8.1 PUBLIC HEARING – EXTENSION OF THE SITE PLAN AND ARCHITECTURAL
REVIEW – File No. PLTX23-0001 – Roy Cabrera (El Roy’s Express Mex, Inc.) –
Consideration of Resolution No. 2024-01 approving the extension of a Site Plan and
Architectural Review for the exterior remodel of an existing restaurant building to allow for the
new El Roy’s Restaurant located at 6620 Commerce Boulevard (APN 143-061-064).
Assistant Planner, Suzie Azevedo provided a PowerPoint presentation on the Extension of the
site plan and architectural review and stated that this application renewal filed on November 20,
2023, had no changes to the approved plans as noted above. Ms. Azevedo outlined the following
in the PowerPoint:
• Project location;
• Project description;
• Elevation illustrations;
• Explanation of SPAR Extension;
o The project was originally approved on 12/8/22;
o Application for renewal filed 11/20/23;
o Conditions are outlined in Resolution 2022-15;
o No changes to approved plans or surrounding area;
o The project is consistent with the City of Rohnert Park Central Rohnert Park
Development Area Plan.
Ms. Azevedo recommended the Commissioners consider approving Resolution
2024-01, for a one-year extension of the Site Plan and Architectural Review for El Roy's Express
Mex. Inc. at 6620 Commerce Boulevard. She confirmed to Commissioner Orloff that there have
been no modifications to the previous plans.
Ms. Azevedo acknowledged and welcomed the applicant, Roy Cabrera to the podium for
questions and comments. The applicant explained that the reason for the extension was purely
financial and they would resume the renovations of the property at 6620 Commerce Boulevard
by May 2024.
Planning Commissioners relayed their question to the representatives of El Roy’s Express Mex.
There were no Public Comments received.
All Commissioners agreed to approve the SPAR with no conditions added.
ACTION: Moved/Seconded (Striplen/Austin-Dillion) to adopt Resolution No. 2024-01, One
year extension of the Site Plan and Architectural Review for the exterior remodel of an existing
restaurant building to allow for the new El Roy’s Restaurant located at 6620 Commerce

9. ITEMS FROM THE PLANNING COMMISSION
Commissioners were invited to attend the 2024 Sonoma State University Planning Conference
scheduled for February 3, 2024.
Chairperson Epstein informed staff and the commission that he would not be available from January 31
to February 11, 2024, and therefore, would not attend the Planning Commission meeting scheduled for
February 8, 2024.
10. ITEMS FROM THE DEVELOPMENT SERVICES STAFF
Ms. Azevedo shared the following information on behalf of Director Alicia Giudice:
• The deadline for Downtown RFQ has passed.
• The scheduled agenda for the PC meeting on 3/14/24 will be the annual State Housing Report.
• Development Services is actively recruiting for a Building Official
• The PC meeting for 2/8/24 will address a CUP for a Tattoo Parlor at 131 Southwest Blvd.
• Review of parliamentary procedures for the Planning Commission will be a priority in 2024
• Informed Commissioners of new counter hours of 8:00 am – 4:30 pm Mon.-Thu.
and Fri. – 8:00 am – 12:00 noon.
Ms. Azevedo shared with the Commissioners that a thrift store will be occupying 375 Southwest Blvd,
the former location of the 49er Pet store. Commissioner Orloff expressed his desire to arrange a meeting
with the owners of the two strip malls to discuss matters concerning the Southwest corridor.

RECOMMENDED ACTION: Staff recommends that the Planning Commission adopt Resolution
No. 2024-02, approving a conditional use permit to allow a tatoo studio within the C-
N/Neighborhood Commercial zoning district, located at 131 Southwest Boulevard (APN 143-
150-052). (Figure 1: Project Location). This district is consistent with the “Neighborhood
Commercial” general plan designation.

BACKGROUND: The subject property is a .26 acre parcel located on the southside of
Southwest Bouleard between Commerce Boulevard and College View Drive. Surrounding uses
include the Southwest Plaza Shopping Center to the west, the Wags Dog Grooming Salon and
Valero Gas Station to the east and single family and multiple family residential to the north and
the south.
The 131-133 Southwest Boulevard property is currently developed with a two story, multi tenant,
commercial building (131-133 Southwest Boulevard) (Figure 2: Building Layout). A
breakdown of the 131-135 Southwest Boulevard tenant spaces is as follows:

Project Details
The applicant, Harry Tucker on behalf of Fortress Tattoo, proposes to lease a 390 square foot
tenant space for a tattoo studio located at 131 Southwest Boulevard. A conditional use permit is
required for a “tattoo studio at this location.
As per the attached floor plan and illustrative drawings, the applicant proposes no structural
changes to the space or exterior and proposes only limited interior design features that will meet
the needs of their business. (Figure 3: Floor Plan) No exterior signage or advertising of any
kind is proposed. The business proposes the use of existing parking in a shared parking
arrangement.

Appointments would be scheduled between the hours of 9:00 am to 8:00 pm, Monday through
Saturday, with only two artists/practitioners operating from the space. Clients receive one on
one consultations with artists to discuss their vision and ensure a customed experience.
The site provides a total of 36 parking spaces, which includes 9 spaces that are shared with the
business to the east, Wags Wash and Groom salon. (Figure 3: Parking). The uses previously
identified occupying 131-133 Southwest Boulevard would require a total of 42 spaces pursuant
to Section 17.16.030, Specific requirements, of the Rohnert Park Municipal Code. A reduction
of up to twenty five percent of the spaces required for a combination of uses may be allowed
where findings are made indicating that the uses share a common parking area and the demand
for parking occurs over different time periods, thereby making the full requirement unnecessary.
Staff has determined given the close proximity to residential neighborhoods (walking distance to
the site) and the 25 percent reduction outlined in 17.16.040, Parking Exemptions, that there is
ample parking for the combination of uses that currently exist and for the proposed tattoo and
fine art studio.

ANALYSIS: The property is zoned C-N, Neighborhood Commercial. This district is is intended
to accommodate businesses that provide goods and services to nearby residential neighborhoods,
generally within an area of a one-mile radius or less. Typical uses found in this district include
limited commercial offices and retail stores and service establishments that are compatible with,
and dependent upon nearby residential developments. As previously noted, there is single family
and multi family residences to the north and south of the site. The proposed tattoo establishment
is located in a multi-tenant commercial building and is compatible with existing “personal
services” businesses that occupy these tenant spaces (hair salon, microblading, lash extensions).
The tattoo studio will provide a unique and personalized experience, operating on an appoint-
ment-only basis, which will ensure an exclusive and intimate environment for clientele with little
or no impacts to the surrounding area. The appointment only model also ensures that the studio
operates in a discreet manner, with clients arriving for scheduled sessions, eliminitating the
“walk in” “hanging around” traffic that is typically associated with this type of use. The
applicant has indicated that the services provided do not generate excessive noise levels given
the focused nature of the appointments, which minimizes any potential disturbances to
neighboring businesses or residents.
Client education and aftercare is a top priority and will follow county and state standards, as
discussed below.

Strict adherence to all safety regulations through the Sonoma County Department of Health
Services will be required including, but not limited to:
• Evidence of all vaccinations and boosters required for artists;
• Evidence of completion of OSHA Bloodborne Pathogen Training;
• Proof that he or she is 18 years of age or older;
• Self-certification of, knowledge of, and commitment to meet state law and relevant local
regulations pertaining to body art safety;
• Payment of a registration fee to Sonoma County Environmental Health Services.
Conditions of approval have been included to ensure that the studio demonstrates the proper
handling and sterilization of equipment and that all personnel are trained in all procedures
necessary to ensure a clean and secure environment as outlined by the Sonoma County
Department of Health Services/Environmental Health Services and Health and Safety Code
§119300-§119328, the Safe Body Art Act, including client care and education.
Per RPMC 17.25.014 the Planning Commission shall approve or conditionally approve a
conditional use permit application if, on the basis of the application, supporting materials, and
written and oral testimony submitted at the hearing, the Planning Commission makes each of the
following findings. The findings and the basis for making each in the affirmative are found in the
attached resolution of approval:
1. That the proposed location of the conditional use is consistent with the objectives of the
zoning ordinance and the purposes of the district in which the site is located;
2. That the proposed location of the conditional use and the conditions under which it would
be operated or maintained will not be detrimental to the public health, safety, or welfare,
or materially injurious to properties or improvements in the vicinity, and that the
operation and maintenance of the conditional use will be compatible with the surrounding
uses;
3. The proposed conditional use will comply with each of the applicable provisions of this
title.
ENVIRONMENTAL DETERMINATION: The project has been analyzed for compliance with
the requirements of the California Environmental Quality Act (CEQA) and found to be
categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further
action is required pertaining to environmental review.
PUBLIC NOTIFICATION: A public hearing notice denoting the time, date and location of the
proposal’s hearing was published in the Community Voice. Property owners within 300 feet of
the project site were mailed notices, and the notice was posted pursuant to State Planning Law.
No public comments were received as of the distribution of this report.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROHNERT
PARK, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR A
TATTOO STUDIO LOCATED AT 131 SOUTHWEST BOULEVARD (APN143-150-052)
WHEREAS, the applicant, Harry Tucker, on behalf of Fortress Tattoo, has filed
Planning Application No. PLUP23-0005 for Conditional Use Permit approval to allow a tattoo
studio in the C-N, Neighborhood Commercial District located at 131 Southwest Boulevard (APN
143-050-052) in accordance with the City of Rohnert Park Municipal Code;
WHEREAS, Planning Application No. PLUP23-0005 was processed in the time and
manner prescribed by State and local law;
WHEREAS, public hearing notices were transmitted to all property owners within a 300
foot radius of the subject property and to all agencies and interested parties as required by
California State Planning Law, and a public hearing notice was published in the Community
Voice for a minimum of 10 days prior to the first public hearing;
WHEREAS, on February 8, 2024, the Planning Commission reviewed Planning
Application No. PLUP23-0005 during a scheduled public meeting at which time interested
persons had an opportunity to testify either in support or opposition to the project; and
WHEREAS, at the February 8, 2024 Planning Commission meeting, upon hearing and
considering all testimony and arguments, if any, of all persons desiring to be heard, the
Commission considered all the facts relating to Planning Application No. PLUP23-0005;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Findings. The Planning Commission, in approving Planning Application
No. PLUP23-0005 makes the following findings, to wit:
1. The proposed location of the conditional use is consistent with the objectives of the Zoning
Ordinance and the purpose of the district in which the site is located.
The proposed location is within the C-N, Neighborhood Commercial District. This district is
intended to accommodate businesses that provide goods and services to nearby residential
neighborhoods, generally within an area of a one-mile radius or less. Typical uses found in
this district include limited commercial offices and retail stores and service establishments
that are compatible with, and dependent upon nearby residential developments. The
proposed tattoo studio is located in a multi-tenant commercial building and is compatible
with existing “personal services” businesses that occupy these tenant spaces (Barber/Beauty
Shop).
2. That the proposed location of the use and the conditions under which it would be operated or
maintained will not be detrimental to the public health, safety, or welfare, or materially
injurious to properties or improvements in the vicinity and that the operation and
maintenance of the use will be compatible with the surrounding uses; and
The project will not have a negative effect on the public health, safety, or welfare or be
materially injurious to properties or improvements in the vicinity. All tattoo practitioners on
the premises shall register with the Sonoma County Department of Health Services
Department/Environmental Health Services and shall comply with all requirements of
California Health and Safety Code §119300-§119328 , the Safe Body Art Act. These
requirements are intended to protect both the practitioner and the client from transmission of
infectious diseases through the application of proper body art procedures and the control of
cross-contamination of instruments and supplies. Additionally, the appointment only model
for the establishment ensures that the studio operates in a discreet, safe manner, with little or
no impact to the surrounding area.
3. The proposed use will comply with each of the applicable provisions of this title.
The proposal does not involve any exterior modifications. The proposal would also comply
with all applicable Zoning Ordinance standards. A violation of a condition of approval or a
provision of the Rohnert Park Municipal Code may cause a conditional use permit to be
revoked or modified as set forth in Chapter 17.25 Article XIV of the Rohnert Park Municipal
Code.
Section 3. Environmental Clearance. The project is categorically exempt from the
California Environmental Quality Act, pursuant to California Code of Regulations, Title 14,
Chapter 3, Section 15301 (Class 1 – Existing facilities with no new construction and no
potentially significant impacts on the environment).
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve Planning Application No. PLUP23-0005, approving a Conditional Use Permit to allow a
tattoo studio at 131 Southwest Boulevard (APN 143-050-052), subject to the following
conditions:
1. Expiration of Approval – Pursuant to the City of Rohnert Park Municipal Code, this
approval shall expire one year from the Planning Commission approval date, unless prior
to the expiration the conditional use permit for a tattoo studio commences per this
approval, or an extension is filed and approved by the Director of Development Services.
2. The applicant shall obtain all necessary permits and clearances from the Rohnert Park
Building Department, Department of Public Safety, and the Sonoma County Department
of Health Services. Standard fire prevention codes will need to be met at time of
occupancy. On-site review of existing Accessibility accommodations will be required.
3. A copy of the approved Sonoma County Health license and a copy of the conditional use
permit conditions of approval shall be posted in a visible location for patrons to observe.
4. The applicant must comply with all requirements as outlined in the California Health and
Safety Code §119300-§119328, the Safe Body Art Act, including client education and
aftercare and practitioner registration with Environmental Health Services.
5. Hours of operation shall be limited to: 9:00 am to 8:00 pm, Monday through Saturday.
6. There shall be no on-site consumption, sale and/or possession of alcoholic beverages.
7. There shall be no on-site smoking or sale of tobacco products.
8. There shall be no loitering at or near the studio during or after the hours of operation.
9. All signs (if any) shall be subject to Sign Review prior to installation.
10. The premises shall be kept in a neat and orderly condition at all times.
11. A violation of a condition of approval or a provision of this chapter may cause a
conditional use permit to be revoked or modified as set forth in Chapter 17.25 Article
XIV of the Rohnert Park Municipal Code. A request to amend one or more of the
conditions of approval shall be treated as a new conditional use permit application.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be 10 working days from the date of
said action. No building permits shall be issued nor shall the use be initiated until the appeal
period has expired, providing there are no appeals.
