2022/01/25 City Council Resolution 2022-010 RESOLUTION NO. 2022-010 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK PROCLAIMING THE CONTINUING NEED TO MEET BY TELECONFERENCE WHEREAS; the Ralph M. Brown Act allows local legislative bodies to meet by teleconference so long as the enumerated requirements are met (California Government Code section 54953); and WHEREAS, on March 10, 2020, the City of Rohnert Park passed a resolution ratifying the proclamation of a Local Emergency, as defined by the California Emergency Services Act (California Government Code section 8558) as a result of the Coronavirus (COVID-19) pandemic; and WHEREAS, the recently amended Ralph M. Brown Act allows local legislative bodies to continue meeting by teleconference during a gubernatorial proclaimed state of emergency if the local legislative body determines, by majority vote, that as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees (California Government Code section 54953(e)(1)(B)); and WHEREAS, on March 4, 2020, Governor Newsom declared a State of Emergency as a result of the COVID-19 pandemic; and WHEREAS, such State of Emergency remains in effect; and WHEREAS, COVID-19 continues to threaten the health and lives of Rohnert Park residents; and WHEREAS, the Omicron variant and other variants continue to emerge and are highly transmissible in indoor settings; and WHEREAS, breakthrough cases are becoming more common; and WHEREAS, hospitalizations have increased throughout Sonoma County. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that: 1. Due to COVID-19, holding meetings in person will present imminent risks to the health and safety to attendees; and 2. The City Council and any other Council appointed committees and commissions, including the Planning Commission, shall continue to meet by teleconference in accordance with Government Code section 54953(e). BE IT FURTHER RESOLVED that the City Council of the City of Rohnert Park determines that, every 30 days, it will reconsider the circumstances of the emergency and review whether it continues to directly impact the ability of the members to meet safely in person.
