CITY COUNCIL/RPFA/SUCCESSOR AGENCY TO THE CDC JOINT REGULAR MEETING - CALL TO ORDER/ROLL CALL Mayor Belforte called thejoint regular meeting to order at 5:03 pm, the notice for which being legally noticed on October 3. 2019. Present: Gina Belforte, Mayor Joseph 'r. Callinan, Vice Mayor Susan Hollingsworth Adams, Councilmember Jake Mackenzie, Councilmember Pam Stafford, Councilmember Staff present: City Manager Jenkins, Assistant City Manager Schwartz, Assistant City Attorney Rudin, Development Services Director Pawson, Director of Public Safety Mattos, Director of Human Resources Perrault, Senior Code Compliance Officer Kirk, Development Engineering Manager/Building Official Bradford, Fire Marshal Thompson, and City Clerk Buergler. 2. PLEDGE OF ALLEGIANCE Led by Development Engineering Manager/Building Official Bradford. 3. PRESENTATIONS A. New Voting System and Accessible Ballot Marking Device Presentation by Deva Marie Proto, County Clerk-Recorder-Assessor-Registrar of Voters of the County of Sonoma County Clerk-Recorder Proto presented the item. 13. Mayor's Proclamation: Recognizing October as Domestic Violence Awareness Month Mayor Belforte read and presented the proclamation to Wendy Adams, Sonoma County YMCA Director. Vice Mayor Callinan stepped away from the dais 5:21 pm and returned 5:22 pm. Report presented by Emily Ann Miller, Vice President of External Affairs and Yeymi Perez, Community Affairs Senator, Sonoma State University Associated Students, Inc. (SSU ASI) Emily Ann Miller informed that the University is bringing back Good Neighbor Initiative signed in 2016, having Voter Education Week and organizing a Voter Registration Blitz this January to ensure students are more involved in the elections and registered to vote. Yeymi Perez said that the University is working on resolutions regarding the environment, beautifying schools, fall commencement, etc. 5. DEPARTMENT HEAD BRIEFING City Manager Jenkins reported on the PG&E planned power shutdown, the activation of the City's EOC, and the proclamation declaring a local emergency which requires City Council ratification. City Manager Jenkins requested the addition of an urgency item to the agenda regarding Council consideration of adopting a resolution ratifying the Director of Emergency Services' proclamation declaring the existence of a local emergency. MOTION TO ADD ITEM TO AGENDA City Manager Jenkins reported the following facts which supported the findings necessary for Council to add the item to the agenda: I. The need to adopt this Emergency Resolution came to the attention of the City on October 8, 2019 when the Director of Emergency Services proclaimed a Local Emergency which was after the posting of the agenda; 2. There is a need to take action prior to the next regularly scheduled City Council Meeting; and 3. The emergency declared by the Director of Emergency Services must be ratified by October 15, 2019. ACTION: Moved/seconded (Stafford/Adams) to find that a need to take action came to the attention of the City after the posting of the agenda, there is a need to take action prior to the next regularly scheduled meeting, and to add as an urgency item the consideration of a resolution ratifying the Director of Emergency Services' proclamation declaring the existence of a local emergency. Motion carried by the following unanimous 5-0-0 vote: AYES: Adams, Mackenzie, Stafford. Callinan and Belforte, NOES: None, ABSENT None. Consideration of Adopting a Resolution Ratifying the Director of Emergency Services' Proclamation Declaring the Existence of a Local Emergency City Manager Jenkins presented the item. Recommended Action(s): Adopt Resolution ratifying the proclamation. Public Comments: None. Motion carried by the following unanimous 5-0-0 vote: AYES: Adams, Mackenzie, Stafford, Callinan and Belforte. NOES: None, ABSENT None. 6. PUBLIC COMMENTS Deborah Nelson thanked the Council and Staff for the paint job on a fire hydrant located in her neighborhood and requested a speed monitor and a parking sign be place down her street to assist street sweepers. John Logan spoke against 5G Wireless Technology. David Molidor spoke against 5G Technology and requested the Telecommunications Ordinance be updated to protect the city. 7. CONSENT CALENDAR A. Acceptance of Reports for City Bills/Demands for Payment dated September 16 through September 27, 2019 B. Approval of Minutes for City Council/RPFA/Successor Agency Joint Regular Meeting, September 24, 2019 C. Adoption of Resolution 2019-123 Accepting a Grant in the Amount of $56,363.63 from FEMA through the Assistance to Firefighters Grant (AFG) Program and Authorizing the Finance Manager to Increase Appropriations In the FY 19/20 Budget by$56,363.63 D. Adoption of Resolution 2019-125 Authorizing the City Manager to Execute a Consultant Services Agreement with RailPros, Inc. for a Railroad Grade Crossing Safety Evaluation, Recommendations, and Cost Estimates, and Related Actions City of Rohnert Park.loint Regular Meeting Minutes for City Council October 8, 2019 RPFA/CDC Successor Agency Page 4 of 6 ACTION: Moved/seconded (Adams/Stafford) to approve Item 7.E. and direct staff to draft a letter to Sonoma Marin Area Rail Transit (SMART) Regarding Safety at Golf Course Drive Crossing and discuss the request at their SMART Board of Directors Meeting. PUBLIC COMMENT: Deborah Nelson spoke about the speed of the train and stated it is very dangerous. Motion carried by the following unanimous 4-1-0 vote: AYES: Adams, Mackenzie, Stafford, Callinan and Belforte, NOUS: Callinan, ABSENT None. 8. REGULAR ITEMS: 8. A. Discussion and Direction on Proposed Local Amendments, Policies and Fees to be Included with the Adoption of the 2019 California Building Standards Code. Director of Development Services Pawson, Development Engineering Manager/Building Official Bradford, and Fire Marshal Thompson presented the item. Recommended Action(s): Provide direction to staff on local amendments, policies and fees to be included with the adoption of the 2019 California Building Standards Code. Councilmember Mackenzie stepped away from the dais 6:31 pm and returned 6:34 pin. Mayor Belforte stepped away from the dais 6:59 pm, Vice Mayor Callinan assumed the gavel. Mayor Belforte returned 7:01 pm and reassumed the gavel. PUBLIC COMMENT: None. ACTION: By Majority (Callinan opposed to Green Building Standards), City Council directed staff to move forward with their proposed local amendments to the 2019 Standards, Polices and Modification to fees. Staff will bring back an item adopting all proposed amendments to General Provisions and Penalties, Building Code, Residential Code, Electrical Code, Mechanical Code, Plumbing Code, Energy Code, Existing Building Code, Green Building Code & Fire Code discussed today. 8. B. PUBLIC HEARING (Noticed: September 20,2019) Finding and Determining that the Public Interest and Necessity Require the Acquisition of Certain Property Interests for Public Purposes Remnant Parcel East of APN 047-132-038, Adopting a Resolution of Necessity, and Authorizing the City Manager to Initiate Eminent Domain Action to Acquire Fee Interest. Development Services Director Pawson presented the item. Recommended Action(s): Adopt Resolution 2019-124 Finding and Determining that the Public Interest, Convenience and Necessity Require the Acquisition of Certain Property Interests for Public Purposes in the Remnant Parcel East of APN 047-132-038 and Authorizing the City Manager to Initiate Eminent Domain Action to Acquire Fee Interest. Discussion and Direction Pertaining to Shopping Cart Management Options Development Services Director Pawson and Senior Code Compliance Officer Kirk presented this item. Staff Recommendation(s): Provide direction to staff on options for managing shopping carts throughout the City. PUBLIC COMMENT: None. ACTION: By Consensus (none opposed), City Council directed staff to move forward their proposed Option Number 3: "Require Cart Retrieval and Management Plans from Businesses' and implement the"Enhanced Status Quo'through a two tiered approach that includes outreach and education efforts with the retail community. MATTERS FROM/FOR COUNCIL Councilmember Mackenzie indicated that Cindy Krone, Ph.D and Commissioner Tony Linegar would be interested in working with the City in a technical advisory manner to assist the City with the possible implementation of the Integrated Pest Management (IPM) Program. 13. PUBLIC COMMENTS Gary Coffman stated the Council spent too much time talking about shopping carts tonight, which is a poor waste of time in his opinion. lie also stated trains do not kill people. People use trains to kill themselves. He does not agree with Council paying SMART to conduct any study and believes it is SMART's responsibility. 14.
