2021/01/12 City Council Resolution 2021-007 RESOLUTION NO. 2021-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING A LARGE LOT TENTATIVE MAP TO ALLOW THE SUBDIVISION OF PROPERTY LOCATED SOUTH OF CAMINO COLEGIO, WEST OF THE SOUTHEAST SPECIFIC PLAN, EAST OF THE SMART RAIL AND NORTH OF E. RAILROAD AVENUE (APNS 46-051-040, 46-051-042, AND 46-051-045) WHEREAS,the applicant, SOMO Village LLC, filed a Planning Application proposing a Large Lot Tentative Map (PLSD19-0002), for the SOMO Village ("Project") located south of Camino Colegio, west of the Southeast Specific Plan, east of the SMART rail and north of E. Railroad Avenue(APNs 46-051-040,46-051-042, AND 46-051-045), in accordance with the City of Rohnert Park Municipal Code ("RPMC"); and WHEREAS,the City has assessed the potential environmental impacts associated with the Project and adopted an Environment Impact Report (EIR) in 2010; and WHEREAS,pursuant to California State Law and the RPMC,public hearing notices were mailed to all property owners within an area encompassing a three hundred foot radius of the subject property and a public hearing notice was published for a minimum of 10 days prior to the first public hearing in the Community Voice; and WHEREAS, on December 17, 2020, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal and recommended that the City Council approve the Large Lot Tentative Map (LLTM); and WHEREAS, on January 12, 2021, the City Council held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rohnert Park makes the following findings, determinations and recommendations with respect to the proposed Tentative Map for the property: Section 1. The above recitations are true and correct Section 2. Environmental Review. On July 22, 2010, the City Council of the City of Rohnert Park certified the Final EIR for this Project, including adoption of associated CEQA Findings, Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program, as described in City Council Resolution No. 2010-101. Section 3. Findings Regarding Tentative Map. The City Council makes the following findings pursuant to Rohnert Park Municipal Code section 16.10.090(E): 1. The proposed map, and its design and improvements, are consistent with the general plan and any applicable specific plan, any policy or guideline implementing the general plan (including the city's design guidelines), or other applicable provisions of this code. Criteria Satisfied.The proposed Tentative Map is consistent with the General Plan designations for the area, as well as the 2010 Final Development Plan that applies to the property. The proposed Tentative Map will implement the General Plan in that it would ensure that adequate infrastructure is available in timely fashion to support the proposed development. The proposed Tentative Map complies with section 16.10.080 (Tentative maps— Accompanying data and reports)of the Rohnert Park Municipal Code and includes all of the required data and reports. The proposed Tentative Map has been designed to meet City standards which provide satisfactory pedestrian and vehicular circulation, including emergency vehicle access and on site improvements, such as streets, utilities, and drainage facilities have been designed and are conditioned to be constructed in conformance with City standards. 2. The site is physically suitable for the type of development. Criteria Satisfied. No major geologic hazards have been reported on the site or other limited conditions that would render it unsuitable for residential and commercial development. The project has been analyzed to confirm that a mixed use project will not have an undue impact on the surrounding neighborhoods. A mixed use project is appropriate in this location due to the proximity to the SMART station (1/2 mile north in Cotati) and the SMART, multi-use plan which will enhance the pedestrian and bicycle network. 3. The site is physically suitable for the proposed density of development. Criteria Satisfied. The site is of sufficient size and shape to allow the proposed density of development. The subdivision has been designed to accommodate the development of over 1,700 residential units,taking into consideration the shape and topography of the site. 4. The design of the subdivision or the proposed improvements will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, absent a statement of overriding conditions. Criteria Satisfied. An Environmental Impact Report (EIR) was processed and approved for the Sonoma Village Planned Development (State Clearinghouse # 20070521116), which shows potential impacts related to the development of the site with the proposed uses. The Final EIR for this Project includes adoption of associated CEQA Findings, Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program. 5. The design of the subdivision or the type of improvements will not cause serious public health problems. Criteria Satisfied. The design of the project is not expected to have negative impacts on the health or wellbeing of project residents or occupants of the surrounding land uses. The design of the Tentative Map is in conformance with the City's General Plan, Zoning Ordinance, and Subdivision Ordinance. The construction of units on the site will comply with all applicable City ordinances, codes, and standards including, but not limited to,the California Uniform Building Code, the City's Ordinances relating to Stormwater runoff management and controls. In addition, the design and construction of all improvements for the Resolution 2021-007 2 subdivision has been conditioned to be in conformance with adopted City street and public works standards. The City's ordinances, codes, and standards have been created based on currently accepted standards and practices for the preservation of the public health,safety and welfare. Finally,the proposed street system throughout the subdivision will improve emergency vehicular access and in the immediate neighborhood. 6. The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large,for access through or use of property with the proposed subdivision, absent alternative, equivalent easements. Criteria Satisfied. The project will respect all existing easements, and any new easements required by the project have been incorporated on the Tentative Map. 7. Any proposed phases and their proposed sequence of construction are identified on the submitted map. Criteria Satisfied. The large lot tentative map exhibits include a phasing plan which aligns with the configuration of the proposed lot configuration. This will allow for the project to be constructed in phases starting in the northeast corner of the site where infrastructure is most readily available. The phasing plan will allow for infrastructure to be expanded incrementally as the project is developed over time. Section 4. The City Council hereby approves the Tentative Map for the SOMO Village Project, as shown in Exhibit A attached hereto, subject to the Conditions of Approval attached as Exhibit B. This indemnification obligation shall include but not be limited to, damages, costs expenses, attorneys’, or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents, officers, attorneys or employees Applicant All times City 4 The applicant shall comply with all documents approved by the City Council including the Final Development Plan, Mitigation and Monitoring Program and Tentative Map. Applicant All times City 5 In case of conflict between the various documents, the following order shall prevail: General Plan as amended, Mitigation Measures included in the Environmental Impact Report for the Sonoma Mountain Village (SCH # 20070521116) (“EIR”), Tentative Map and its Conditions of Approval, Rohnert Park Municipal Code (RPMC), and Design and Construction Standards. Subsequent environmental review shall be prepared and certified for any development phase or portion of a phase that results in project-specific impacts not previously addressed in the EIR and SEIR. Projects implementing the Final Development Plan and each development phase shall also comply with the implementation, monitoring and reporting requirements for each mitigation measure included in the adopted Mitigation Monitoring Program. Costs of implementing and monitoring the mitigation measures shall be borne by the Applicant and any successors- in-interest.
