A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
AUTHORIZING THE ASSISTANT CITY MANAGER TO CREATE A CAPITAL
IMPROVEMENT PROGRAM (CIP) PROJECT FOR THE ANIMAL SHELTER
SWAMP COOLER REPLACEMENT PROJECT AND PERFORM BUDGET
AMENDMENTS TO EXISTING CIP PROJECT WITH INFRASTRUCTURE RESERVE
FUNDS
WHEREAS, on November 23, 2021, the City Council approved a 2-year Capital
Improvement Program budget for Fiscal Year(FY) 21-22 and FY 22-23; and
WHEREAS, the City's Infrastructure Reserve Fund budget, which is used to fund
projects approved in the Capital Improvement Program, has been adopted in the Fiscal Year
2022-2023 Annual Budget; and
WHEREAS, at the Animal Shelter, the current cooling system for part of the shelter has
failed and needs to be replaced; and
WHEREAS,there is no identified project or funding in the current CIP to replace the
Animal Shelter swamp cooler; and
WHEREAS, the Southwest Boulevard Complete Streets Project No. 2020-23 is the
transformation of approximately 1,900 linear feet of Southwest Boulevard, between the
roundabout and Adrian Drive; and
WHEREAS, there is currently $3,169,000 budgeted for the Southwest Boulevard
Complete Streets Project in its entirety; and
WHEREAS, staff hired a consultant to perform a building assessment of City facilities in
order for Public Works to program out long-term repair and replacement of identified
deficiencies; and
WHEREAS,the intent of the Implementation Project is to use the Building Condition
Assessment recommendations and provide funding for top priority repair.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert
Park that it does hereby authorize and approve the following:
Section 1. The above recitals are true and correct and material to this Resolution.
Section 2. In making its findings the City Council relied upon and hereby incorporates by
reference all of the correspondence, staff reports and all other related materials.
Section 3. The Project is categorically exempt from the requirements of the California
Environmental Quality Act ("CEQA") pursuant CEQA Guidelines sections 15301 (Existing
Facilities) and 15302 (Replacement or Reconstruction). (14 Cal. Code Regis. §§ 15301, 15302).
Section 4. The Assistant City Manager is authorized to create a new CIP Project for the
Animal Shelter Swamp Cooler Replacement Project.
Section 5. The Assistant City Manager is authorized to appropriate Infrastructure Funds
(Fund 29901399) to the Animal Shelter Swamp Cooler Replacement Project in the amount of
$200,000.
Section 6. The Assistant City Manager is authorized to appropriate Infrastructure Funds
(Fund 29901399) to the Southwest Boulevard Complete Streets Project No. 2020-23 in the
amount of$1,050,000.
Section 7. The Assistant City Manager is authorized to appropriate Infrastructure Funds
(Fund 29901399) to the Building Condition Assessment Implementation Project in the amount of
$250,000.
Section 8. This Resolution shall become effective immediately.
Section 9. All portions of this Resolution are severable. Should any individual
component of this Resolution be adjudged to be invalid and unenforceable by a body of
competent jurisdiction, then the remaining Resolution portions shall continue in full force and
effect, except as to those Resolution portions that have been adjudged invalid. The City Council
of the City of Rohnert Park hereby declares that it would have adopted this Resolution and each
section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that
one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or
unconstitutional.
