6.1 PUBLIC HEARING – TENTATIVE SUBDIVISION MAP AND DEVELOPMENT AREA
PLAN EXTENSION - File No. PLSD23-0001/PLDP20-0003 - Lisa Borba, UD LLC –
Consideration of Resolution(s) 2023-06 and 2023-07 approving an extension of a Tentative
Subdivision Map (TSM) and Development Area Plan (DAP) to allow the subdivision and
development of property located on a 34.34-acre lot south of Rohnert Park Expressway, West of the
Green Music Center and North of Copeland Creek within the University District Specific Plan (APN:
047-131-026 and -027).
Suzie Azevedo, Assistant Planner, provided a PowerPoint and highlighted the project in the
following areas: project description, location, development area plan, and extension request,
Ms. Azevedo recommended approval of Resolution(s) 2023-06 and 2023-07 approving a two (2)
year extension to allow the subdivision and development of the UD LLC parcel(s) within the
UDSP.
The Applicant, Lisa Borba was unable to attend due to a scheduling conflict with personnel.
Commissioner Orloff asked was the Applicant concerned with the two (2) year extension for the
construction of the basin and if they would have to bring in new landfill material for the project.
Suzie Azevedo stated that an e-mail was sent by the Applicant stating they foresee developing
the site in 2025 and Jeffrey Beiswenger stated that some new landfill will have to be brought in
by the Applicant.
Commissioner Epstein wanted to confirm that all the conditions are in place for the two (2) year
extension and that nothing had changed since the original approval of this project. Suzie
Azevedo confirmed that all conditions are still the same.
There was no public comment on Agenda Item 6.
The Planning Department received an e-mail from a resident asking for an improvement on the
Public Hearing Notice by including a map showing where the 300ft. radius property is located.
The Planning Department acknowledged their concern and will discuss including a map in all
Public Hearing Notices moving forward. An invitation was extended to the resident to attend the
Planning Commission meetings.
Commissioner Epstein asked if community services are considered when developing new
housing for Rohnert Park. Jeff Beiswenger stated that no Developer has come forward with plans
for commercial services with any new development.
ACTION: Moved/Seconded (Orloff/Epstein) to approve Resolution(s) 2023-06 and 2023-07

6.2 Downtown Project Update.
A presentation was conducted by Paul Carey, Senior Analyst with the City Manager’s office.
Paul Carey gave information on the present and future Design Origins also, the downtown
purpose such as design, themes, land use, retail, housing, parks, and tree health. He explained
existing entitlements, what is “Form Based Code” (downtown ingredients), and commercial
focus. He gave feedback on what the residents wanted to see downtown. Chairperson Austin-
Dillion asked who will review the designs for the downtown and wanted to know if local
businesses would be eligible to obtain space in the downtown project. Commissioner Epstein
recommended that space be allocated for social services in Rohnert Park. Adjacent city-owned
properties were discussed such as the corporation yard and retooling the maps for this public
works use. Commissioner Orloff introduced the idea of a skate park. Jeff Beiswenger stated that
Rohnert Park Director of Community Services, Cindy Bagley, was brought in to get her
perspective on the parks and open space for the downtown. There was no public comment on the
Downton Project.

Planning Manager, Jeff Beiswenger, stated that the rescission of the Downtown Area entitlements will

Agenda Title: PLSR22-0005, Site Plan and Architectural Review Amendment, Construction of
One Solar Carport within an Existing Parking Lot

RECOMMENDED ACTION: Staff recommends approval of Resolution 2023-08 for an amendment to
Site Plan and Architectural Review (SPAR) approval for the construction of one (1) photovoltaic solar
carport within the existing Taco Bell parking lot located at 5000 Redwood Drive to support six electric
vehicle chargers.
BACKGROUND: The project site is located at 5000 Redwood Drive, which is bounded to the west by
Redwood Drive, to the east by Interstate 101, and to the south by an existing “Good Nite Inn”. (Figure 1)
The parcel is currently developed with a Taco Bell fast food restaurant and associated drive-through
aisles, parking, and landscaping. A Site Plan and Architectural Review was approved in 2018 for façade
and landscaping improvements for the existing restaurant. Improvements included exterior façade
changes, interior remodel, and replacement of turf with drought-resistant landscaping.

In August of 2022, the 5000 Redwood Drive Taco Bell received Site Plan and Architectural Review
approval for the addition of two (2) PV solar carport structures. (Figure 2) During the building review
process, it was determined that by building the larger of the two solar array structures as approved, below
Pacific Gas & Electric (PG&E) power lines, the applicant is at risk of PG&E having to dismantle the
array in the future should they ever need to do significant changes to the existing power lines.

The applicant, ChargeNet Holdings Corp, has reconfigured the project to relocate the larger solar array to
the location that the smaller solar array was previously located, eliminating the smaller array altogether.

The carport will support solar photovoltaic (PV) panels, which will power the electric vehicle chargers
(EVC). The EVCs and associated energy storage system equipment will be reviewed and approved
through a separate building permit process. The construction of the carport structure is not expected to
impact the commercial space, the drive-through aisles, or the paved parking areas.
ANALYSIS: The amendment to the 2022 SPAR approval includes the elimination of one carport with
roof-mounted solar panels and the relocation of the larger approved carport to support six new electric
vehicle chargers. The relocation of the carport and solar panels is consistent with the Commercial General
Plan land use designation and C-R zoning designation of the property, and complies with the City’s
development standards including height, setbacks, parking, and landscaping.
Site Plan
As proposed, the addition of the carport will not alter access to the sidewalk, parking, or building, and no
parking spaces will be impacted by the addition. The carport will be 13’6” inches in height at the lower
elevation, and just over 15 feet at the higher elevation. The carport is 4,355 square feet and will cover two
(2) handicap parking spaces and three (3) standard parking spaces.
Landscaping
The removal of two trees is proposed. A condition of approval was added to require the applicant to
replace any trees or landscaping removed as a result of the carport installation. New landscaping shall be
installed in accordance with water conservation standards, which meet or exceed the requirements of
Model Water Efficient Landscaping Ordinance (MWELO), and with staff approval.
Colors and Materials
The carport structures are built using 10 x 3, 12-gauge steel purlins. The black, thermally pressed glass
solar panels will be held in place by anodized aluminum frames.
ENVIRONMENTAL DETERMINATION: In accordance with the California Environmental Quality
Act (CEQA), the proposed project is exempt from environmental review under Section 15303 New
Construction or Conversion of Small Structures of the CEQA Statute & Guidelines.
PUBLIC NOTIFICATION: As per Chapter 17.25 Article III of the Rohnert Park Municipal Code,
applications for site plan and architectural reviews do not require public noticing.

PLANNING COMMISSION RESOLUTION NO. 2023-08
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROHNERT PARK APPROVING AN AMENDMENT TO SITE PLAN AND
ARCHITECTURAL REVIEW APPROVAL FOR A PHOTOVOLTAIC SOLAR
CARPORT ADDITION AT TACO BELL LOCATED AT 5000 REDWOOD DRIVE
(APN 045-081-018)
WHEREAS, the applicant, Bodhi Raymond of A Tech Construction, Inc., filed a
Planning Application No. PLSR22-0005 for Site Plan and Architectural Review for the
construction of two (2) photovoltaic solar carport addition at 5000 Redwood Drive (APN 045-
081-018).
WHEREAS, Planning Applications No. PLSR22-0005 was processed in the time and
manner prescribed by State and local law;
WHEREAS, on August 11, 2022, the Planning Commission reviewed Planning
Application No. PLSR22-0005 at which time interested persons had an opportunity to testify
either in support of or opposition to the project; and
WHEREAS, at the August 11, 2022, Planning Commission meeting, upon considering
all testimony and arguments, if any, of all persons desiring to be heard, the Commission
considered all the facts relating to Planning Application No. PLSR22-0005 and approved the Site
Plan and Architectural Review with a vote of five (5) Ayes and zero (0) Noes; and
WHEREAS, on March 22, 2023, the applicant filed an application for an amendment to
the Site Plan and Architectural approval to eliminate one (1) photovoltaic solar carport and shift
the larger carport and array to the location of the eliminated smaller carport and array; and
WHEREAS, on April 27, 2023 the Planning Commission reviewed the amendment of
Planning Application No. PLSR22-0005 at which time interested persons had an opportunity to
testify either in support of or opposition to the amended project; and
WHEREAS, at the April 27, 2023, Planning Commission meeting, upon considering all
testimony and arguments, if any, of all persons desiring to be heard, the Commission considered
all the facts relating to the amendment of Planning Application No. PLSR22-0005.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Factors Considered. The Planning Commission, in approving an
amendment to Planning Application No. PLSR22-0005, makes the following factors, to wit:
A. That the developments general appearance is compatible with existing development and
enhances the surrounding neighborhood.
Criteria Satisfied. The project, as amended, proposes the addition of one PV carport to an
existing parking lot. No expansion or other exterior changes are proposed to the main
building, drive-through aisles or associated equipment, paved parking facilities, or trash

enclosure; therefore, the development would remain compatible with existing
surrounding commercial development.
B. That the development incorporates a variation from adjacent on-site and off-site
structures in height, bulk, and area; arrangement on the parcel; openings or breaks in
the façade facing the street; and/or the line and pitch of the roof.
Criteria Satisfied. The proposed project is for an accessory structure and would not
impact the exterior modifications to the existing commercial building would or alter the
height, bulk, or area of the commercial building. Therefore, this finding is not applicable.
C. That the development will be located and oriented in such a manner so as to provide
pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate,
and avoids indiscriminate location and orientation.
Criteria Satisfied. The project proposes to add one carport structure to an existing parking
lot. The additional structure follows the development standards for building orientation,
setbacks, landscape areas, and parking on the site. The exterior modification to the
existing commercial building would not alter the pedestrian, bicycle and vehicular
connections with adjacent properties. The site as currently designed is consistent with this
criteria.
Section 3. Environmental Clearance. The project has been analyzed for compliance with
the requirements of the California Environmental Quality Act (CEQA) and found to be
categorically exempt under Section 15303 New Construction or Conversion of Small Structures
No further action is required pertaining to environmental review.
NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby
approve an amendment to Planning Application No. PLSR22-0005 subject to the Applicant
Design Package attached as Exhibit A and Conditions of Approval attached as Exhibit B.
BE IT FURTHER RESOLVED that said action shall not be deemed final until the
appeal period has expired and that the appeal period shall be ten (10) working days from the date
of said action. No building permits shall be issued until the appeal period has expired, providing
there are no appeals.
DULY AND REGULARLY ADOPTED on this 27th day of April, 2023 by the City of

CONDITIONS OF APPROVAL: 5000 Redwood Drive
SITE PLAN AND ARCHITECTURAL REVIEW
The conditions below shall apply to the construction of two solar carports in the parking lot of an existing
commercial building located at 5000 Redwood Drive (PLSR22-0005).
General Conditions
1. The Site Plan and Architectural Review approval shall expire one year from the Planning
Commission approval date, unless prior to the expiration a building permit is issued and
construction is commenced and diligently pursued toward completion and the use is initiated, or an
extension is requested and approved.
2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal
Code (RPMC) and any state or federal agency. The violation of any condition listed herein shall
constitute a nuisance and a violation of the Rohnert Park Municipal Code. In conformity with
Chapter 1.16 of the RPMC, a violation of the RPMC may be an infraction or a misdemeanor and
shall be punishable as provided by law. In addition to criminal penalties, the City may seek
injunctive relief. The Applicant agrees to pay for all attorney’s fees and costs, including, but not
limited to, staff time incurred by the City in obtaining injunctive relief against the Applicant as a
result of a failure of the Applicant to fully perform and adhere to all of the Conditions of Approval.
3. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert Park, its
agents, officers, attorneys and employees from any claim, action or proceedings brought against
any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this
application or certification of the environmental document which accompanies it. This
indemnification obligation shall include but not be limited to, damages, costs, expenses, attorneys’,
or expert witness fees that may be asserted by any person or entity, including the Applicant, whether
or not there is concurrent passive or active negligence on the part of the City, its agents, officers,
attorneys or employees.
Planning Division Conditions
4. Any landscaping removed or destroyed as a result of the construction of the carports shall be
replaced at a 1:1 ratio. Any trees to be removed shall be removed in compliance with Chapter 17.15
Tree Preservation and Protection of the Rohnert Park Municipal Code.
5. Any restriping of the existing parking area shall receive approval from the Development Services
Division and shall not result in a net loss of parking spaces.
6. Bicycle parking stalls installed as part of the project shall be in compliance with the Rohnert Park
Zoning Ordinance Section 17.16.140. The C-R: Regional Commercial zoning designation requires
four (4) bicycle parking spaces to be installed for the project. Two city standard “inverted U”
bicycle racks will statisfy this requirement.
Public Safety Conditions
7. A separate permit shall be required prior to installation of the proposed electric storage equipment.
8. A twenty-foot access aisle throughout the parcel shall be maintained at all times.
9. A 20-foot-wide fire access lane shall be provided at all times. The minimum height for the carport
structures is 13 feet, six inches above paved surface. A sign demonstrating this is required in both
directions.
10. There is an existing 8” fire line loop with the site. The plans shall be revised to clearly show the
line with a note to avoid damaging the line.
