A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK AMENDING A TEMPORARY CONDITIONAL USE
PERMIT FOR A MODEL HOME COMPLEX TO ALLOW FOR THE
INSTALLATION OF TEMPORARY SIGNAGE ON LOT NOS. 77, 78, 79, 80, 81 AND
82 AT UNIVERSITY DISTRICT VAST OAK NORTH PHASE 3B IN THE AREA
SOUTH OF O’RYAN ROAD, NORTH OF HINEBAUGH CREEK AND EAST OF
NORTH KERRY ROAD IN THE VAST OAK NORTH PHASE 3B – WILLOW AT
UNISVERISITY DISTRICT SUBDIVISION
WHEREAS, the D.R. Horton (“Applicant”), filed Planning Application No. PLTU21-
0001 for a Temporary Conditional Use Permit (“TCUP”) for the construction of the Model
Homes and Sales Offices in the Vast Oak North Phase 3B – Willow at University District (the
“Project”), in accordance with the City of Rohnert Park Municipal Code (“RPMC”); and
WHEREAS, the Applicant submitted a signage package for temporary signage to be
installed at the model home complex and has requested an amendment to the TCUP to incorporate
the signage into the project approval documents.
WHEREAS, pursuant to California State Law and the RPMC, public hearing notice was
published for a minimum of 10 days prior to the first public hearing in the Community Voice; and
WHEREAS, the City Council of the City of Rohnert Park has certified the Final
Environmental Impact Report (EIR) and Addendum prepared for the UDSP project and the City
has otherwise carried out all requirements for the project pursuant to CEQA; and
WHEREAS, on February 24, 2022, the Planning Commission held a public hearing at
which time interested persons had an opportunity to testify either in support or opposition to the
proposed TCUP; and
WHEREAS, the Planning Commission has reviewed and considered the information
regarding the proposed amendment to the TCUP.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Rohnert Park make the following findings, determinations, and recommendations with respect to
the proposed Temporary Conditional Use Permit:
Section 1. The above recitations are true and correct.
Section 2. Environmental Review:
A. On May 23, 2006, the City Council of the City of Rohnert Park certified the Final
EIR for this Project, including adoption of associated CEQA Findings, Statement of Overriding
Considerations, and the Mitigation Monitoring and Reporting Program, as described in City
Council Resolution No. 2006-141. The City Council approved the Addendum to the Final EIR,
as described in City Council Resolution No. 2014-032 approved on April 8, 2014. The proposed
Development Area Plan is consistent with the analyses in the 2006 EIR and 2014 Addendum and
will not result in additional environmental effects not previously evaluated in the EIR and
Addendum. No additional environmental review is necessary.

B. Further, CEQA Guidelines section 15162 provides that “no subsequent EIR shall
be prepared” for a project unless the lead agency determines that (1) “substantial changes are
proposed in the project which will require major revisions of the previous EIR”; or (2) “substantial
changes occur with respect to the circumstances under which the project is undertaken”; or (3)
“new information of substantial importance … shows” one or more significant effects not
discussed in the original EIR, greater severity to previously-identified substantial effects, or newly-
found feasible mitigation measures that would substantially reduce significant effects. The
proposed Temporary Conditional Use Permit will not result in any changes to the proposed project
not previously analyzed in the 2006 EIR and 2014 Addendum and no new information of
substantial importance shows any significant effects or newly found feasible mitigation measures
that would substantially reduce significant effects.
Section 3. Findings for Approval of Temporary Conditional Use Permit. The Planning
Commission in approving amendments to the Temporary Conditional Use Permit for the model
home complex signage for Vast Oak North Phase 3B – Willow at University District hereby makes
the following findings:
A. That the proposed location of the Temporary Conditional Use is consistent with the
objectives of the Zoning Ordinance and the purposes of the district in which the site is
located;
A model home complex is an appropriate use within the University District Specific Plan,
residential districts and signage is a necessary component of any model home complex. A
modest amount of signage is appropriate in a residential area when a public purpose is
served by providing wayfinding assistance. In the case of a model home complex, it is
important that the visiting public can clear identify the location of a model home
complex.
B. That the proposed location of the Temporary Conditional Use and the conditions under
which it would be operated or maintained will not be detrimental to the public health,
safety or welfare, or materially injurious to properties or improvements in the vicinity,
and that the operation and maintenance of the Conditional Use will be compatible with
the surrounding uses.
Public access on the site will be limited to the model home complex. Construction
operations will be separated from the sales facilities creating a safe environment. The
signage as proposed will assist the public in safely navigating to the model home
complex without interacting with construction activities. The proposed signs are designed
to be architecturally compatible with the model home complex and with other signs in
University District.
C. The proposed Temporary Conditional Use will comply with each of the applicable
provisions of this title.
The model homes, streetscape and landscaping proposed are consistent with the
Development Area Plan for the VON Phase 3B-Willow at University District approved
by the C ity C ouncil. Tem pora ry fa cilities such as the m odel hom es, parking, A D A
com pliance, fe ncin g and restro om s com ply w ith all applicable requirem ents. The
pro posed signage is perm itted by the m unicipal code as part of a tem pora ry m odel hom e
com plex.
Section 4. B ased on the fi ndings set fo rt h in this R esolution and the evidence in the
staff report, and the abov e-refe renced Findings, Staff recom m ends that the Planning C om m ission
hereby am end a T em pora ry C onditional U se Perm it fo r a m odel hom e com plex to all ow fo r the
in stall ation of tem pora ry signage on L ot N os. 77, 78, 79, 80, 81 and 82 at U niversity D istrict V ast
O ak N ort h P hase 3B in the area south of O 'R yan R oad, nort h of H inebaugh C reek and east of
N orth K err y R oad in the V ast O ak N orth Phase 3B - W ill ow at U niversity D istrict subdivision, to
all ow fo r m odel hom e signage, as set fo rt h at Exhibit 1, in its entirety , and subject to the
reco m m ended signage specifi c condition s of appro val as pro vided in Exhibit 2.

TEMPORARY MODEL HOME AND SALES OFFICE COMPLEX
SIGNAGE SPECIFIC
1) In addition to the conditions below, the model home complex shall comply with all
condition of approval adopted by Resolution 2021-18.
2) Prior to the installation of any signs, the applicant shall submit and receive approval of a
Sign Review application from the Planning Division and apply for the necessary building
permits.
3) The signs shall conform to Exhibit A attached hereto.
4) Every sign and all parts, portions and materials must be maintained in good repair. The
display surface of all signs must be kept clean, neatly painted, and free from rust,
cracking, peeling, corrosion or other states of disrepair. This maintenance obligation
includes the replacement of broken faces, repainting of rust, chipped or peeling structures
or faces within fifteen days following written notification by the city. When there is a
change or discontinuance of a business or occupancy such that a sign no longer represents
a place of business or occupancy, the sign must be removed or the name of the prior
business or occupant either removed, or the sign face covered in a manner that blends
with the building or supporting structure.
5) Prior to the date of expiration of the TCUP the model home complex shall cease
operation and the temporary features associated with the model home complex, including
the signage shall be removed.
