2020/10/13 City Council Resolution 2020-093 RESOLUTION NO. 2020-093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING THE DIRECTOR OF FINANCE TO INCREASE APPROPRIATIONS IN FISCAL YEAR 2020-21 BUDGET AND AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACT CHANGE ORDERS UP TO 36% OF THE CONSTRUCTION CONTRACT AWARD AMOUNT FOR THE VARIOUS COURTS RESURFACING PROJECT NO. 2017-26,2018-14 AND 2018-19 WHEREAS,the City Council approved the construction of the Various Courts Resurfacing Project on June 9, 2020 (Resolution 2020-48),which included the resurfacing of the tennis courts and basketball courts at Sunrise Park, the tennis court at Alicia Park, and the basketball courts at Honeybee and Dorotea Park; and, WHEREAS,the construction contract was awarded to Vintage Contractors, Inc in the amount of$330,745 with Resolution 2020-48 which also authorized the City Manager to execute Contract Change Orders (CCO) up to 10%of the construction contract award amount ($33,075); and, WHEREAS, on August 21, 2020,the City Manager signed CCO#l with Vintage for Six Thousand Dollars ($6,000)to install embedded pickleball posts for the court netting into the newly striped pickleball courts at Sunrise Park(2%of the contract award amount); and, WHEREAS, on September 8, 2020, the City Council approved Resolution 2020-86 authorizing the City Manager to sign CCO#2 in the amount of Eighty Thousand, Four Hundred Dollars ($80,400)to overlay Alicia Park court with asphalt concrete and remove portions of perimeter fencing; and, WHEREAS,the total of CCO#1 and CCO#2 is 26%of the construction contract award amount ($86,400); and, WHEREAS,during the construction of Honeybee Basketball Court resurfacing, staff directed the contractor to grind the existing volley-ball post sleeves and concrete footings flush with the court surface, and restripe the surface to match the new surface to alleviate a trip hazard, for a cost of$2,050; and, WHEREAS,during the City Council meeting of September 22, 2020, the City Council provided direction to staff to install posts for a dividing net between the north and south pickleball courts at Sunrise Park so that balls would not enter the back-to-back courts, for a cost of$5,050; and, WHEREAS,members of the Pickleball Club requested striping of six pickleball courts on top of the two tennis courts at Sunrise Park for a cost of$3,500; and, WHEREAS,on September 8, 2020, the City Council asked staff to replace the drinking fountain at Alicia Park with a new Americans with Disabilities Act(ADA) compliant fountain with a bottle filler, for a cost ranging between $15,000 and $20,000; and, WHEREAS, the City Manager's signature authority needs to be increased in order to sign change orders over 26% of the construction contract award amount; and, WHEREAS, Public Works staff recommends increasing the City Manager's signing authority up to 36%of the construction contract award amount ($119,070); and, WHEREAS, the project has funding shortfall of$10,310 with the addition of the Sunrise Park pickleball court divider posts installation, striping of six additional courts at the tennis court and contingency; and, WHEREAS, staff recommends that the City Council authorize the Finance Director to appropriate $10,310 of Infrastructure Fund Balance to the Sunrise Park Court Rehabilitation Project No. 2017-26. NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby determine, authorize and approve the following: Section 1. The above recitals are true and correct and material to this Resolution. Section 2. The City Manager is hereby authorized to sign Contract Change Orders up to 36%of the construction contract award amount($119,070). Section 3. The Finance Manager is authorized to appropriate Infrastructure Reserve Fund balance in the amount of$10,310, to fund the Sunrise Park Courts Rehabilitation Project No. 2017-26. Section 4. This Resolution shall become effective immediately. Section 5. All portions of this Resolution are severable. Should any individual component of this Resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining Resolution portions shall continue in full force and effect, except as to those Resolution portions that have been adjudged invalid. The City Council of the City of Rohnert Park hereby declares that it would have adopted this Resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or unconstitutional.
