1969/06/18 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES June 18, 1969 The Council of the City of Rohnert Perk met this date in regular session commencing at 7010 p.m. in the City Offices, 435 Southwest Boulevard, Rohnert Park, with Mayor Rogers presiding. The regular meeting was preceded by a brief executive session to discuss possible appointments to the Cultural Arts Commission and the Recreation Commission. Call to Order Mayor Rogers called the meeting of the regular session to order at approximately 7010 p.m. Roll Call Present: (5) Councilmen Buchanan, Hopkins, Roberts, Smith and Rogers Staff Presents. City Manager Callinan, City Attorney Maxwell, Consulting Engineer Hudi.s, Assistant to the City Manager Albright Approval of Minutes Upon motion by Councilman Roberts, seconded by Councilman Smith, and - unanimously approved, the minutes of June 2,1969 were approved as submitted. Approval of Bills Upon motion by Councilman Smith, seconded by Councilman Buchanan, and unanimously approved, the bills presented for approval were approved. Communications Communications were brought to the attention of the Council. No action was taken on any communication except as speeifi- cally noted in these minutes. FHA letter re Golis' At Councilman Smith's request City Manager Callinan read Golf Lakes Estates the communication from the Federal Housing Administration regarding Mr. Golis'complaint relative to FAA financing for Golf Lake Estates. Recreation Commission Mayor Rogers advised that appointments to the Cultural Arts Commission and the Recreation Commission were discussed in Executive Session prior to this regular meeting. No appointments to the Cultural: Arts Commission were made at this time. Upon motion by Councilman Buchanan, seconded by Councilman Roberts and unanimously approved, the existing Recreation Commission was reappointed for 1969 -1970. Ordinance No. 122 AN ORDINANCE AMENDING ORDINANCE N0. 47 (Mobile Homes In- eluded as Dwelling Units) City Manager Callinan reviewed the ordinance. Upon motion by Councilman Buchanan, seconded by Councilman Roberts, and unanimously approved by roll call vote, Ordin- ance No. 122 was adopted. June .16, 1969 Page _2_ Ordinance No. 121 PROHIBITING TEES ENTRT OF HORSES, COWS, MMap AND OTHER HOOPED ANIMALS UPON ANY PUBLIC STREET, PARK OR PUBLIC PLACE City Manager Callinan advised that recommendations for changes in the proposed ordinance had been received from certain horse owners. The Council referred the matter to the City Attorney for further consideration and recommenda- tion. Young America Homes Mr. Robert O'Neil, of Young America Homes was present and briefly outlined and displayed development plans for single and multi- family homes in the El Colegio Area adjacent to Southwest Boulevard. Mr. Bob Hayes of Hayes, Smith, Trocket & Blair Architects & Planners, San Francisco explained briefly the concept of the schematic plaza submitted. Coun - oilman Smith indicated he would encourage development of the type proposed which involves new concepts. Mayor Rogers scheduled a meeting for 8;00 p.m., Monday, June 23, 1969 in the City Council Chambers to discuss in greater detail the development plan of Young America Homes. RESOLUTION NO. 69 -58 A RESOLUTION DIRECTING MAKING OF AML'MD ASSESSMENT RE CERTAIN ASSESSMENTS UNM RESOLUTION OF INTENTION NO. 7 Project No. 1956.1, Assessment Nos. 6.52.1.2 and 6.81.2 Mayor Rogers declared a conflict'of interest in this resolu- tion and abstained from discussion or voting on this matter. The chairing of the meeting was turned over to Vice Mayor Smith. City Manager Callinan explained the resolution. Upon motion by Councilman Roberts, seconded by Councilman Buchanan, and unanimously approved, with Mayor Rogers ab- staining,, Resolution No. 69 -58 was adopted. The chairing of the meeting was returned to Mayor Rogers. RESOLUTION NO. 69 -59 A RESOLUTION REDUCING CERTAIN ASSESSMENTS ® Coddingland Unit o Aeseesmenti District iy68 -7 RESOLUTION No. 69-6 City-Manager Callinan reviewed the above resolution. 'Upon motion by Councilman Buchanan, seconded by Councilman Smith, and unanimously approved, Resolution No. 69 °59 �s adopted. t , . 0 RESOLUTION ISTERMI.NING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS -m Coddingland Unit 1 Assessment District 1968 -1 City Manager Callinan, reviewed the'above resolution. Upon motion by Councilman Smith, seconded by Councilman Buchanan, and unanimously approved, Resolution No. 69 -60 was adopted. June 16, 1969 Page -3- Project 1968 -1 - Consulting Engineer Hudis gave a brief status report on the Coddingland area construction of the frontage road in the Coddingland area, Frontage Road and advised that the frontage road should be completed by the end of July. City Manager Callinan advised that the bonds for the project had been delivered this date. Relocation of Utilities City Manager Callinan reviewed previous discussions held at Preeway:Expressway regarding the relocation of existing overhead utilties on the westerly frontage road for the US 101 Expressway interchange. A lengthy discussion followed. Councilman Smith asked if wood poles were used in the free - way interchange and a developer wanted to develop and had to go underground how would P.G. &E. handle the matter? Would P.G. &E. abandon the wood poles and take them down? Mr. Hack Boyette of P.G. &E. was present and advised that if a developer applied for service to one plant then ser- vice to the developer would have to be streamlined or under - grounded at the developers expense, that Rule 20 funds could be used to underground the main feeder circuit. He further advised that the average voltage in the area is 12,000 voltage and that Secondary voltage depends on the customer. Mr. Boyette also advised if the existing utilities were re- located overhead to wood poles along the freeway that should the City desire at a later date to use Rule 20 funds to remove the primary and secondary lines and place them underground,, that his company would take the position that the undergrounding would meet the criteria for the use of Rule 20 Funds. Councilman Hopkins advised that after attending a meeting held this date with P.G. & E. representatives, Mayor Rogers, and the Sonoma County Road Commissioner, that he felt that there would be no reason for undergrounding the utilities at this time. City Manager Callinan advised that the relocation of utilities to wood poles would take much less time than to relocate to metal poles or go underground. Mr. Hack Boyette advised that for this relocation project, assuming relocation overhead on wood poles, that P.G.&E. would pay 1/2 the cost of relocation, and normally the State of California would pay the other 1/2 the cost, how-. ever in this interchange project 1/2 of the cost to be paid by the State of California will have to be borne by the County of Scmoma or the City of Rohnert Park. Mr. Callinan pointed out that the County of Sonoma was going to pay the cost referred to by Mr. Boyette. Mr. Paul Golis was recognized and asked why Rule 20 money is being spent in this area and not being spent in the existing developed area of Rohnert Park. The Council June 16, 1969 page -4- replied that no Rule 20 funds are being used, but Rule 20 funds may be used at a later date. law. Hugh Codding, was present and advised that the sugges- tion to use Rule 20 money was initiated by the developers and not by the City of Ronne -rt Park. Mr. Codding stated that if there is any criticism of the use of Rule 20 money that it should be directed toward him, not the City of Rohnert'Park. Re also advised that if the utilities went underground he would dedicate the easement for the right of way to P.G. 80. at no cost. Mr. Codding thanked the Council and staff for going to so much trouble in looking into the matter of using Rule 20 money, and asked that the matter be left open so that at a later date the utilities could be put underground. Upon motion by Councilman Hopkins, seconded by Councilman Buchanan, and unanimously approved, the Council agreed to the relocating of the existing overhead utilities on the westerly frontage road to the edge of the freeway right of way on the west side of U.S. 101'in the Coddingland area as per the sketch and letter submitted by the Division of High - ways dated February 5, 1969. Councilman Smith asked that the record show that he is keep- ing an open mind to the use of Rule 20 money in this area, and in any other area of the City that it can be used; that this would be one place that can be An.ven nnria; da-A_ tion of using Rule 20 money, Engineer's Report on City Manager Callinan asked that the Council review the Per.Acre Assessment Report on Per Acre .Assessment For Development Program and Capital Projects to be Financed Therefrom, prepared by Mr.-Hudis and if there were any questions Engineer Hudis would be happy to answer them. The City Manager also ad- vised that this report would be used to finalize the agree - ment for Annexation No. 6; the lands south of East Cotati .Avenue. Men's Golf Club City Manager Callinan advised that correspondence had been Special Rates received from the Rnhnp,»t ParIr P O P n9„', _ special rates for green fees during their tournament. Upon motion by Councilman Hopkins, seconded by Councilman Buchanan, and unanimously approved, a special green fee rate of $3.50 for the Fourth Annual Sonoma County Men's Amateur Golf Championship tournament was granted the Rohnert Park Golf Club.' Mr. Paul Golis & Mr. Paul Golis and Mrs. Lorrain Curley were recognized and M;rs. Lorraine Curley objected to what they felt was 'a, hurry -up adoption of Or- re Ordinance No. 122 dinance No. 122; that the ordinance was adopted before the time indicated on the agenda. The Council expressed disagreement with Mr. Golis 'and 'Mrs. Curley's feelings. Councilman Smith pointed out that quite a bit of time was June 169 1969 Page -5- taken in the early part of the meeting reading the communi- cations from F.H.A. At Mrs. Curley's request City Manager Callinan read Ordinance No. 122. Mrs. Curley started to comment and stated the new apartments on Doris Court did not pay the recreation fees and that it should be properly applicable to apartments rather than mobile home parks. The Council corrected this misunderstanding, advising that all apart- ment buildings also pay the recreation fee. City Manager Callinan and City Attorney Maxwell pointed out that Ordinance No. 122 doesn't really change anything, it simply spells out in clear language how Ordinance No. 47 will be applicable to mobile home parks. Golf Course Dedica- The City Manager advised that the dedication of the golf tion course had been scheduled for July, and requested sugges- tions from the Council relative to the dedication. Sale of Surplus The City Manager reported that the City had a few items Equipment of obsolete equipment that would be disposed of by bid with a minimum price if the Council had no objections. The Council consented. Councilman Smith recommended that a system be established that annually the Council be given an accounting of obso- lete materials and equipment, and an estimate of need to dispose of obsolete equipment.' During a discussion that followed$, City Attorney Maxwell suggested that a purchasing ordinance be prepared for the City, and the Council agreed. Meeting with Merchants City Manager Callinan gave a brief report on a recent meeting with merchants of the shopping center in an effort to clean up the shopping center area. Animal Control As per the Council's request, City Manager Callinan report- ed that there had been 355 animals impounded during the past twelve months. Trees on Expressway The City Manager reported that after reviewing the sugges- tions of Superintendent of Public Works Wiggins, County Recreation and Parks Director Rodato and the Sonoma State College landscape architect, an effort will be made to have the County plant redwood trees on the southside of the Expressway between the Snyder Lane to Petaluma Hill Road if the Council so approves. The Council endorsed the suggestion. NSF Institute City Manager Callinan advised that a correspondence had been received from Sonoma State College again requesting a reduction in pool rates for their NSF institute held for biology teachers and their families. June 16, 1969 Page r6- Upon motion by Councilman Buchanan, seconded by Councilman Smithy and unanimously approved, the Council approved a 50% reduction in pool rates to participants in the NSF Summer Institute in Biolomy and Ecology and their families. Avram Avenue & City Manager Callinan reported that petitions for the Santa Alicia Drive v r.. con- struction of Avram Avenue and Santa Alicia Drive had been received and referred to Engineer Rudis for checking and inititation of assessment distract proceedings. Community & Recrea - Architect Lawrence Simons presented the Council with a tion Center statement for final payment in the amount of $12,563.63 to James Construction for the 10% retention fee withheld until the 35 days following the filing of the Notice of Completion. Councilman Smith questioned the reasons for having to re-- place the track for the stage drapes. Architect Simons explained that it was an error on his part due to ordering the drapes prior to ordering the track. Upon motion by Councilman Buchanan, seconded by'Councilman Roberts, and unanimously approved, final payment to James Construction in the amount of $12,563.63 representing 10f retention fee for construction of the Community & Recreation Center was approved. Councilman Smith commended Mr. Simons for his work on the ..vu-Iffunity m Recreation venter. Davi Operation File 0060 At Councilman Hopkins' request City Manager Callinan report- ed that some improvements had been started on the Davi Property on Commerce Boulevard, and that the matter would be investigated more thoroughly before the next City Council meeting. TV Interference Mrs. Lorraine Curley reported to the (buncil that the resi- dents of Casa Dorado were receiving the Rohnert Park Police Department radio broadcasts over their televisions sets, and asked if the Council could have something done about this problem. The City Manager advised that the matter 7 - -, -N . -- lltt U.e.reaay peen brought to hls attention by Mrs. Curley and that he, the Chief of Police and representatives of P.G. & E. would try to determine the cause of the inter- ference. Mr. Ralph Pitch, P.G. & E. representative was recognized and advised that the problem had been referred to P.G. &E's technical staff. City Attorney's Re- City Attorney Maxwell gave an up to date verbal report on pOrt the Expressway Interchange right of way lawsuit,- the by- laws for the non-profit corporation of the Cultural Arts Commission which have been sent to the Cultural Arts Commission for their approval; the Siri lawsuit relative to the Expressway project °, and reported that a reply should be received from the Public Utilities Commission June 169 1969 Page --7- regarding the petition for rehearing on the Southwest Boulevard Grade Crossing. Visiting Dignitary Mayor Rogers introduced Mr. Frank Corcoran a local resi- dent who ran for Coroner during the last County election. Horse Complaint Mrs. Garrison of 441 Alta was recognized by the Council and expressed her feelings regarding the nuisance of horses in her neighborhood. She reported that she spoke for approximately six of her neighbors and that she would like to complain about the horses being kept in the neighborhood for long periods of time. She did not object to horses being brought to the homes,, but felt that they should not stay at the residence for long period of time.
