AGENDA ITEMS 6.1 STUDY SESSION – City of Rohnert Park – Highway 101 Bike/Pedestrian Crossing Feasibility Study Planning Manager, Jeff Beiswenger, introduced the item and answered questions and comments from the Commission and Advisory Committee, including: timing of the project in reference to the Southwest roundabout; the location of the overcrossing; issues with the underpassing including confinement, flood and debris and the creeks; LEED alternatives to add impervious surfaces, setbacks, etc. in regards to the creeks; safety concerns including adequate lighting; width of the path in regards to social distancing, size of and number of people in a group; flat areas for people to rest; touchdown locations; retaining existing trees; partnering with SSU for branding of the City; inclusion of bicycles and electric powered devices (e.g. scooters and bicycles); and, inclusion of cultural and aesthetic motifs. Consultant Steven Grover joined the meeting to present the item and answered questions from the Commission and Advisory Committee, including: differences in maintenance between the plans; ADA accessibility; and, the design of crosswalk signal for safety. Public Comment: None. 6.2 GENERAL PLAN UPDATE STUDY SESSION – City of Rohnert Park – Circulation Element Planning Manager, Jeff Beiswenger, presented the item and answered questions and comments from the Commission and Advisory Committee, including: encouraging staff to implement LEED, to incentivize and have the plan reflect the diverse populations of the City; code enforcement of parking, specifically combining parking and bike lanes on Golf Course Drive to continue past RPX; increase charging stations in parking lots; wider sidewalks; extending bicycle connections to SOMO Village and downtown; improving parking regulations for recreational vehicles on the streets; time to walk within the City; partnering with Sonoma State regarding automobile impact on the street; traffic generated from the Casino; damage from heavy trucks on the roadways; and, moving bicycles away from the pedestrians for safety. GP/Zoning: High Density Residential Applicant/Owner: Michael Hayward / Faith Community Church RECOMMENDED ACTION: Staff recommends that the Planning Commission hold a public hearing and adopt Resolution No. 2021-05 approving a Conditional Use Permit (CUP) to operate a mobile shower unit at 7352 Boris Ct. BACKGROUND: The applicant, Michael Hayward/Faith Community Church, is proposing to operate a mobile shower unit at 7352 Boris Ct. (see Figure 1). The unit will be located within the existing parking lot adjacent to the church building on the property. The project site is zoned “R- H” high-density residential, which allows for religious facilities. Adjacent uses include apartment buildings, the Technology Middle School campus and a public park. Figure 1 – Location Map 2 The Redwood Gospel Mission, a faith-based homeless service agency based in Santa Rosa is seeking to bring a mobile shower unit to Rohnert Park on a weekly basis. Faith Community Church will host the mobile shower unit on church property at 7352 Boris Ct. The mobile shower unit requires electrical hook-ups and the availability of on-site water, but is otherwise self-contained. Redwood Gospel Mission would provide the staff to set up and operate the unit at Faith Community Church. Other activities currently occur on the site, which would complement the mobile shower unit. The church currently offers a free “thrift store” for unsheltered individuals to get clothes and have indicated that they are eager to partner with City-funded services, such as the Homeless Outreach Services Team (HOST) to provide on-site services to individuals. Likewise, Unsheltered Friends Outreach, a small group of dedicated volunteers that engage unsheltered individuals in Rohnert Park and Cotati, said that they would use the weekly event as an opportunity to provide meals and support to unsheltered individuals. The church has requested that the mobile shower trailer be allowed to operate at their facility one day a week for a few hours – likely on Wednesdays 11am to 1pm. Based on Redwood Gospel Mission’s operational experience throughout Sonoma County, the shower is expected to serve 6- 12 people per week. The proposed site layout is depicted in Figure 2. Operational details include: • Location of trailer. Trailer has two shower stalls with an on-board 125-gallon fresh water tank with a pump to provide enough pressure for the showers. A photograph of the mobile shower unit is included as Figure 3. • Location of hose bib. The tank will need to be periodically refilled, so a hose bib is available adjacent to the building. • Temporary barricades. The back part of the parking lot will be blocked with movable barricades to prevent vehicles from freely entering the back part of the site. Those arriving on foot or on bicycle will easily be able to pass through. The area behind the barricades will be a pedestrian only area. • Client Intake. The location of the intake area is indicated on Figure 2. This is where visitors can check-in, sign-up for a shower and discover other services available. • Trash Receptacles. The location of trash receptacles are noted on the map and these will help ensure proper disposal of trash and debris. A dumpster is also available on the site. • Electrical Connection. Electricity is available at the building and is needed to power the trailer’s lights and pumps. A GFCI converter will need to be used to plug-in to reduce the risk of electrical short-circuits due to the presence of water. • Restroom facilities. The existing church building has restroom facilities available. The mobile shower trailer also has a small restroom available in each of the two stalls. 3 Figure 2 – Proposed Site Layout Figure 3 – Mobile Shower Unit ANALYSIS: The site proposed for the proposed mobile shower unit is bordered on the north, south, and west sides by high-density residential zoning and on the east by Benicia Park, and Technology Middle School. The zoning for the property is high density residential (R-H) and allows for Religious Assembly, which has been established on this property. According to provisions within the Municipal Code, the mobile shower unit may be permitted as a reoccurring temporary use under section 17.25.044 (Periodic temporary events) with the issuance of a Conditional Use Permit (CUP). 4 The Planning Commission has the authority to issue a conditional use permit for a periodic temporary use, after conducting a public hearing and subject to appeal to the City Council. Prior to approval, Planning Commission must make certain findings of fact, provided in the attached resolution. Staff has reviewed and analyzed potential concerns with the operation and finds that each concern can be adequately addressed by the proposed operation. Staff’s analysis is provided below. Debris and litter Persons may arrive on site with trash to dispose of. A small amount of trash will be generated as part of the temporary use. Trash receptacles will be required to be available during the operation of the temporary use. A conditional of approval will require that the site is kept free of any litter or debris and that a clean-up occur at the conclusion of each event. The applicant has identified the location of the trash receptacles and the dumpster on the site plan. Americans with Disabilities Act (ADA) compliance While the applicant and operator report that patrons of the shower unit typical arrive under their own power, persons with disabilities may arrive on site to use the shower facilities. The units are currently only accessible via stairs (two stairs for each unit). To address the need for accommodation, Redwood Mission Gospel Mission has an established Accessibility and ADA Policy for temporary events. The following protocol has been established, which incorporates Redwood Gospel Mission’s policy and addresses the potential for accommodation: • Availability of a portable ADA compliant wheel chair ramp that can be put in place when needed; • A minimum of one designated ADA compliant parking space; • Presence of at least two volunteer assistants to help guide those with disabilities to the appropriate destination and assist with access to the shower facility. Water supply and backflow prevention A hose bib is available adjacent to the church building which can be used as a water supply to refill the 125 gallon, on-board fresh water tank. This property does not have a backflow prevention device installed, which means that if a direct connection to the on-board water tank and the hose bib is established, water from the trailer could “back flow” into the City’s water system. To prevent this from happening the tank should only be filled if an air space can be provided between the inflow of water from the hose bib and the water within the tank. The applicant will be required to a submit procedure to refill the tank to ensure that backflow cannot occur. Electrical Availability and Safety An electrical connection is necessary for the operation of the mobile shower units. The applicant has indicated that power cords will be covered as necessary along pedestrian paths to avoid tripping hazards. A GFCI converter will be required at the plug-in for the mobile shower trailer. Ground fault circuit interrupter (GFCI) is a fast-acting circuit breaker designed to shut off electric power in the event of an electrical short. This is particularly important where water is present, since water is an excellent conductor of electricity and electrocution could occur if protections are not in place. Arrival and intake on site 5 Upon arrival at the site, patrons will be directed to check in at the entry table. Patrons can walk on the covered sidewalk along the side of the church to get to the shower units. They will not need to walk through the church. Temporary barricades will prevent cars from entering the back part of the site while allowing pedestrians to pass through. This will keep the back part of the parking lot safe for pedestrians and other activities. Days of Operation and Duration The applicant has established Wednesday from 11 am to 1 pm as the weekly operation hours. To provide some flexibility, staff recommends that the operation be allowed for a maximum of two days a week, Monday – Friday, and between the hours of 10 am and 3 pm. This will provide some flexibility on the days of operation and allow for time to set-up and breakdown. Signage The sign code does not allow temporary signage to identify this use or for directions. This includes A-board signs or banners. The applicant has indicated that signage will not be necessary for this operation. Security The applicant has indicated that this operation will be well-staffed with three to seven persons on-site at all times to ensure proper operation and address any issues that may arise. A condition of approval has been included to ensure that no fewer than three staff persons are on the site at all times during the operation of the mobile shower unit. COVID-19 Protocols All requirements of the current health orders issued by the Sonoma County Health Officer shall apply, including any future orders issued after the date of this permit. The applicant specifies that a six-foot physical distancing will be required while waiting for a shower stall to open up. The shower stalls will be sanitized after each use. There will be one marked entrance and a separate marked exit. Operator Experience: As part of processing the application, staff has reviewed the experience in other communities. Bayside Church in Santa Rosa, which has been hosting the shower trailer weekly for the past three years, indicate that the program is well managed and report that the neighboring community has not experienced any negative impacts. The City of Santa Rosa has been sponsoring a mobile shower site at City Hall on Saturdays. The City funds the program and Catholic Charities Homeless Outreach Services Team (HOST) owns and operates the shower trailer. This is reported to be a valuable outreach tool to direct unsheltered individuals to available services. If operated as described above, the mobile shower unit will provide a valuable service to the community. Staff recommends approval of the CUP subject to the conditions of approval to ensure safe operation. ENVIRONMENTAL DETERMINATION: This proposal is categorically exempt from the requirements of the California Environmental Quality Act CEQA Class 1, Section 15301, Existing Facilities, as it is a minor alteration of an existing use involving negligible expansion. No further action is required pertaining to environmental review. 6 PUBLIC NOTIFICATION: A public hearing notice denoting the time, date and location of the proposal’s hearing was published in the Community Voice. Property owners within 300 feet of the project site were mailed notices, and the notice was posted pursuant to State Planning Law. Additional notification was provided to residents of the nearby apartment complexes and to the school district. Criteria Satisfied: The proposed mobile shower unit will be located in the existing parking lot of an existing church building. The property is zoned high density residential (R-H). (Exhibit A). The purpose of residential zoning districts generally is to: reserve areas for a broad range of dwelling types and densities, which meet the diverse economic and social needs of the residents consistent with sound standards of public health and safety; ensure the provision of light, air, privacy, and open space; protect residential neighborhoods from excessive noise, illumination, unsightliness, odors, dust, dirt, smoke, vibration, heat, glare, and other objectionable influences and to minimize congestion and avoid the overloading of public services and utilities (RPMC 17.06.010). High density residential zoning districts are intended to allow for a wide 2 Reso 2021-05 range of housing types (RPMC 17.06.020). RPMC permits homeless services for greater than seven people in the high density residential zoning district and allows religious assembly with a conditional permit (RPMC 17.060.030). The proposed used is consistent with these requirement of the Zoning District, which anticipates congregate gatherings. The conditions of approval which limit hours of operation, provide for an organized operation with limited hours of operation and appropriate protection from litter, noise and utility overloading ensure that the proposed mobile shower unit will operate within the intent of the zoning district and not interfere with the peaceful enjoyment of neighboring properties. 2. That the proposed location of the conditional use and the conditions under which it is operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. Criteria Satisfied: The project, as conditioned, will not have a negative effect on the public health, safety or welfare; or be materially injurious to properties or improvements in the vicinity. The proposed use is limited in time to no more than five hours two days a week. In addition, conditions will mitigate any potential risks to public safety and of nuisance conditions. Conditions include: measures to prevent backflow into the city water system; requirements to keep the project site clean and free of debris; COVID-19 protocols; limits on operation hours and noise to protect the peace and enjoyment of neighboring properties; and operational rules, including accessibility accommodation policies, to ensure that the activity operates safely and efficiently. 3. That the proposed conditional use will comply with each of the applicable provisions of Title 17 of the City of Rohnert Park Municipal Code. Criteria Satisfied: The proposed used is consistent with intent of RPMC 17.06.010 and 17.06.020 as related to the high density residential zoning district. The operation under a Conditional Use Permit is consistent with RPM 17.060.030 with respect to the operation of religious assemblies and homeless services in the high density residential zoning district. A violation of a condition of approval or a provision of Title 17, Zoning may cause a conditional use permit to be revoked or modified as set forth in Chapter 17.25 of the Rohnert Park Municipal Code. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality Act, pursuant to California Code of Regulations, Title 14, Chapter 3, Section 15301 (Class 1 – Existing Facilities) , as it is a minor alteration of an existing use involving negligible expansion. Section 4. The Planning Commission does hereby approve Planning Application No. PLUP21-0002 subject to conditions included as Exhibit B Section 5. This action shall not be deemed final until the appeal period has expired and that the appeal period shall be 10 working days from the date of said action. There will be one marked entrance and a separate marked exit direction. • Water will be supplied by Faith Community Church via a hose bib in the back (East) wall of the main sanctuary building and will connect to the trailer with a heavy-duty garden hose. • Used water from the shower unit is collected in a tank on the trailer and is hauled off- site to be disposed of at the Sonoma County Fairgrounds • No toilet facilities are included with the shower trailer. These services are not offered. • The church grounds has two trash cans, one on either end of the parking lot, and one more will be provided near the check in/resource area to collect any trash from guests of the shower. These receptacles will be emptied in the church dumpsters. • In addition to the driver (Norman Anderson) there will be between two (2) and six (6) volunteers on site to help with set up, sanitation, site security, and distribution of resources. Volunteers will be masked and gloved per COVID-19 restrictions. • The parking lot at Faith Community Church is a private parking lot and not subject to traffic. We will have volunteers at the driveway on Boris Ct. to prohibit possible vehicle traffic while the trailer is in use. In essence, the parking lot will be closed during operating hours (which is Wednesdays from 11:00 am – 1:00 pm). Additionally, we will have cones, sawhorses/sandwich boards, and signs set across the parking lot (North to South) in front of the shower trailer area so volunteers, church staff, and guests of the shower will park in the front half of the parking lot away from the trailer. • Any electrical needed by the trailer will be provided from an outlet in the main sanctuary building by way of heavy-duty extension cord running from the building to the back side of the trailer. These cords will not run through foot traffic areas. • All cords and hoses will be marked by cones and/or covered with floor mats to reduce tripping hazards. Exhibit B 7352 Boris Ct. Mobile Shower Unit (PLUP21-0002) Conditions of Approval The conditions below shall apply to the Mobile Shower Unit operation at 7352 Boris Court, Rohnert Park, California. The Conditions of Approval are the obligation of the applicant/operator and place no obligation either express or implied on the City. 1. Compliance with Municipal Code. The applicant shall comply with all applicable sections of the City of Rohnert Park Municipal Code and any other applicable relevant regulations of affected agencies, including the Rohnert Park Building and Public Safety Departments. 2. Indemnification. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert Park, its agents, officers, attorneys and employees from any claim, action or proceedings brought against any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this application or certification of the environmental document which accompanies it. This indemnification obligation shall include but not be limited to, damages, costs, expenses, attorneys’, or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents, officers, attorneys or employees. 3. Permitted Activities. Permitted activities are limited to those described in the in the Shower Trail Narrative (Attachment 1). No other activities are permitted. 4. Security and Staffing. No fewer than three persons shall be available at all times during operation. 5. COVID-19 Protocols. The operation shall comply all requirements of the current and future health orders issued by the Sonoma County Health Officer and the California Department of Health Services. Consistent with City of Rohnert Park policy, all staff and volunteers shall be masked at all times. The shower stalls will be sanitized after each use. 6. Operational and Site Safety Contact: The applicant shall provide the City with the name(s) and contact information for designated site safety and security monitor. This monitor will be on site during the hours of operation to ensure compliance with these conditions of approval. 7. Compliance Reporting. . The applicant shall provide monthly reports to the City on the operation for the first six months of operation. Reports shall include information on days and hours of operation, number of patrons served, operational issues, nuisance complaints and mitigation activities undertaken to resolve operational issue and nuisance complaints. If after six months there are no significant operational issues, reporting frequency shall be quarterly. . 2 Reso 2021-05 8. Americans with Disabilities Act (ADA) compliance ADA compliance shall be achieved through implementation of the following measures. a. One designated ADA compliant parking space shall be designated on site. b. A portable ADA compliant wheel chair ramp shall be available during all hours of operation. c. At least two volunteer assistants shall be available during all hours of operation to help guide those with disabilities to the appropriate destination and assist with access to the shower facility. d. The operation shall compliance with Redwood Gospel Mission Accessibility and ADA Policy at all times (COA Attachment 1). 9. Water supply and backflow prevention. A hose bib shall be available to refill the on- board tank. To prevent backflow into the city water system the on board tank shall only be filled if an air space can be maintained between the inflow of water from the hose bib and the water within the tank. The applicant will be required to submit a tank refill procedure to the Development Services Department prior to operation. 10. Electrical Availability and Safety. An electrical connection with a GFCI shall be available for electrical needs. Power cords shall be covered as necessary along pedestrian paths to avoid tripping hazards. 11. Arrival and intake on site. Temporary barricades shall be placed to prevent cars from entering the back part of the site, while still allowing pedestrians to pass through. The back part of the site shall be maintained as a pedestrian-only zone for safety 12. Days of Operation and Duration. The activity may occur for up to a maximum of two days a week, Monday – Friday, and between the hours of 10 am and 3 pm. 13. No Signage Permitted. No temporary signage shall be used without the necessary permits. A-board signs and other free standing signs are not permitted. 14. Insurance. Provide an endorsement of the project applicant's insurance policy in the amount of $1,000,000 (one million dollars) naming the city of Rohnert Park as an additional insured. The certificate shall be renewed annually and provided to the City until operations permanently cease. 15. Trash and Debris. Litter and trash receptacles shall be placed at accessible location on the site. Site shall be kept free of litter and debris at all times. The church grounds has two trash cans, one on either end of the parking lot, and one more will be provided near the check in/resource area to collect any trash from guests of the shower. These receptacles shall be emptied in the church dumpsters at the termination of the event. 16. Loitering Prohibited. Fixtures or furnishings that encourage loitering and nuisance behavior are prohibited. 17. Fire Extinguishers. Provide fire extinguishers and comply with other requirements per Fire Code. 18. Waste Water. Used water from the shower unit shall be collected in a tank on the trailer and hauled off-site 3 Reso 2021-05 19. Available Restrooms. Bathrooms within the church building shall be available during the event. 20. Noise. No uses or activities shall create noise levels that exceed standards as outlined in Chapter 17.12, (17.12.030) Noise Standards. 21. Canopies and Pop-Ups. Any canopy or pop-up used shall be secured for wind stabilization. 22. Violation and Remedy. A violation of a condition of approval or a provision of Title 17, shall result in revocation and/or a modified conditional use permit per Section 17.25.018 of the Rohnert Park Municipal Code. COAs – Attachment 1 Redwood Gospel Mission Mobile Showers Hiways & Hedges Policy amendment 03/25/2021 Accessibility Policies & ADA Protocol for temporary outdoor events 1. A portable ADA compliant wheel chair ramp must be available on each outing that the RGM provides. The ramp is made of aircraft aluminum and can support up to 1000 lbs. 2. If the Rgm occupies 25 parking spaces, one designated spot will be reserved for those with a disability, and additional spot will be designated for every 25 spots thereafter. 3. All routes within the area receiving services, must be 36” apart 4. Sidewalks and any direct route to the shower unit must beat least 48” wide 5. For any tables, such as a service counter, there must be a minimum clearance of 27”and a minimum width of 36” wide 6. No counter space can exceed 36” tall 7. Appropriate signage must be visible, inaccessible routs such as stairs need a directional sign to the alternate “accessible” route 8. At least two volunteer assistants will help guide those with disabilities to the appropriate destination
