2023/06/13 City Council Resolution 2023-044 RESOLUTION NO. 2023-044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING THE SOUTHWEST BOULEVARD COMPLETE STREETS PROJECT (PROJECT), FINDING THE PROJECT EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO THE CEQA GUIDELINES SECTIONS 15301, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE A CEQA EXEMPTION, RIGHT OF WAY CERTIFICATION AND RELATED DOCUMENTS THAT MAY BE NECESSARY FOR THE CALIFORNIA TRANSPORTATION COMMISISON (CTC) TO PROVIDE SUBSTITUTE STATE FUNDING FOR THE PROJECT, AND AUTHORIZING THE CITY ENGINEER TO APPROVE THE PLANS AND SPECIFICATIONS FOR THE PROJECT WHEREAS, The Southwest Boulevard Complete Streets Project(Project 2020-23) is a transformative project along Southwest Boulevard between the roundabout currently in construction at Commerce Boulevard to the east of Adrian Drive; and WHEREAS,the City of Rohnert Park (City) was awarded COVID Relief and Recovery Supplemental Appropriations Act(CRRSAA) last year through the California Department of Transportation through a grant; and WHEREAS,due to the recent crisis over the federal debt ceiling,the grant funding was swapped from federal funding to state funding during an emergency meeting of the California Transportation Commission (CTC) on Friday, June 2, 2023; and WHEREAS,the CTC is requiring the City to request obligation of the state funding as soon as possible, which requires formal approval of the project by the City Council, a Right of Way Certification, and signed plans and specifications for the project; and WHEREAS,the project plans and specifications were designed by BKF Engineers and reviewed and approved by staff; and WHEREAS, staff has determined that this project is fully in right of way owned by the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the following: 1. The City Council approves the Project, and determines that the Project is categorically exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant CEQA Guidelines section 15301 (Existing Facilities) (14 Cal. Code Regis. §§ 15301), and directs staff to file a notice of exemption with the Sonoma County Clerk - Recorder. 2. The City Engineer is specifically delegated discretionary authority to approve the design of the project, and approve the plans and specifications for the project. 3. The Public Works Director is authorized to sign all grant-related documents to facilitate obtaining and obligating funding from the California Transportation Commission for the Project, including the execution of any Right of Way certifications and other documents as may be necessary for the Project. 4. This Resolution shall become effective immediately. 5. All portions of this Resolution are severable. Should any individual component of this Resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining Resolution portions shall continue in full force and effect, except as to those Resolution portions that have been adjudged invalid. The City Council of the City of Rohnert Park hereby declares that it would have adopted this Resolution and each section, subsection, clause, sentence, phrase, and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase, or other portion may be held invalid or unconstitutional.
