AGENDA ITEMS 6.1 PUBLIC HEARING – CONDITIONAL USE PERMIT/SITE PLAN AND ARCHITECTURAL REVIEW– File No. PLUP21-0006/PLSR21-0006 – Nancy Carreras/Interplan, LLC – Consideration of Resolution No. 2023-03 approving an Amendment to a Conditional Use Permit and Site Plan and Architectural Review for modifications to the existing drive-thru operation and addition of other site improvements for the Chick-Fil-A restaurant located at 5080 Redwood Drive (APN 045-083-002) Suzie Azevedo, Assistant Planner, provided a PowerPoint, which included a site plan showing the project location, description, and conditional use. Ms. Azevedo highlighted the project in the following areas: background, strategy, project description, canopy addition, traffic circulation, parking, and pedestrian walkways. Planning staff recommended approval of the Site Plan and Architectural Review (SPAR) and Conditional Use Permit for the exterior modifications to the drive-through operation and associated on-site improvements at 5080 Redwood Drive. The Commission participated in a discussion and offered the following comments: • Commissioner Striplen had no questions and recommended that Resolution amendments should be redlined for clarity. • Commissioner Orloff asked the following:  Does the committee have any rules regarding a restaurant drive-thru?  Any studies regarding an increase in traffic?  Will this add more exhaust fumes to the environment?  Will Krispy Kreme's drive-thru be impacted by this? • Commissioner Epstein inquired about the spillage into the parking lot due to increased OMD (Order Meal Delivery) during peak hours. Also, is there any impact on the egress and ingress of the parking lot? • Commissioner Striplen asked if collision stats were pulled for the Redwood Drive area as part of Chick-Fil-A’s traffic study, which would be helpful information for other businesses in the area. Ms. Azevedo stated that the staff did not vet the area for that information. Commissioner Striplen advised the planners that collision information would be helpful for future projects. Commissioner Orloff concurred. A YEAR-IN-REVIEW PRESENTATION The 2022 Year-In-Review slide show was presented to the Commission. 8. ITEMS FROM THE PLANNING COMMISSION Commissioner Striplen noted in the Year-In-Review Presentation the following: • No information was shown about the environment, i.e. creek clean-up, drought, and flood concerns • No public information about living in a watershed. Public information about the quality of life in the City was not addressed. Commissioner Orloff noted the collaboration with the Tribe and wanted to acknowledge the great partnership that the City has with them. Chairperson Austin-Dillion asked about a timeline for an update on the downtown project. Planning Manager, Jeff Beiswenger, provided an update. 9. This proposal is consistent with the Industrial land use designation in the General Plan and the associated I/L-O Industrial/Office Overlay Zoning District. BACKGROUND: The subject property is a .48 acre parcel located on the southeast corner of State Farm Drive and Professional Center Drive. (Figure 1: Project Location). Surrounding uses include the VCA Animal Hospital to the north, the Learning Institute to the east and a Rohnert Park Health Center/Kaiser Permanente medical facility to the immediate south. The property is currently developed with a single story, 9766 square foot building that received a Conditional Use Permit and Site Plan and Architectural Review in 2001 and was built in 2002, respectively. The facility, Rohnert Park Cancer Center, (owned by US Cancer ManageManagement Corporation) specializes in operations of cancer treatment centers that delivers university level care with cutting edge technology, offering many types of alternative therapy. Page 2 Figure 1: Project Location The applicant, Boulder and Associates, on behalf of the US Cancer Management Corporation, proposes an 800 square foot addition at the northeast portion of the building to provide additional cancer treatment capacity to meet the growing demand within the community. The addition of one radiation vault is unique in that it will not experience the traffic typically associated with a medical office use (i.e. given the large size of the radiation therapy unit, the facility is only able to provide service to fewer patients than would a more typical medical clinic of this size). Project Details The project involves the construction of a 800 square foot addition to the northeast corner of the existing building, which would require a reworking of the site plan to accommodate the addition. The new space would facilitate another radiation vault, which would be accessed through the northeasterly portion of the existing building. The submitted site plan shows that access to the project site would continue to be provided from the driveways on Professional Center Drive, which lead to on-site parking bays to the east of the building. This parking area is shared with the building to the east, and a joint parking and access agreement to allow this arrangement to continue in perpetuity exists between the owners. (Figure 2: Site Plan) This agreement includes easements for vehicle and bicycle parking, ingress, egress, private drainage, trash enclosure, common use of the monument sign, as well as underground public utilities and above ground equipment and facilities. Page 3 Figure 2: Site Plan The proposed addition would be of the same contemporary style as the existing building, incor- porating the same stucco finish and color and the roof parapet cap. The design is proposed to be flat roof with the step profile to match existing profile detail, size and height. Windows would be installed along the north and east elevations of the addition, continuing the rhythm of build- ing’s fenestration. (Figure 3: Project Elevations) Figure 3: Project Elevations Page 4 Site modifications will include moving an existing curb to make way for the drive aisle. Efforts have been made to not alter the existing landscape, trees, and site lighting. For the new vault ad- dition, parking had to be reduced by 6 spaces to create the drive aisle. There is no change to ac- cessible parking stalls, accessible path of travel and public right of way and access. The applicant was required to provide a parking analysis to address the parking needs associated with the expansion of the Center and determine if the proposed parking supply is sufficient to meet the anticipated parking demand. The site’s parking requirements were evaluaed and com- pared to the Rohnert Park Municipal Code, as outlined below. The analysis, in its entirety, is in- cluded as Attachment 2 to the staff report. The property is located in the the Triangle Business subarea of the Central Rohnert Park Priority Development Area Plan. The City’s minimum parking requirements in that subarea states of- fices must provide 4 spaces per 1000 sq. ft. of gross floor area. With an addition of 800 square feet, the proposed project would need to provide an additional 3.2 spaces. According to the In- stitute of Transportation Engineers (ITE) Parking Generation manual, the average peak parking demand for medical offices is 3.2 spaces per 1000 sq. ft. In this regard, with an addition of 800 square feet, the proposed project would generate demand for an additional three vehicles. Parking occupancy counts were conducted in both the off-street lot and all on street spaces on Professional Center Drive, east of State Farm Drive . The occupancy data and map are attached, as noted, in the parking analysis and in (Figure 4: Zone Capacity). To summarize, the off- street lot was broken into three zones (A, B, C) with a total supply of 37 spaces. The peak park- ing demand for the total lot was 15 vehicles, which occurred twice on July 5th, and once on July 6th. At these times, there were 22 vacant spaces in the lot. To confirm this, Staff has visited the facility on a couple of occasions in both the morning and afternoon hours and did not find more than 10-15 vehicles parked on the site at any one time. The total supply for all off-and on-street spaces was 63 spaces with a peak demand of 30 spaces. Based on these observations, the addi- tion of another radiation vault to the site would only result in a very minor increase in the overall use of the facility. Figure 4: Zone Capacity Page 5 The data surveyor noted that most of the motorists parking in-on street spaces were accessing the Animal Hospital and the Early Learning Institute. In addition, there were two or three parties per day walking from the adjacent Rohnert Park Health Center/Kaiser Permanente lot through the “B” zone into the Cancer Center. The original approval for the Kaiser Permanente facility re- quired that a pedestrian access be provided between the two properties. The analysis concluded that there should be adequate parking available to accommodate the project’s parking demand given all the scenarios outlined. ANALYSIS: The property is zoned Industrial-Office Overlay, I-L/O. This designation currently allows medical clinics as a permitted use. The proposed addition would meet the required setbacks for this District. The existing building and the proposed addition would be built out at approximately 10,566 sq. ft. of floor area which would equate to a lot coverage of 50.5. This would be under the 60 percent allowed for in the Industrial-Office Overlay District. Furthermore, the Floor Area Ratio (F.A.R) with the addition is 0.505, which is also under the 1.0 F.A.R. designated for the I-L/O zoning district. The proposed building addition would be of the same materials and colors as the existing structure and would feature the same architectural theme, which is appropriate. The proposal also includes exterior modifications to include the removal of an existing curb to make way for the drive aisle, which will eliminate 6 parking spaces to create the new drive aisle. The parking analysis commissioned by the applicant concluded that there is sufficient parking for this site and the surrounding area. Again, to also support this finding, the applicant has noted that the radiation vault operation is unique in that it does not experience the traffic typically associated with a medical office use (i.e. given the large size of the radiation therapy unit, the facility is only able to provide service to fewer patients than would a more typical medical clinic of this size). Also notable is the facility’s relationship to the Rohnert Park Health Center and Kaiser Permanente. It is staff’s understanding that the latter refers many of its cancer patients to the cancer center facility for treatment. Patients visiting both facilities will likely park in the larger lot to the south, thereby lessening the need for on-site parking at the cancer care facility site. It should also be mentioned that there is curbside parking available along both the State Farm Drive and Professional Center Drive frontages, so an unlikely need for overflow parking could be met with streetside spaces. ENVIRONMENTAL DETERMINATION: The project has been analyzed for compliance with the requirements of the California Environmental Quality Act (CEQA) and found to be categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further action is required pertaining to environmental review. PUBLIC NOTIFICATION: Public notification is not required for Site Plan and Architectural Review. That the developments general appearance is compatible with existing development and enhances the surrounding neighborhood. Criteria Satisfied. The development is compatible with existing surrounding development and the proposed expansion would continue the architectural theme established with the existing building, which is appropriate. The roof parapet cap and stucco finish are representative of the modern “business park” architecture found in the area and the project incorporates community wide design elements such as variations in the roof elevation, decorative window treatments and a complementary color palette. The new addition is designed so it will feel as if it was always part of the original building. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the façade facing the street; and/or the line and pitch of the roof. 2 Reso 2023-04 Criteria Satisfied. The design of the new addition will match the existing building with regards to the size and position of the storefront, the stucco finish and color and the roof parapet cap. Existing pedestrian, bicycle and vehicular connections would be retained as part of the project. A pedestrian access is provided between the Kaiser Permanente/Rohnert Park Health Center parcel and the Cancer Center site. Section 3. Environmental Clearance. The project is categorically exempt from the California Environmental Quality At, pursuant to California Code of Regulations, Section 15301 (Class 1 – Minor Alterations to existing Facilities) NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application No. PLSR22-0010 subject to the Site Plan and Architectural Review submittal package attached as Exhibit A and the following conditions: 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is applied for the exterior remodel and any tenant improvements, or an extension is requested and approved. 2. All applicable provisions of the City of Rohnert Park Municipal Code (RPMC), are made a part of these conditions of approval in their entirety, as if fully contained herein. 3.
