Planning Manager, Jeff Beiswenger, and Consultant Emmanuel Ursu, introduced the item and answered questions from the Commission, including: the use of redwood trees in regards to water intensity; plant species selected for landscaping; encouraging the use of drought-tolerant native species for biodynamics and pollinators during drought; the placement of houses (#1-19) near open space wetland area near Petaluma Hill Road and Snyder Road and potential impacts; if this is an increase in houses from prior approvals; total houses that have been approved in this specific plan; square footage of lot sizes; and, limits of lot size in regards to the zoning designation. A Development Area Plan (DAP) is intended to allow a phase or phases of an approved specific plan area to be considered prior to the approval of final maps or submittal of building permits for the applicable area. The specific plan presents the overall picture for the area and the development standards and design guidelines provide direction on how development should appear. A DAP implements the Specific Plan by establishing the architecture, site plan(s), landscape treatments, and other specifics for a given portion of a plan area. DAPs typically apply to both the public realm (streets and open space) and the private realm (individual homes and lots). The subject application addresses the private realm. BACKGROUND: In 2006, the University District Specific Plan (UDSP) and a development agreement (DA) between the City, University District LLC, and Vast Oak Properties L.P. was approved and associated General Plan amendments were also adopted and implemented to allow development of 1,645 residential units and 175,000 square feet of commercial space on approximately 300 acres of land owned by five property owners (University District LLC, Vast Oak Properties, Cotati-Rohnert Park Unified School District, Signature Homes, and Linden). 2 Subsequent amendments to the UDSP, DA, and General Plan were approved in 2014 and in 2019. An Environmental Impact Report (EIR) was prepared and adopted by the City in conjunction with this 2006 approval of the Specific Plan, General Plan amendments and DA and an addendum to the EIR was prepared in 2014. The 2006 UDSP allocates 52 single-family dwellings in the Vast Oak North area to the Low density 50’ X 95’ SFD designation as shown in Figure 1. Figure 1: Land Use Designation Map and Location Map In 2019, the City granted Tentative Map and DAP I application approvals for the creation of 233 single-family lots in the Vast Oak North (VON) subdivision including community walls and trails. The subject proposal includes 52 of the lots in Phase 3A – Alder of the VON subdivision. See the area in orange in Figure 2. “Seasons” is the applicant’s marketing name for the project. 3 Figure 2: Vast Oak North Map PROJECT SUMMARY: The proposed project involves a Development Area Plan II (DAP II) application for the home designs (floor plans, building elevations, roof plans, colors, and materials); landscaping in the front and street-side yards; and yard fences on the 52 single-family lots in the Alder (Seasons) subdivision. Steel roll-up garage doors are recessed five feet from the front of the home. A covered porch is provided on the Wine County style (which repeats four times in the subdivision) while the Cottage (three homes) and Italian Country (five homes) do not have porches. Agate Cottage - The Cottage style has a lace stucco body with vertical siding accents in the gable ends over the front bedroom and entry. The main roofline is perpendicular to the front of the house and terminates in a gable end with two smaller gable ends adding architectural interest to the simple building form. An optional light next to the garage door, window shutters and a decorative attic vent on the front elevation provide a modicum of ornamentation. 5 Agate Italian Country - A hip roof over the main portion of the house with an offset gable over the front bedroom and entry are used in the Italian Country design. The exterior is finished with lace stucco and a stone veneer wainscot accent is indicated on the front elevation. Other design elements include window shutters, stucco covered foam trim, an arched entry, decorative vent and optional exterior light next to the garage door. Agate Wine Country – In contrast to the Cottage style, the ridge of the main roof on the Wine County style sits parallel to the front of the house with a cross-gable over the front entry and bedroom to break up the roofline. Three wood posts with cross braces at the top and stone veneer at the base support the porch roof. Exterior finish consists of lace stucco for the main body and board and batten siding in the gable end of the porch and a decorative vent and optional light next to the garage door are included. 6 Plan 2: Pearl The Pearl plan is a two-story home with 2,842 square feet (living area plus garage). A covered patio is an available option. The garage door is recessed 4’-6” from the front of the house and the front of the second story is recessed a few feet farther than the garage. Like the Agate plan, the Pearl plan includes a covered entry and a covered porch is provided on the Wine County style (which repeats four times in the subdivision) while the Cottage (five homes) and Italian Country (four homes) have covered entries and no porches. Pearl Cottage- The Pearl Cottage style has a lace stucco body with vertical siding accent in the gable end over the second story front bedroom. The main roofline is parallel to the street with a minor cross gable facing the street. The second story is recessed from the first to break up the vertical mass of the building. Window shutters, divided lights windows, stucco covered foam trim, and an outlooker in the street-facing gable end add architectural interest to the design. 7 Pearl Italian Country- The two-story Pearl plan has a hip roof over the main portion of the house with an offset gable over the front second-story bedroom and a second gable roof over the first-floor bedroom and entry. The exterior is finished with lace stucco and a stone veneer wainscot accent is indicated on the front elevation. Other design elements include window shutters, stucco covered foam trim, an arched entry and recess at one of the second story windows, decorative vent and optional exterior light next to the garage door. Pearl Wine Country- Like the Cottage style, the ridgeline of the main roof on the Wine County style sits parallel to the street with a cross-gable over the second-story bedroom and a second gable at the first floor over the front entry and bedroom. Three wood posts with cross braces at the top and stone veneer at the base support the porch roof. Exterior finish consists of lace stucco for the main body and board and batten siding accent at the section of the second story over the porch and in the gable end of the porch roof. A decorative vent and optional light fixture next to the garage door are included. 8 Plan 3: Moonstone Fourteen of the 52 homes proposed in the Alder subdivision are the two-story Moonstone plan type. This plan includes an optional covered patio and an optional extended covered patio at the rear. The garage is recessed 7’- 4” from the front of the house and a portion of the second story above the first-floor study is recessed to line up with the garage and the portion of the second story projects out over the garage. No covered porch is provided for the Moonstone plan. Moonstone Cottage- The Cottage style has a lace stucco body with vertical siding accent in the gable end over the second story front bedroom which projects slightly towards the street above the garage. The main roofline is parallel to the street with a minor cross gable over the projection above the garage and over the first floor study and covered entry. Window shutters, divided light windows, stucco covered foam trim, and an optional light fixture next to the garage door add architectural interest and ornamentation to the design. 9 Moonstone Italian Country- The two-story Moonstone plan has a hip roof over the main portion of the house with an offset hip over the front second-story bedroom that projects over the garage door and a gable roof over the first-floor study and entry. The exterior is finished with lace stucco and a stone veneer wainscot accent on the front elevation. Other design elements include window shutters, stucco covered foam trim and corbels under the second story bedroom projection and first floor gable roof eave, an arched entry, decorative vent and optional exterior light next to the garage door. Moonstone Wine Country- The ridgeline of the main roof on the Wine County style sits parallel to the street with a cross-gable over the second-story bedroom projection above the garage and a shed roof at the first floor over the study and front entry. A wood post with a cross brace at the top and stone veneer at the base supports the outside corner of the roof over the entry. Exterior finish consists of lace stucco for the main body and board and batten siding accent at the section of the second story projecting over the garage. Stucco-covered foam corbels are provided under the second story projection above the garage, shutters at two second story windows, divided-light windows, stone veneer wainscot on the front elevation and a decorative vent and optional light next to the garage door provided architectural interest and ornamentation. 1 Plan 4: Ammolite The Ammolite plan is the largest of the four plan types with a total floor area just under 3,500 square feet. All three styles include six- foot deep covered front porches, and the garage door is recessed five feet from the front of the house, 11 feet from the front of the covered porch. An optional covered patio is available with this plan. Thirteen Ammolite plans are proposed in the subdivision. Ammolite Cottage- The Cottage style has a lace stucco body with vertical siding accent in the gable end over one of the second story front bedrooms. The main roofline is parallel to the street with a minor cross gable at the second story and over the porch below with a shed roof over the front portion of the garage where the second story is stepped back. Window shutters, divided light windows, stucco covered foam trim, and an optional light fixture next to the garage door add architectural interest and ornamentation to the design. 1 Ammolite Italian Country- A hip roof is provided over the main portion of the house with an offset cross gable at one of the second floor bedrooms over the front porch. There is a shed roof over the front of the garage where the second story is stepped back. The exterior is finished with lace stucco and a stone veneer accent on the front elevation at the base of the arched porch columns. Other design elements include window shutters, stucco covered foam trim, an arched window recess at the second story, and optional exterior light fixture next to the garage door. Ammolite Wine Country- The ridgeline of the main roof on the Wine Country style sits parallel to the street with a cross-gable at the second-story bedroom above the front porch. Four woods post with a cross braces at the top and stone veneer at the base supports the roof over the front porch. Exterior finish consists of lace stucco for the main body and board and batten siding accent at the section of the second story over the porch. Window shutters at two second story windows, divided-light windows, and a decorative vent and optional light fixture next to the garage door provided architectural interest and ornamentation. Colors Three color schemes are proposed for each architectural design proposed as shown below and on the last three Architectural plan sheets (before the Landscape Plans). Scheme #1, 2 and 3 are for the Cottage elevations with earth tones for the main body and trim that is lighter than the main body color with darker colors for the accent siding, facias and eaves, doors and window shutters. 1 Color Scheme #4, 5 and 6 are used on the Italian Country elevations and have a cream body color that is lighter than the trim. In Scheme #4 the accent siding, shutters, facia and eaves and doors are greens that are slightly darker than the main body of the house whereas in Scheme #5 and 6 the main body is much lighter than the other colors on the house. 1 Color Scheme #7, 8 and 9 are used on the Wine Country styles. In Scheme 7, the trim and accent colors are much darker than the main body and in Scheme 8 and 9 the trim and body do not have as much contrast. Landscaping The landscape Master Plan (Sheet L-1.0) identifies the location and species of trees, shrubs and ground cover proposed. As a part of the project, the applicant will install landscaping in the front and street side yards. Back and interior side yard landscaping will be installed by future homeowners. 1 All of the proposed landscape material has low water use with the exception of one vine (Japanese Creeper). Three tree species are proposed (Arbutus Marina, Crape Myrtle and Purple Leaf Plum) in 15-gallon containers with one tree proposed on each home site and two trees proposed on Lot Nos. 27 and 44. A typical landscape plan is provided on Sheet L-2.0 with an excerpt of the plan pasted below. ANALYSIS: As proposed, the project is consistent with the UDSP including the UDSP Design Guidelines. Building and roof forms, patterns of fenestration and openings, exterior colors and materials are designed to reflect the character of the neighborhoods developing in the UDSP, provide articulation when viewed from the street, contain an appropriate amount of diversity and variety in design while maintaining a cohesive and complementary theme. In addition, features of the project include those that implement the following Design Guidelines: • Porches and/or entries are strongl y encouraged on select floor plans and elevations to be the primary element of each home on the street façade. • Home architecture or porches preferred closer to street than the garage doors. • Provide a minimum 3 elevations per floor plan and 3 architectural styles per neighborhood, though 4 architectural styles per neighborhood is preferred. • A variety of roof plans is desired, dependent on architectural style, as roof forms and materials have impact on neighborhood, though roof forms must remain simple in form to allow for future photovoltaic applications by homeowners. • Roofs over one-story elements, such as those over porches or bays, provide additional articulation of the massing of larger, two-story residences. • Roof forms should accentuate building elements and functions. • Roofing materials appropriate to architectural style and pitch and for future photovoltaic applications. • Provide homes with a color palette that includes body, trim and accent colors. 1 • Building colors and materials should reflect the neighborhood’s character with diversity for visual interest and unifies the homes with complementary images. • Each elevation with 3 colors minimum; 1 body, 1 trim and 1 accent. • Each neighborhood with a minimum of 3 roof profiles and building colors. • Individual color schemes must be appropriate to architectural styles with a harmonious selection of accent materials, roof profiles and colors. • No adjacent single-family detached home with same color. • Buildings should be oriented to walkways, paseos, motor-courts, drives and/or streets, when feasible. • When garages are 18’ minimum behind front propert y line, no garage should be less than 3' behind forward portion of home or porch. The proposed homes incorporate all of the above design guidelines and the home styles are consistent with the design elements envisioned for the Cottage, Italian Country and Wine Country. To approve a DAP, the City Council must find that the proposed development conforms to the specific plan; and, either: (a) public infrastructure and services can be provided concurrently with the development; or (b) a statement of public policy consideration and/or an exception can be granted. Staff reviewed the Alder (Seasons) DAP II submittal and found it to be consistent with the UDSP 1 the standards for home and landscape design including standards for building setbacks, building height, lot coverage, parking, building architecture and plant palette. In addition, public infrastructure and services are being provided with the development as the developer will be required to participate in the Public Facilities Financing Plan, which will provide for necessary off- site public facilities, and shall be responsible for on-site facilities to meet the project’s needs. ENVIRONMENTAL DETERMINATION: The City prepared an Environmental Impact Report (EIR) to address the potentially significant adverse environmental impacts associated with the planning, construction, or operation of the UDSP and to identify appropriate and feasible mitigation measures and alternatives that may be adopted to significantly reduce or avoid the impacts identified in the EIR. The City certified the Final EIR for the University District Specific Plan project on April 26, 2006. An Addendum to the EIR was prepared to analyze the revised 2014 UDSP Project relative to the UDSP analyzed in the 2006 EIR. Updated traffic, noise and air quality analyses were prepared, and the water supply assessment was reviewed to support the Addendum. The Addendum concluded that the proposed changes in the Project would not result in a new or substantially more severe impact than disclosed in the 2006 EIR. The proposed DAP II is consistent with the analysis in the EIR and EIR Addendum and would not result in additional environmental effects. Therefore, no additional environmental review is necessary. Further, CEQA Guidelines section 15162 provides that “no subsequent EIR shall be prepared” for a project unless the lead agency determines that (1) “substantial changes are proposed in the project which will require major revisions of the previous EIR”; or (2) “substantial changes occur with respect to the circumstances under which the project is undertaken”; or (3) “new information of substantial importance … shows” one or more significant effects not discussed in the original EIR, greater severity to previously-identified substantial effects, or newly-found feasible mitigation measures that would substantially reduce significant effects. As noted above, the DAP is consistent with the previous analysis in the 2006 EIR and 2014 Addendum. MITIGATION MONITORING AND REPORTING PROGRAM: The mitigation measures required to reduce the impacts to a less than significant level have been included as part of the Mitigation Monitoring and Reporting Program in the Final EIR. The program identifies the required mitigation measures, responsibility for ensuring compliance and the timing of the measure implementation. City staff is actively monitoring compliance with the adopted mitigation measures as construction proceeds in the UDSP. PUBLIC NOTIFICATION: A public hearing notice denoting the time, date, and location of this hearing was published in the Community Voice on May 14, 2021. Property owners within 300 feet of the project site and interested parties requesting notification were also mailed notices, and the notice was posted pursuant to State law. Public infrastructure and services can be provided concurrently with the development Criteria Satisfied. The developer will be required to participate in the Public Facilities Financing Plan, which will provide for necessary off-site public facilities, and shall be responsible for on-site facilities to meet the project’s needs. The Development Agreement for the project sets forth the timing of the necessary facilities as they relate to the physical development of the site. Section 4. The University District shall be developed in accordance with the General Plan (GP), University District Specific Plan (UDSP) including Design Guidelines, Mitigation Measures (MMs) identified in the UDSP Final Environmental Impact Report (FEIR), Development Agreement (DA) between the City and University District LLC, the Rohnert Park Municipal Code (RPMC), and the Design and Construction Standards. General Requirements 1) The applicant shall comply with all documents approved by the City Council and adhere to all verbal representations and exhibits presented by the applicant at the Planning Commission and\or City Council meeting for approval of the University District Specific Plan project unless subsequently revised by the City. 1) In case of conflict between the various documents, the following order shall prevail: General Plan, UDSP, Mitigation Measures for the FEIR, RPMC, DA, Tentative Map and its Conditions of Approval, UDLLC DAP I and conditions of approval, and Design and Construction Standards. 2) The applicant shall comply with the FEIR. In addition the applicant shall pay the cost to monitor the mitigation measures identified in the FEIR for the UDSP Project (SCH # 2003122014) kept on file in the Development Services Department. The requirements contained in the Mitigation Monitoring Program (MMP) shall be incorporated into these conditions and constructed in accordance with the MMP. 3) The applicant agrees to indemnify, hold harmless and defend the City, its officers, agents, elected and appointed officials, and employees, from any and all liability or claims that may be brought against the City arising out of its approval of the Project. 4) By accepting the benefits conferred under this approval, the applicant acknowledges all the conditions imposed and accepts the DAP subject to those conditions with full awareness of the provisions of the Specific Plan, as may be amended from time to time, and the RPMC, as applicable. 5) The use of the property by the applicant/grantee for any activity authorized by this approval shall constitute acceptance of all of the conditions and obligations imposed by the City on the DAP. The applicant/grantee by said acceptance waives any challenge as to the validity of these conditions. 6 Reso 2021-08 6) All improvements shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant plans of affected agencies, unless superseded by the Specific Plan for this property. 7) The development of this phase shall be consistent with all other approvals associated with this project (e.g. UDSP/Design Guidelines, Tentative Map, DA). 8) The applicant shall obtain all necessary permits and clearances from the Rohnert Park Building and Public Safety Departments prior to occupancy of the project. 9) Any covenants, conditions, and restrictions (CC&R’s) applicable to the project property shall be consistent with the terms of these conditions and the City Code. If there is conflict between the CC&R’s and the City Code or these conditions, the City Code or these conditions shall prevail. Site Plan, Landscaping and Signs 10) All improvements shall be in conformance with the submitted Site Plans, Building Plans, and Landscape Plans, except as modified herein. 11) All plant materials proposed shall be in conformance with the University District Plant Material Matrix contained in Appendix B of the Specific Plan. 12) The design of all entrances to the site shall be subject to Department of Public Safety approval. 13) The designs and locations of decorative paving treatments shall be subject to staff review and approval. 14) The Planning Manager shall have the authority to administratively approve minor variations to the DAP that may be subsequently proposed following DAP approval. 15) All exterior lighting shall be designed so as to prevent any spillover lighting onto adjacent properties and rights-of-way. Lighting elements will be required to be recessed within their fixtures to prevent glare. New lighting levels provided shall be compatible with general illumination levels in existing areas to avoid a noticeable contrast in light emissions, consistent with the need to provide for safety and security. Exterior project lighting shall be reviewed and approved by Development Services Director. 16) The design of any entry monument signage shall be submitted to the Planning Division for review and approval prior to installation. 17) The project applicant shall design and construct all project facilities in accordance with the most recent seismic standards of the California Building Standards Code. 18) The applicant shall design and construct the foundations for all project structures using standard engineering practices that account for, and minimize damage resulting from, 7 Reso 2021-08 expansive soil conditions. Specific design and constructed methods shall be as directed by Mitigation Measure GE0-8a of the FEIR for this project. 19) All trees within five feet of the public right-of-way shall have root barriers that are approved by the Engineering Division. 20) A permanent automatic sprinkler shall be installed to maintain all landscape materials and areas. 21) The applicant's engineer shall coordinate with the City Engineer to ensure that recycled water is used for irrigation of the project's landscaping, if available. 22) The final location for mailbox enclosures, enclosure sizes, and total number of mailboxes and parcel boxes per enclosure shall be subject to review and approval by the Planning Division and United States Post Office. Site Improvements 23) All double-check valves provided for domestic water and fire sprinkler systems shall be concealed from any public streets with decorative walls and landscaping. Plans shall be submitted to the Development Services Department and City Engineer for review and approval. 24) Any changes in sidewalk configuration due to site grades and transformer locations shall be subject to review and approval by the Planning Manager and City Engineer. Construction Mitigation 25) For any project requiring an on-site inspector to monitor grading and/or development, the applicant shall deposit funds with the City to cover the full cost of an inspector prior to any land disturbance. The City Engineer, as appropriate, shall approve the amount and hire the inspector. 26) The developer shall comply with construction hours pursuant to Rohnert Park Municipal Code Section 9.44.120. 27) All construction material waste and other debris shall be recycled to the extent feasible. The applicant shall present a “clean site everyday” program to City building staff for approval. The program shall include on-site signage in English and Spanish to be posted at construction entrances.
