RESOLUTION NO. 2022-02
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARK PROCLAIMING THE NEED TO MEET BY TELECONFERENCE AT THE
REGULAR PLANNING COMMISSION MEETING OF FEBRUARY 24, 2022
WHEREAS; the Ralph M. Brown Act allows local legislative bodies to meet by
teleconference so long as the enumerated requirements are met (California Government Code
section 54953); and
WHEREAS, on March 10, 2020, the City of Rohnert Park passed a resolution ratifying
the proclamation of a Local Emergency, as defined by the California Emergency Services Act
(California Government Code section 8558) as a result of the Coronavirus (COVID-19)
pandemic; and
WHEREAS, the recently amended Ralph M. Brown Act allows local legislative bodies
to continue meeting by teleconference during a gubernatorial proclaimed state of emergency if
the local legislative body determines, by majority vote, that as a result of the emergency, meeting
in person would present imminent risks to the health or safety of attendees (California
Government Code section 54953(e)(1)(B)); and
WHEREAS, on March 4, 2020, Governor Newsom declared a State of Emergency as a
result of the COVID-19 pandemic; and
WHEREAS, the State of Emergency was still in effect during the publication deadline
for the Public Hearings for the February 24, 2022 meeting; and
WHEREAS, Due to COVID-19, holding meetings in person was presenting imminent
risks to the health and safety to attendees at timing of the publication of the public hearings; and
WHEREAS, three Public Hearing Notices were published in the Community Voice to
be held at the Regular Planning Commission on February 24, 2022 via teleconference; and
WHEREAS, the requirements of AB 361 are met to ensure that the public is able to
watch and make public comments during the teleconferenced public meetings.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Rohnert Park that the Planning Commission, shall meet by teleconference in accordance with
Government Code section 54953(e) through the end of February.
