2024/04/23 City Council Resolution 2024-028RESOLUTION NO.2024-028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING A LETTER AGREEMENT TO THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF ROHNERT PARK AND THE ROHNERT PARK PUBLIC SAFETY OFFICERS' ASSOCIATION (RPPSOA) WHEREAS, on June 8, 2021, the City Council adopted Resolution No. 2021-070 approving and adopting a Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA); and WHEREAS, the RPPSOA and City staff have met and conferred in good faith to amend certain terms and conditions of the Agreement effective April 23, 2024; and WHEREAS, staff prepared the attached Side Letter Agreement effective April 23, 2024 to the Memorandum of Agreement; and WHEREAS, the attached Side Letter Agreement effective April 23, 2024 has been approved and executed by representatives of RPPSOA. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the Side Letter Agreement effective April 23, 2024 to the Memorandum of Agreement for the RPPSOA, which is attached hereto as Exhibit "A" and incorporated by this reference. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute documents pertaining to same for and on behalf of the City of Rohnert Park. The City and the RPPSOA are collectively referred to herein as the "Parties." The Parties have met and conferred in good faith, in accordance with the Meyers-Milias- Brown Act ("MMBA"), concerning the terms and conditions of this Agreement (Sworn Staffing and Field Training Officer requirements). The Parties recognize recent and critical staffing challenges for sworn personnel. To that end, the Parties agree to the following amendment to the MOA. The specific provisions contained in this Side Letter are intended to supersede any previous agreements, whether oral or written, regarding the specific provisions contained herein. Further, except as provided herein, all wages, hours and other terms and conditions of employment presently enjoyed by the RPPSOA in the MOA shall remain in full force and effect. Whereas: I. Renegotiation The RPPSOA and City desire to begin negotiations early on a successor MOA. The Parties agree to begin meeting -and -conferring on a successor MOU prior to January 2025. Starting in July 2024, the Parties will begin to meet over non -economics and salary survey data. The Parties agree to formally exchange initial economic proposals during the first week of December 2024. II. Article 10.4 (c), will be amended as follows: 2024-2025 Increase: Effective the first full pay period that includes May 1, 2024, the 2023-2024 pay schedule for sworn officers shall be increased by 3%. Effective the first day of the pay period that includes July 1, 2024, the 2023-2024 Pay Schedule shall be increased by three percent (3%). This revised schedule shall be known as the 2024-2025 Pay Schedule. III. Article 10.4 (a), will be amended as follows: (a) Field Training Officer (FTO) Pay Employees who are qualified and regularly assigned by the Director of Public Safety, as a Field Training Officer, shall receive a five percent (5%) of base salary monthly Incentive Pay. (i) A Field Training Officer shall be defined as a Public Safety Officer who has been fully qualified to train newly -hired Public Safety Officers. Field Training Officers will be selected through a three- phase testing process. The process will include a written test, an oral examination, and supervisory and command staff review. After a candidate has been selected, he or she will be required to successfully complete a P.O.S.T. certified FTO School before final appointment. (ii) Any FTO who is assigned to a specialty position of Detective will automatieally relinquish his or -her- FT-0 st-a us and p ineentive, an:w44 be required to tv apply for- the position when he or- she beeomes eligible--. PSOs assigned to the Deteetive Division shallof be eligible-anFT-0 assignment and the pay ineentive. shall be eligible for the five percent(5%) Incentive Pay while assigned to a trainee only. Such payment shall be assigned for a minimum of one (1) pay period. (iii) Completion of a three to,-.,, a a FTO shall be deemed , sueeessfally eompleting the FTO assignment. At any time after three yeas as a FTO, an employee, at his or her option, may elect to discontinue the FTO assignment by notifying the City in writing. If an employee exercises this option, the employee will automatically relinquish his or her FTO status and pay incentive. The exercise of this option by an employee will not be grounds for any disciplinary action by the City. (iv) The City reserves the right to exercise its regular and customary management rights with regard to FTO assignments including, establishing FTO performance standards, conducting an annual performance review of the FTO and taking disciplinary actions subject to the requirements of applicable laws.
