Darrin Jenkins, City Manager, presented the item. ACTION: The Commission participated in the presentation and offered the following comments and questions: plans for the overall downtown corridor in the Rohnert Park Central Priority Development Area Plan; percentage of development of office space; if the Laulima plan will be incorporated; the challenge with economic dynamics and if the hotel remains a component of the plan; how the selection of the diversity of art, food, and other businesses will be promoted; if the City will condition leases to control the types of business allowed; consultation with the Tribe for site design, signage, etc. to be respectful in a meaningful way; incorporation of solar, water use, other efficiencies; if the City will sell land for others to build such as hotels and housing; how the City controls the occupancy and branding of the spaces; what role the City plays for retail development; if it’s possible to control when a parcel is developed; and, if the City or a non-profit will develop a space to provide social services. 7. RECOMMENDED ACTION: Staff recommends approval of Resolution 2022-12 for a Site Plan and Architectural Review (SPAR) to construct two photovoltaic solar carports within the existing Taco Bell parking lot located at 5000 Redwood Drive to support six electric vehicle chargers. BACKGROUND: The project site is located at 5000 Redwood Drive, which is bounded to the west by Redwood Drive, to the east by Interstate 101, and to the south by an existing “Good Nite Inn”. (Figure 1) The parcel is currently developed with a Taco Bell fast food restaurant and associated drive-through aisles, parking, and landscaping. A Site Plan and Architectural Review was approved in 2018 for façade and landscaping improvements for the existing restaurant. Improvements included exterior façade changes, interior remodel, and replacement of turf with drought-resistant landscaping. Figure 1. Site Location The applicant, A Tech Construction, Inc., proposes to construct two carport structures in an existing parking lot (Figure 2). The carports will support solar photovoltaic (PV) panels, which will power six electric vehicle chargers (EVC). The EVCs and associated energy storage system equipment will be reviewed and approved through a separate building permit process. The construction of the carport structures is not expected to impact the commercial space, the drive-through aisles, or the paved parking areas. Figure 2. Existing Site Plan ANALYSIS: The proposed project includes the addition of two carports with roof-mounted solar panels to support six new electric vehicle chargers. The addition of the carports and solar panels is consistent with the Neighborhood Commercial (C-N) General Plan land use designation and C-N zoning designation of the property, and complies with the City’s development standards including height, setbacks, parking, and landscaping. Site Plan As proposed, the addition of the carports will not alter access to the sidewalk, parking, or building, and no parking spaces will be impacted by the addition. Both carports will be 13’6” inches in height at the lower elevation, and just over 15 feet at the higher elevation. The carport to the west (Array #1) is 1,269 square feet and will cover the four existing ADA accessible spaces, while Array #2 is 3,584 square feet and will cover 13 standard parking spaces (Figure 3). Figure 3. Proposed Site Plan Landscaping The removal of one tree is proposed. A condition of approval was added to require the applicant to replace any trees or landscaping removed as a result of the carport installation. New landscaping shall be installed in accordance with water conservation standards, which meet or exceed the requirements of Model Water Efficient Landscaping Ordinance (MWELO), and with staff approval. Colors and Materials The carport structures are built using 10 x 3, 12-gauge steel purlins. The black, thermally pressed glass solar panels will be held in place by anodized aluminum frames. ENVIRONMENTAL DETERMINATION: In accordance with the California Environmental Quality Act (CEQA), the proposed project is exempt from environmental review under Section 15303 New Construction or Conversion of Small Structures of the CEQA Statute & Guidelines. PUBLIC NOTIFICATION: As per Chapter 17.25 Article III of the Rohnert Park Municipal Code, applications for site plan and architectural reviews do not require public noticing. The project proposes the addition of two PV carports to an existing parking lot. No expansion or other exterior changes are proposed to the main building, drive-through aisles or associated equipment, paved parking facilities, or trash enclosure; therefore, the development would remain compatible with existing surrounding commercial development. B. That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the façade facing the street; and/or the line and pitch of the roof. Criteria Satisfied. The exterior modifications to the existing commercial building would not alter the height, bulk, or area of the commercial building. Therefore, this finding is not applicable. C. That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. 2 Reso 2022-12 Criteria Satisfied. The project proposes to add two carport structures to an existing parking lot. The additional structures follow the development standards for building orientation, setbacks, landscape areas, and parking on the site. The exterior modifications to the existing commercial building would not alter the pedestrian, bicycle and vehicular connections with adjacent properties. The site as currently designed is consistent with this criteria. Section 3. Environmental Clearance. The project has been analyzed for compliance with the requirements of the California Environmental Quality Act (CEQA) and found to be categorically exempt under Section 15303 New Construction or Conversion of Small Structures No further action is required pertaining to environmental review. General Conditions 1. The Site Plan and Architectural Review approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is issued and construction is commenced and diligently pursued toward completion and the use is initiated, or an extension is requested and approved. 2. The facility shall comply with any and all applicable provisions of the Rohnert Park Municipal Code (RPMC) and any state or federal agency. The violation of any condition listed herein shall constitute a nuisance and a violation of the Rohnert Park Municipal Code. In conformity with Chapter 1.16 of the RPMC, a violation of the RPMC may be an infraction or a misdemeanor and shall be punishable as provided by law. In addition to criminal penalties, the City may seek injunctive relief. The Applicant agrees to pay for all attorney’s fees and costs, including, but not limited to, staff time incurred by the City in obtaining injunctive relief against the Applicant as a result of a failure of the Applicant to fully perform and adhere to all of the Conditions of Approval. 3. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert Park, its agents, officers, attorneys and employees from any claim, action or proceedings brought against any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this application or certification of the environmental document which accompanies it. This indemnification obligation shall include but not be limited to, damages, costs, expenses, attorneys’, or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents, officers, attorneys or employees. Planning Division Conditions 4. Any landscaping removed or destroyed as a result of the construction of the carports shall be replaced at a 1:1 ratio. Any trees to be removed shall be removed in compliance with Chapter 17.15 Tree Preservation and Protection of the Rohnert Park Municipal Code. 5. Any restriping of the existing parking area shall receive approval from the Development Services Division and shall not result in a net loss of parking spaces. 6. Bicycle parking stalls installed as part of the project shall be in compliance with the Rohnert Park Zoning Ordinance Section 17.16.140. The C-R: Regional Commercial zoning designation requires four (4) bicycle parking spaces to be installed for the project. Two city standard “inverted U” bicycle racks will statisfy this requirement. Page 1 City of Rohnert Park Planning Commission Report Meeting Date: August 11, 2022 Item No: 6.2 Prepared by: Suzie Azevedo, Assistant Planner Agenda Title: PLSR22-0009, Site Plan and Architectural Review/Conditional Use Permit – Cattlemens Restaurant Remodel Location: 4619 Redwood Drive GP/Zoning: Commercia /C-R: Regional Commercial Applicant/Owner: Peter Mrozik, Cattlemens Restaurant RECOMMENDED ACTION: Staff recommends that the Planning Commission adopt Resolution No. 2022-13, approving Site Plan and Architectural Review and Conditional Use Permit for the remodel of an existing restaurant building (previously Outback Steakhouse) to allow for a new Cattlemens restaurant located at 4619 Redwood Drive. (Figure 1). This proposal is consistent with the Regional Commercial land use designation in the General Plan and the associated C-R: Regional Commercial zoning district. Figure 1: Location Map Page 2 BACKGROUND: The project is located on a 0.55 acre parcel in the northwest portion of the City in an area predominately characterized by existing developed parcels with commercial retail and family fun entertainment businesses. The existing 6300 square foot restaurant building, formerly Outback Steakhouse, and the associated outdoor patio area, was built in 1997. The applicant, Peter Mzorik of Cattlemen’s Restaurant, proposes an exterior remodel to the existing restaurant building to model the Cattlemens theme building façade and brand. Surrounding uses include the Indoor K1 Go Kart facility to the West, Walmart to the South, Highway 101 to the east. The parcel (4601 Redwood Drive), home to the Go Kart operation, and the parcel (4619 Redwood Drive) housing the previous Outback Steakhouse, were both previously owned by Codding Enterprises. In 2021, the restaurant parcel was sold to Cattlemen’s Restaurant. As part of the purchase agreement, Codding Enterprises, initiated and recorded an agreement granting a non-exclusive easement in perpetuity for vehicular parking, vehicular and pedestrian ingress and egress, and other lawful use directly associated with business operations as shown outlined in blue below. The significance of the access easement and parking are discussed further in the project details portion of the staff report below. (Figure 2 – Parking Easement Area). Figure 2, Parking Easement Area Page 3 Project Details Architectural Details: Exterior alterations include new façade improvements to the existing building gables on the north, east, and south of the building to cover up the existing gables and create a more western themed building in keeping with the Cattlemens Steakhouse appearance. New painted cedar plywood board and batten siding will be installed over the existing gables and over the stucco walls below the gables on the north and south facades. New columns are required on the north and south facades to support the façade improvements. (Figure 3, Exterior Elevations). Existing Elevation East Elevation Page 4 North Elevation South Elevation The existing roofing tiles will be cleaned and painted in keeping with the new building paint color sheme. Existing roofing tiles will be removed from portions of existing roof gables to remain and new metal roofing will be installed over those portions of existing roof gables. Additionally, a new main entrance door will be installed in keeping with Cattlemens theme and a wider service man-door, with glazing, to the outdoor seating area will replace the existing service man-door to the outdoor seating area. A new covered roof will be provided over the existing outdoor seating area. Outdoor seating will remain approximately the same size. The outdoor seating area will be contained by new wood columns with a 42’ tall wood frame wall between them with the same new painted board and batten siding on the new facades. Roll down shades between columns will allow the outdoor seating to be protected from weather and sun. About 1/3rd of the outdoor seating area is already covered by the existing building roof. (Figure 4, Outdoor Seating) Page 5 Figure 4, Outdoor Seating Parking: The Cattlemens site/parcel has on-site parking for 15 spaces, four of which are accessible parking spaces. As previously discussed, there is a recorded parking easement on the adjacent parcel for a total of 75 parking spaces dedicated to the restaurant operation. The total number of provided parking spaces is 90 spaces. Per the original permitted building drawings, the restaurant has 216 interior seats and 48 exterior seating. The exterior seating is proposed at 52 seats for a total of 268 seats. Pursuant to Municipal Code Section 17.16, Off-Street Parking requirements, the parking ratio for eating and dring establishments (General Restaurant) is 1 parking space per 2.5 seats. Based on 268 seats proposed, a total of 107 parking spaces would be required using this formula. The proposal, with the dedicated parking easement/agreement, provides a total of 90 spaces. Section 17.16.040, Parking Exemptions, allows parking space reductions up to a maximum of twenty-five percent if approved by the Planning Commission through the issuance of a Conditional Use Permit. The applicant has filed the necessary Conditional Use Permit for consideration and staff supports the approval of the Conditional Use Permit. The restaurant site and neighboring parcel, housing the K-1 Go Kart facility to the west, have functioned well in the past with the entertainment/restaurant configuration and parking has never been an issue at this location in that regard. Signage/Lighting: Proposed signage includes removing existing signage, to be replaced with Cattlemens brand signage, including tube lighting across the top edge of the new facades. The applicant is proposing four (4) open pan channel letter signs and two (2) decorative exposed “boot” graphics as follows: Sign Locations (A, B1, B2, C) Page 6 Sign Specifications Section 17.27.100 (Special Sign Type Requirements) of the RPMC, neon signs and tubing require a Conditional Use Permit to determine area, height, illumination and location of the proposed signage. Page 7 The maximum signage allowed in the C-R (Regional Commercial) district is based on 1.0 square foot for each linear ft of building frontage. In applying this calculation, the north and south frontage of 103’ was used given the layout of the existing building and the surrounding area. The total square footage of signage proposed is 98 square feet. The proposed signage maintains a consistent design approach in style, materials and quality and is well proportioned with the scale of the building. The “boot” graphic visually anchors the sign and the size of the lettering is designed in keeping with the proportioned and size of the sign area. Wall mounted gooseneck lighting is also proposed on each elevation for façade articulation and is used in a consistent pattern. Placement of the light fixtures are directed downward and will not cause glare or reflect into buildings, public streets or adjacent parcels. Landscaping: The project site is currently fully landscaped. All existing plant and trees shall be inspected to determine their health and any unhealthy plants and trees will be replaced using plants compliant with the City of Rohnert requirements. Staff will work with the applicant on upgrades to the site where feasible and in accordance with all state and local requirements. ANALYSIS: The proposed project includes exterior modifications, including new signage, to an existing commercial restaurant building and would remain in compliance with the Commercial-R (Regional) General Plan land use designation of the property, which is intended to provide sites for retail areas containing a wide variety of businesses, including: retail stores, eating and drinking establishments, commercial recreation, business and personal services, and hotels and motels. The property is zoned C-R: Regional Commercial which is intended to allow for uses that provide goods and services that serve the community and outlying areas within an eight to twenty-mile radius. Commercial/Eating Establishment uses are permitted in the C-R zoning district as well as a range of other commercial activities. The project involves exterior modifications to an existing building and no changes to setbacks, height or lot coverage are proposed. Additionally, the floor area will remain the same with the seating for approximately 216. The parking scenario has been discussed and staff supports the parking reduction pursuant to Section17.16.040, Parking Exemptions of the Rohnert Park Municipal Code, as noted above. The Rohnert Park Design Guidelines, adopted by the City Council in 2012, contain site and architectural recommendations for commercial, mixed-use, and multi family districts. The intent of the document is to provide guidance to property and business owners, design professionals, and developers in the design of new buildings and renovations. These guidelines are used to assist the review of these projects, creating quality developments that reflect the character and goals of the city while facilitating a streamlined project approval. The guidelines were also adoped to support community expectations and open space guidelines to include: • Encourage designs that relate to their context. • That the development incorporates a variation from adjacent on-site and off-site structures in height, bulk, and area; arrangement on the parcel; openings or breaks in the façade facing the street; and/or the line and pitch of the roof. • Architectural detailing consistent with the building style should be used to add variety to building facades. • Wall signage shall be placed on designated signage areas or areas that complement the building’s façade composition. • On renovated commercial buildings, the incorporation of an outdoor open space is also encouraged. Page 8 The review of the project is also guided by RPMC Section 17.25.033, factors to consider/conditions. The applicant has put forward a thoughtful design which will visually enhance the Redwood Drive corridor and line of sight from Highway 101. Staff has evaluated each of the criteria required in RPMC 17.25.033 and has prepared the appropriate findings recommending approval with conditions in the resolution attached. ENVIRONMENTAL DETERMINATION: The project has been analyzed for compliance with the requirements of the California Environmental Quality Act (CEQA) and found to be categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. The proposed project will also satisfy design guidelines that encourages incorporation and upgrade of outdoor open space on renovated commercial buildings. The upgrade to the restaurant building will be an attractive addition to the west side of town and the architecture, lighting elements, and overall site design components give the restaurant site a look and feel that will enhance the surrounding neighborhood. 2 Reso 2022-13 B. The updated look and feel of the new restaurant will achieve architectural detailing proportioned to the building. Facade articulation elements were selected according to the design theme associated with the Cattlemens brand and style by creating new facade improvements that cover up the existing gables and create a more western themed building in keeping with the Cattlemens Steakhouse appearance. The development incorporates a variation from adjacent on-site and off-site structures in height, bulk, area, and arrangement on the parcel as well as openings and breaks in the facade facing the street and the line and pitch of the roof. C. That the development will be located and oriented in such a manner so as to provide pedestrian, bicycle and vehicular connections with adjacent properties, as appropriate, and avoids indiscriminate location and orientation. Criteria Satisfied. The project proposes to remodel the exterior facade with new architectural elements. The project involves exterior modifications to an existing building and; therefore, there are no changes to the building orientation, setbacks, or lot coverage on the site. The applicant has put forward a thoughtful design which will visually enhance the Redwood Drive corridor and line of sight from Highway 101. The exterior modifications to the existing commercial building would not alter the current pedestrian, bicycle and vehicular connections. Section 3. Factors Considered for Conditional Use Permit. The Planning Commission approving Planning Application No. PLUP22-0002, makes the following findings pursuant to Rohnert Park Municipal Code 17.16.040 and 17.27.100: A. That the proposed location of the conditional use/sign is in accord with the objectives of the City of Rohnert Park Zoning Ordinance and the purposes of the district in which the site and sign is located. Criteria Satisfied. The project is located within the C-R, Regional Commercial District, which is intended to allow for the operation of activities that provide goods and services that serve the community and outlying areas within an eight to twenty-mile radius. The restaurant provides a visitor-serving function, consistent with the definition of the regional commercial zoning district. The restaurant site and neighboring K-1 Go Kart facility parcel to the west, have functioned well in the past with the entertainment/restaurant configuration and parking has never been an issue at this location; therefore, staff supports the Conditional Use Permit for the parking reduction. Given the site's close proximity to Interstate 101, the sign component of the project will aid in the attraction of tourists and other visitors who are important to the economy of the City and B. That the proposed location of the conditional use/sign and the conditions under which it is operated or maintained will not be detrimental to the public health, safety, or welfare, or materially iryurious to properties or improvements in the vicinity. 3 Reso 2022-13 Criteria Satisfied. The surrounding properties are all of commercial uses. The Cattlemen's restaurant use will complement the existing uses in the area as well as the planned and future proposals for businesses to the southwest in the Northwest Specific Plan Area. The restaurant building is sited and designed in a manner that achieves a safe built environment. Conditions will be imposed by the Conditional Use Permit and Site Plan and Architectural Review that should mitigate any concerns related to the facility with regard to building, fire and life safety as well as any nuisance conditions that may arise given the specifics of this type of use. C. That the proposed conditional use/sign will comply with each of the applicable provisions of Title 17 of the City of Rohnert Park Municipal Code. Criteria Satisfied. As proposed, the project is consistent with the intent of the zoning district and all the various development standards including height, setbacks, and coverage. Staff supports the Conditional Use Permit for the reduction in parking and the use of skeleton neon lighting and tubing. A violation of a condition of approval or a provision of Title 17, Zoning, may cause a conditional use permit to be revoked or modified as set forth in Chapter 17.25 of the Rohnert Park Municipal Code. The applicant has duly been notified of this provision. Section 4. Environmental Clearance. The project has been analyzed for compliance with the requirements of the California Environmental Quality Act (CEQA) and found to be categorically exempt as a Class 1 Exemption under Section 15301: Existing Facility. No further action is required pertaining to environmental review. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby approve Planning Application Nos. PLSR22-0009/PLUP22-0002, subject to the Applicant Design Package, attached as Exhibit A, and the following conditions: 1. The Site Plan and Architectural Review and the Conditional Use Permit approval shall expire one year from the Planning Commission approval date, unless prior to the expiration a building permit is applied for the exterior remodel and any tenant improvements, or an extension is requested and approved. 2. All applicable provisions of the City of Rohnert Park Municipal Code (RPMC), are made a part of these conditions of approval in their entirety, as if fully contained herein. 3. Project shall comply with: 2019 California Building Code, 2019 California Plumbing Code, 2019 California Mechanical Code, 2019 California Electrical Code, City of Rohnert Park Municipal Code Title 15. 4. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert Park, its agents, officers, attorneys and employees from any claim, action or proceedings brought against any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this application or certification of the environmental document which accompanies it. This indemnification obligation shall include but not be limited to, damages, costs, expenses, attorneys', or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents, officers, attorneys or employees. 5. Upgrade to fire sprinklers and alarms to current codes will be required. 6. A roof will need to be installed over the existing trash enclosure. 4 Reso 2022-13 7.Install a sump in the trash enclosure floor, and connect the sump to the sanitary sewer. 8.Bicycle parking shall be added pursuant to Section 17.16.140, Bicycle Parking, of the Rohnert Park Municipal Code. 9.All existing plant and trees shall be inspected to determine their health and any unhealthy plants and trees will be replaced using plants compliant with the City of Rohnert requirements. Staff will work with the applicant on upgrades to the site where feasible and in accordance with all state and local requirements. 10. The development of the project shall conform in its entirety to plans and specifications submitted herein as Exhibit A. BE IT FURTHER RESOLVED that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals.
