to be
categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further
action is required pertaining to environmental review.
NOTIFICATION: A courtesy notice was mailed to owners of properties contiguous to the
project site. One response was received and is attached for the Commission’s review.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK APPROVING SITE PLAN AND ARCHITECTURAL
REVIEW FOR A SECOND STORY ADDITION LOCATED AT 636 MARTIN AVENUE
(APN 143-930-064)
WHEREAS, the applicant, Callinan Construction Company, filed Planning Application
No. PLSR20-0005 for Site Plan and Architectural Review for a second story addition to an
existing industrial building located at 636 Martin Avenue, in accordance with the City of
Rohnert Park Municipal Code;
WHEREAS, Planning Applications No. PLSR20-0005 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on September 10, 2020, the Planning Commission reviewed Planning
Application No. PLSR20-0005 at which time interested persons had an opportunity to testify
either in support of or opposition to the project; and,
WHEREAS, at the September 10, 2020, Planning Commission meeting, upon
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PLSR20-0005.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors Considered. The Planning Commission, in approving Planning
Application No. PLSR20-0005, makes the following factors, to wit:
A. That the developments general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied. The applicant has proposed architecture consistent with the City
adopted Design Guidelines which identifies a modern architectural style as one that
consists of a variety of materials and textures that would be used to achieve visual
interest. Exterior wall cladding materials may include metal siding, fiber cement siding,
stone or terra-cotta cladding, wood siding, stucco or concrete. The use of natural

B. That the development incorporates a variation from adjacent on-site and off-site
structures in height, bulk, and area; arrangement on the parcel; openings or breaks in
the façade facing the street; and/or the line and pitch of the roof.
Criteria Satisfied. The project proposes to add a second story to an existing industrial
building. The proposed upper floor addition has features that are consistent with the

existing building and will include a new shaded outdoor eating and rest area for the
building employees. The project as proposed provides continuity in design and materials
on all elevations.
C. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and orientation.
Criteria Satisfied. The project proposes to add a second story addition to an existing
single story industrial building. The exterior modifications to the existing industrial
building would not alter the pedestrian, bicycle and vehicular connections with adjacent
properties.
Section 3. Environmental Clearance. The project has been analyzed for compliance with
the requirements of the California Environmental Quality Act (CEQA) and found to be
categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further
action is required pertaining to environmental review.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLSR20-0005 subject to the Site Plan and Architectural
Review submittal attached as Exhibit A and subject to the following Conditions of Approval:
1. All applicable provisions of the City of Rohnert Park Municipal Code are made a part of
these conditions of approval in their entirety, as if fully contained herein.
2. The Site Plan and Architectural Review shall expire one year from the Planning
Commission approval date, unless prior to the expiration, the operation commences, a
building permit is filed or an extension of the Site Plan and Architectural Review is
applied for and approved.
3. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert
Park, its agents, officers, attorneys and employees from any claim, action or proceedings
brought against any of the above, the purpose of which is to attack, set aside, void, or
annul the approval of this application. This indemnification obligation shall include but
not be limited to, damages, costs, expenses, attorneys’, or expert witness fees that may be
asserted by any person or entity, including the Applicant, whether or not there is
concurrent passive or active negligence on the part of the City, its agents, officers,
attorneys or employees.
4. Stencil “FIRE LANE – KEEP CLEAR” onto the pavement past both driveways and
fronting 640 Martin.
5. Modify FDC to penetrate the block wall, facing the street. Add a 4” Storz connection w/
check valve.
6. Please provide a complete set of permanently labelled keys to all utility rooms and the
entry door to the tenant space.
7. All doors to utility rooms and fire alarm panels shall be labeled. Label the rear exit door
with the unit number.
8. Fire sprinklers are required per NFPA 13 and local ordinance. A separate fire department
permit (FS 10) is required for any modification or addition to the system.
9. An automatic fire alarm system is required per NFPA 72 and local ordinance. A separate
fire department permit (FS 12) is required for any modification or addition to the system.

10. Fire extinguishers shall be provided as per CFC.
11. The existing driveways shall be replaced with ADA-compliant driveways meeting current
City standards.
12. Provide an ADA-compliant path of travel from the building front door to the public
sidewalk.
13. Upgrade existing water services as needed to provide additional fire services and/ or fire
hydrants. Confirm that adequate flow and pressure is available for fire protection.
14 An encroachment permit is required for all work in the public right-of-way.
15. Water system upgrades and ADA-path improvements may trigger the need for civil
improvement drawings.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.

Hello Jennifer,
Unfortunately the short notice of this document and our subsequently required response time forced us
to respond in a negative manner in order to get our concerns to you in time for the planning commission
meeting. If we had been afforded more time to respond, much of this would have been avoided as we
could have discussed this issue with Ray Reyff. However, since our letter was submitted, we have now
had opportunity to discuss this issue with Reyff Electric and no longer have concerns about the plan for
the building itself.
Our only concern moving forward, would be that Mr. Reyff has a discussion with the Owners of the
other buildings in our business park to alleviate concerns of how the construction itself would or would
not impact the other businesses. This could take place any time prior to construction commencing and
likely should occur shortly before I would think. Mr. Reyff has agreed that this is what he intends to do,
and as such we no longer have any concerns to move forward at this time.
Our concerns in this matter should not be construed in any way as a comment to Mr. Reyff’s character or
standing in the community.
