CITY COUNCIL/RPFA/SUCCESSOR AGENCY TO THE CDC JOINT REGULAR MEETING - CALL TO ORDER/ROLL CALL Mayor Rodriguez called the joint regular meeting to order at 5:00 p.m., which was legally noticed on June 9, 2023. All Council Present: Samantha Rodriguez, Mayor Susan Hollingsworth Adams, Vice Mayor Jackie Elward, Councilmember Gerard Giudice, Councilmember Emily Sanborn, Councilmember Staff present: City Manager Piedra, Assistant City Manager Schwartz, City Attorney Kenyon, Public Safety Director Mattos, Human Resources Director Cannon, Director of Development Services Pawson, Director of Community Services Bagley, Director of Public Works Garrett, Deputy Chief Johnson, Information Technology Technician Azevedo, and City Clerk Lopez Cuevas. 2. PLEDGE OF ALLEGIANCE Led by Vice Mayor Hollingsworth Adams. 3. PRESENTATIONS None. 4. DEPARTMENT HEAD BRIEFING 4.A. Informational Report from Public Safety Director Mattos Regarding Unruly Gatherings and Loud Parties and False Alarms. Chief Mattos presented statistics regarding unruly gatherings, loud parties, and false alarms reports in the City, including procedures used to respond to calls for service and issue citations. 5. PUBLIC COMMENTS Bill Petre and Brooke Davis thanked the Council and Public Safety Staff, Director of Public Works, and Director of Community Services, for their support of the pickleball club during their recent tournament. CONSENT CALENDAR 6.A Acceptance of Reports from Finance Department: City Bills/Demands for Payment dated May 18 through June 5, 2023 6.B Approval of Minutes for City Council/RPFA/Successor Agency Joint Regular Meeting, 6.0 Adopt Resolution 2023-042 Adopting an Appropriations (Gann) Limit for the City of Rohnert Park for Fiscal Year 2023-24 pursuant to Article XIII B of the California Constitution 6.D Adopt Resolution 2023-043 Accepting the Hinebaugh Creek Pedestrian Bridge as Complete and Directing Related Actions (CEQA: Consistent with Environmental Impact Report for the University District as Amended) 6.E Authorize the City Manager to Extend the Non-Exclusive Temporary Construction and Demolition Debris Collection Service Agreements dated November 14, 2017, with 1) Recology Sonoma Marin, 2) M & M Services, Inc. dba Pacific Sanitation, and 3)N Leasing Company, LLC. dba Republic Services, for a period of three years to Expire on December 31, 2027 6.F Adopt Resolution 2023-044 Approving the Southwest Blvd Complete Streets Project (Project), Finding the Project Exempt from the California Environmental Quality Act (CEQA) Pursuant to CEQA Guidelines Sections 15301, Authorizing the Director of Public Works to File a CEQA Exemption, Right of Way Certification and Related Documents that May be Necessary for the California Transportation Commission (CTC) to Provide Substitute State Funding for the Project, and Authorizing the City Engineer to Approve the Plans and Specifications for the Project ACTION: Moved/seconded (Giudice/Elward) to approve the consent calendar. Motion carried by the following unanimous 5-0-0 voice vote: AYES: Elward, Giudice, Sanborn, Hollingsworth Adams, and Rodriguez, NOES: None, ABSENT: None, ABSTAINS: None. 7. REGULAR ITEMS: A. Community Discussion and Direction on Amending the City Council Agenda and Format Process to Include a Miwok and Southern Pomo Land Acknowledgment. City Clerk Lopez Cuevas presented this item. Recommended Action(s): Council to discuss the following: 1) Should the City Council and City's subsidiary bodies such as the City Council standing committees, City Council ad hoc committees, and City boards, commissions, and committees, as well as the Financing Authority, Successor Agency to the Community Development Commission and Foundation Board agendas include a land acknowledgment; 2) should the land be recited at its meeting or should the agendas include a written excerpt; and, 3) Should this practice be at the discretion of each Mayor. PUBLIC COMMENTS: None. ACTION: By consensus (none opposed), Council directed staff to write in the proposed land acknowledgment into all City Council and all its subsidiary bodies' agendas. Each Mayor and Chair shall ensure the City of Rohnert Park Joint Regular Meeting Minutes for City Council June 13,2023 RPFA/CDC Successor Agency Page 3 of 5 land acknowledgment is recited at each meeting immediately after roll call and prior to the Pledge of Alliance. B. Discuss and Provide Direction on or Adopt a Resolution Amending the City Council Protocols (the Established Procedural Rules for the Conduct of City Council Meetings and Council Business). City Clerk Lopez Cuevas presented this item. Recommended Action(s): Adopt Resolution 2023-045 Amending the City Council Protocols (Council Policy Number 1.02.001). PUBLIC COMMENTS: Steve Keith spoke about this item. ACTION: By consensus (none opposed), Council directed staff to bring back the proposed amendments and resolution for adoption at future City Council meeting. ACTION: By Majority, (Elward, Giudice, Sanborn, Rodriguez) Council directed staff to keep the second public comment period. ACTION: By consensus (none opposed), Council directed staff to reduce Other Agencies/Entities/Organizations presentations to five minutes each unless a longer presentation is approved by the City Manager or Mayor. ACTION: By Majority, (Elward, Adams, Rodriguez) Council directed staff to modify Section VIII.2 to read "Liaisons are obligated to keep Council well informed on activities pertaining to Rohnert Park via the Council Committee and Other Reports at Council meetings. It is encouraged that these presentations will be no longer than three minutes each." ACTION: By Majority, (Elward, Adams, Sanborn, Rodriguez) staff and consultants are allowed to participate remotely at city council meetings. C. Consider Adopting a Resolution to Update City of Rohnert Park Personnel Rules and Regulations for Compliance with Current Federal and State Laws. Human Resources Director Cannon presented this item. Recommended Action(s): Adopt Resolution 2023-046 Authorizing and Approving Updates to the City Manager Administrative Policy Number 1 "Personnel Rules and Regulations." PUBLIC COMMENTS: None. ACTION: Moved/seconded (Giudice/Rodriguez) to adopt Resolution 2023-046 with the following administrative change to Personnel Rules and Regulations Section 3.D.1. "Leave under this section may be intermittent but must be taken within three months of date of death, unless otherwise approved by the Personnel Officer." By Minute Order, Consider Authorizing the City Manager to Execute Side Letter Agreement with Recology Sonoma Marin to Partially Defer Rate Increase Under Franchise Agreement, Lowering Rate Adjustment for July 1, 2023, from 8.27% to 6.77%. Director of Public Works Garrett presented this item. Recommended Action(s): By minute order, authorize the City Manager to Approve the rate request increase of 6.77% starting July 2023 and authorize the City Manager to sign the side letter to execute the deferral. PUBLIC COMMENTS: None. RP Rotary Salute to our Community Awards Dinner(6/9) -All Attending Councilmember Giudice reported on this event. 9. COMMUNICATIONS Councilmember Giudice invited all to attend the annual Moonlighters free concert and free pasta night tomorrow at 5:30 p.m. at the library. Councilmember Sanborn informed that there is a groundbreaking ceremony for the Casino expansion happening on June 15 at 11 a.m. Mayor Rodriguez informed the following: • The library will celebrate its 20th anniversary at a June 17 event. • Yesterday was Women's Veterans Day and tomorrow is Flag Day. • The first biannual Juneteenth celebration in partnership with SSU is happening on Monday.
