2023/05/23 City Council Resolution 2023-039 RESOLUTION NO. 2023-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK TO RESCIND THE DECLARATION OF WATER SHORTAGE EMERGENCY AND RESCIND STAGE 2 CONSERVATION MEASURES UPON EXPIRATION OF STATE WATER BOARD EMERGENCY REGULATION IN 23 CCR SECTION 996 WHEREAS; on April 21, 2021, Governor Gavin Newsom declared a local drought emergency for Sonoma and Mendocino counties; and WHEREAS, On May 11, 2021, the City adopted Resolution No. 2021-053 declaring a water shortage emergency; and WHEREAS, On March 28, 22, Governor Newsom issued Executive Order N-7-22, ordering the State Water Board to consider adopting emergency regulations including a requirement that each urban water supplier that has submitted a water shortage contingency plan to the Department of Water Resources implement, at minimum, the shortage response actions adopted under section 10632 of the Water Code for a shortage level of up to twenty percent (level two) which was adopted by the State Water Board per Resolution 2022-018; and WHEREAS, on July 26, 2022, the City adopted Resolution No. 2022-086 rescinding Resolution No. 2021-053, declaring a water shortage emergency, and implementing Stage 2 of the City's adopted Water Shortage Contingency Plan per the State Water Board's requirements; and WHEREAS beginning December 26, 2022, the region received substantial rainfall via a series of atmospheric rivers lasting through the month of January, ultimately shifting the water supply outlook for the upcoming year; and WHEREAS, at the February 6, 2023, Water Advisory Committee, Sonoma Water staff announced they are operating their reservoirs (Lake Mendocino and Lake Sonoma) are above or nearing full capacity and are expecting no water shortage conditions for their contractors this year; and WHEREAS, based on this information and the fact that Sonoma Water has more than adequate supply for the upcoming water year, there is no need for the City to continue implementing mandatory 20%reductions in water use to protect water supplies; and WHEREAS, Although the State Water Board 2022-018 has not been rescinded, staff recommends that the City Council adopt a resolution rescinding the City's water shortage emergency and the water emergency declaration when the State Water Board rescinds resolution 2022-018; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the following: 1) Rescind City Council resolution 2022-086, Stage 2 of the City's Water Shortage Contingency Plan simultaneously when the State Water Board rescinds their resolution 2022-018; and 2) End the water shortage emergency declaration that was part of City Council resolution 2022-086. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute documents pertaining to same for and on behalf of the City of Rohnert Park.
