SOP-34 CLETS Confidentiality in Radio Transmissions Police Service Division SOP-34 January 7, 2021 SUBJECT: CLETS Confidentiality in Radio Transmissions PURPOSE AND SCOPE To establish standard procedures in compliance with the requirements of the California DOJ’s CLETS Policies, Practices and Procedures (PPP) and the FBI’s Criminal Justice Information Services (CJIS) Security Policy regarding ensuring the confidentiality of Criminal Justice Information (CJI) and Personal Identifiable Information (PII) during radio transmissions. The current RPDPS radio technology does not have the ability to encrypt radio transmissions; therefore, compliance will be achieved through policy, as described in Lexipol Policy 806. PROCEDURE I. Transmission Guidelines A. When the immediate safety of officers, other department members, or the public is at risk, enough summary information may be broadcast as necessary to aid in identifying or locating the suspect. B. Without an immediate safety need, the MDC or department-issued cell phone should be utilized when practicable to communicate protected information. C. Without an immediate safety need, and when neither MDC or cell phone are available or practicable, elements of protected information should be broken up into multiple radio transmissions, to separate an individual’s last name and DL/ID number from their first name, first initial, or other information such as DOB, home address, and physical descriptors. Officers who need to transmit multiple data elements should un- key the microphone between the elements, then rekey and continue without waiting for a response from Dispatch. II.
