2020/09/08 City Council Resolution 2020-086RESOLUTION NO. 2020-086 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK FOR THE ALICIA PARK COURT RESURFACING PROJECT NO.2018-19 AUTHORIZING THE USE OF $114,838 OF UNANTICIPATED REVENUE FROM SONOMA COUNTY PARK TAX (MEASURE M) AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT CHANGE ORDER WITH VINTAGE CONTRACTORS, INC. IN THE AMOUNT OF $80,400 WHEREAS the City Council approved the construction of the Various Courts Resurfacing Project on June 9, 2020 (Resolution 2020-48), which included the resurfacing of the courts at Alicia Park; and, WHEREAS, Staff is concurrently proposing that the City Council consider approving an Access and Improvement Agreement with the Goals Foundation to accept two donated and installed Mini -Pitch system soccer courts within the existing fenced courts at Alicia Park; and, WHEREAS, Staff has subsequently determined the existing court is severely delaminated and a simple crack seal is not feasible; and, WHEREAS, with the addition of the Mini -Pitch soccer court system being donated to the City, the new soccer court would be a one -of -a -kind amenity in the region; and, WHEREAS, in order to have a fully functioning amenity at the soccer courts, staff recommends addressing the sports lights, fencing and court surface; and, WHEREAS, the current sports lights are 1000 watt metal halide fixtures and are either burned out or dim; and, WHEREAS, the cost to replace all eight halide lights and mounting brackets/arms with new LED fixtures and mounting brackets/arms is $23,985, and, WHEREAS, the proposed Mini -Pitch soccer court system consists of four -foot high fencing around the sides of the two courts and it would be installed within the existing fenced court area; and, WHEREAS, Staff proposes to remove the east (parking lot side) and west sides of the tennis court fencing to provide better access to the new soccer courts for a cost of $4,000; and, WHEREAS, the existing court surface has delaminated to a point that the entire court top layer surface is crumbling, making it impossible to repair; and, WHEREAS, Staff recommends milling off 1 inch of the existing delaminating surface, installing petro-mat fabric and placing 1.5 inches of 3/8" asphalt concrete over the court surface for a cost of $76,400; and WHEREAS, the total cost for the project with the recommended improvements $145,847, however the current budget for the project is $27,780, equaling a $118,067 budget shortfall; and, WHEREAS, Sonoma County Park Tax (Measure M) is a local sales tax measure that supports long-term needs to maintain, operate and improve parks; and, WHEREAS, there is $246,699 of available fund balance in Measure M Funding; and, WHEREAS, staff is proposing to fund the budget shortfall of $118,067 from unanticipated revenue from Measure M and authorize an increase in budget appropriations in Capital Project Fund 310 for the Alicia Park Court Resurfacing Project No. 1819 (PR-109) by the same amount. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby determine, authorize and approve the following: Section 1. The above recitals are true and correct and material to this Resolution. Section 2. In making its findings the City Council relied upon and hereby incorporates by reference all of the bid materials, correspondence, staff reports and all other related materials. Section 3. The Project is categorically exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant CEQA Guidelines sections 15301 (Existing Facilities) and 15302 (Replacement or Reconstruction). (14 Cal. Code Regis. §§ 15301, 15302). Section 4. The Finance Manager is authorized to appropriate Measure M funds to the Alicia Court Resurfacing Project No. 2018-19 in the amount of $118,067. Section 5. The City Manager is hereby authorized and directed to execute a Contract Change Order with Vintage Contractors, Inc. in the amount of Eighty Thousand, Four Hundred Dollars ($80,400). The City Manager is hereby authorized and directed to take all actions necessary to effectuate this Contract Change Order for and on behalf of the City of Rohnert Park, including execution of the agreement in substantially similar form to the agreement attached hereto as Exhibit "A," subject to minor modifications by the City Manager or City Attorney. Section 6. This Resolution shall become effective immediately. Section 7. All portions of this Resolution are severable. Should any individual component of this Resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining Resolution portions shall continue in full force and effect, except as to those Resolution portions that have been adjudged invalid. The City Council of the City of Rohnert Park hereby declares that it would have adopted this Resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or unconstitutional.
