AGENDA ITEMS 7.1 MASTER BANNER SIGN PROGRAM Assistant Planner, Suzie Azevedo presented a detailed PowerPoint outlining a proposal submitted by Sonoma State University (SSU) for a Two-Year Pilot Master Banner Program to establish guidelines and procedures for the placement and design of banners on specific streetlight poles throughout the City. The banner program would enhance the overall aesthetics of the area, support community-focused organizations, and improve neighborhood identity. Additionally, establishing a pilot program will help create policy, to assist with the city’s Downtown development, by exploring streetscapes, designing imagery for streetlight poles, and helping to identify and implement best practices that would ensure community enhancement and safety as it relates to installation processes and procedures. Discussion was held between staff and the Commission. Commissioners provided the following comments: • Concerns about exclusive use of streetlight poles only by Sonoma State University; perception of individualizing one group; the program should allow for other non-city partners, including nonprofit and not-for-profit organizations. • Concerns that the proposal included an excessive number of banners; need to scale back display. • Need for additional program structure and MuniCode incorporation. • Quality of life concern; public may not be in favor. • Two-year period is too extensive. • Support for workshop/study session to gain input from community and potential stakeholders. • Explore alternative advertising for SSU, freeway marquee sign, use of freeway, and off- ramp exit signs. • Overall support for SSU within the Rohnert Park community. The applicant, Neil Markley, Associate Vice President of Finance was recognized and responded to Commission questions and concerns. Mr. Markley noted that during recent discussions with the City’s Leadership Group, exploration of ways to improve connections with Rohnert Park and Cotati has been a priority. SSU was supported and was encouraged to apply for the banner program to improve upon this connectivity. He emphasized the importance of promoting SSU, sharing information about the university, extending a warm welcome to students, and highlighting the university's role within the City and community. Mr. Markley indicated they would consider reducing the number of banners displayed and limiting the frequency of showings to twice a year. Further discussion was held. Associate Planner, Elliott Pickett, was recognized and stated that the pilot program would provide an important interim step between the City’s current practice of informally placing signs and codification of specific standards and that staff desired to find a mutually agreeable approach to achieve that step. Additionally, he stated that the proposed pilot program would initiate and implement General Plan Policies about strengthening relationships and connecting the community with Sonoma State and enhancing community character and placemaking. Chairperson Epstein suggested tabling Resolution 2024-04 and for Planning Staff to conduct a study session to present to the Planning Commission taking in consideration for all comments and concerns. ACTION: Moved/Seconded (Striplen/Lam) to deny Resolution 2024-04 for a Two-Year Pilot Master Sign Program and policy for the placement of banners on selected poles throughout the City of Rohnert Park, directing staff to conduct a study session incorporating all comments and concerns as noted for streetlight pole banner installation throughout the City. BACKGROUND: On April 22, 2014, based on a recommendation from the Planning Commission, the City Council approved an ordinance authorizing an Amended and Restated Development Agreement (“DA”) between the University District LLC and Vast Oaks LP. The ordinance and the DA became effective on May 22, 2014. The DA covers a large portion of the University District Specific Plan Area (see Attachment 1), which is generally referred to as the Vast Oaks and UDLLC property. The DA has been amended two times, once to modify the Affordable Housing Plan and once to facilitate the construction of water tank and the expansion of Crane Creek Regional Park. The DA has also been partially assigned to a number of merchant builders, in order to accomplish the buildout of the Vast Oaks portion of the University District. In 2020, Vast Oaks LP assigned its interest in the DA to University District LLC. The term of the DA is ten (10) years and Section 2 of the DA contemplates and describes the process by which the Developer may request and the City may approve two (2) five year extensions (“Extended Term”) to the DA. On January 19, 2024, the Developer requested the first five-year extension. The DA provides that a DA extension shall be reviewed in the same manner as annual extensions. Section 2.02(C) further provides that if an Extended Term is granted, “City shall record an instrument giving notice of the Extended Term and the termination date thereof.” On March 12, 2024, the City Council reviewed the annual report for the University District DA and determined that the Developer was in substantial compliance with the terms of the DA. On April 23, 2024, the City Council adopted a resolution approving and authorizing the execution of a notice of an extended term for the University District Development Agreement, finding that the Page 2 developer was making adequate progress, was not in default under the agreement, and that the term extension would be beneficial to the city to continue the orderly development of the Specific Plan area. Because the Planning Commission will be continuing to review development plans in the University District, staff wanted to make sure the Planning Commission was informed about the extended term of the Development Agreement. BACKGROUND AND ANALYSIS: The applicant, Sonoma State University (SSU), submitted an application for a Master Sign Program and policy to allow the placement of banners on selected poles throughout the City to promote the University and highlight Rohnert Park as a partner with the University. Staff reviewed the application and proposed that the Planning Commission regulate it through the sign program provisions of Rohnert Park Zoning Code 17.27.040. These provisions allow the Planning Commission to permit and regulate signs that do not fall under the exemptions outlined in Rohnert Park Zoning Code 17.27.050 (Exempt Signs) and that do not meet the objective design criteria outlined in Rohnert Park Zoning Code 17.27.060 through 17.27.100. The application proposed streetlight banner signs on Rohnert Park Expressway from Commerce Boulevard to Petaluma Hill Road and on East Cotati Avenue from Bodway Parkway to the City limits. The banners would be in place from March through September and staff recommended limiting the program to a two-year period. Upon review of the application, the Planning Commission expressed concerns regarding the scale of the program and the impacts it would have on the aesthetics of the City and concern regarding the length of time the signs would be installed, which could limit the ability of other applicants to utilize a streetlight banner program. While the Planning Commission also expressed support for Sonoma State University (SSU) in general, it voted by motion voted not to approve the specific application. Page 2 In order to complete the record for the application and preserve the applicant’s appeal rights, staff is recommending that the Planning Commission document its reasoning and findings, as outlined in the attached resolution. The resolution explains why the application, as proposed, is inconsistent with the City’s Zoning Code. The resolution also documents that the Planning Commission’s denial is “without prejudice”. This finding allows the applicant to bring forward a revised application without the one-year waiting period that is required by code and is intended to reflect the Planning Commission’s general support for partnerships with SSU. Adoption of the resolution will initiate the 10-day appeal period described in the Municipal Code. Staff will make SSU aware of the action and the deadline for appeal, as well as the opportunity to revise the application to improve consistency with the City’s Zoning Code. ENVIRONMENTAL DETERMINATION: The action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, pursuant to CEQA Guidelines Section 15378. For purposes of the PDA Plan, Central Rohnert Park is composed of five subareas, each with unique characteristics (Triangle Business, City Center, Central Commercial, Station Center, Creekside Neighborhood – See Figure 2), These subareas are intended to meet the community’s commercial and service needs and are envisioned to be developed as distinct community places in and of themselves, connected by an improved city stret grid and transit, bike and pedestrian facilities. Figure 2 – PDA Subareas One of the challenges of implementing the PDA Plan, with its vision for a walkable downtown destination, is working with the existing development in the area to create a truly “urban space”. The Downtown District Amenity Zone (DDAZ) Overlay. (Figure 3 – Downtown District Amenity Zone) and its supporting Form Based Code (FBC) outline development standards as well as procedures for the preparation, filing and processing of applications within the DDAZ. Applications within the DDAZ are subject to review and approval by the Downtown Design Review Board (DDRB) to confirm that the application meets all the applicable requirements of Page 3 the DDAZ FBC standards and the PDA Plan. The DDAZ Form Base Code (FBC) allows the City’s Planning Commission to serve as the DDRB. The DDAZ Overlay District and Form Based Code are included in Chapter 17.06.700 to 17.06.750 of the Rohnert Park Municipal Code. Other projects within the DDAZ do not require strict compliance with the presecriptive stand- ards of the FBC, but they are still reviewed by the Downtown Design Review Board and staff works with each each applicant to incorporate features that support the downtown vision. A good example of this is the pedestrian pathway and landscape improvements in the Raley’s Center parking lot which connects Raleys to State Farm Drive on an alignment included in the FBC. Project Site Page 4 The proposed project is a Design Review for property at 500 Raley’s Towne Center, proposed by Argonaut Investments. The site is designated C-R (Regional Commercial) in the General Plan, located within the Central Commercial subarea of the PDA, and within the Downtown Core tran- sect of the DDAZ. The proposal includes exterior modifications to an existing commercial ten- ant space to allow for the relocation of Orangetheory Fitness Center within the Raley’s Towne Center Shopping Center. The proposal does not include new access points, new construction in excess of 2,000 square feet or an expansion in excess of 10% of the floor area, so it is not subject to the full prescriptive requirements of the DDAZ FBC. Despite this fact, the proposal includes elements that are supportive of the downtown vision, described more completely below. PROJECT SUMMARY: The project is located on a 13.14-acre parcel within the Raley’s Towne Center Shopping Center. The shopping center is developed with commercial retail, and restaurant style businesses. The Altamont apartment complex is located directly south, the Safeway Shopping Center is directly west and the City’s proposed downtown site is located across State Farm Drive to the east of the shopping center. The existing 5,476 square foot building is characterized by a primary western entrance, facing the parking lot, a glass block double cloud feature on its north face and a service door and several windows along its State Farm Drive frontage to the east. There is also a small outdoor seating area along the east façade of the building (See Figure 4 – Existing Conditions). Figure 4 – Existing Conditions North Elevation with Glass Block Wall West Elevation – Primary Entrance Page 5 The applicant proposes to remodel the building to include new architectural elements, landscaping, lighting, signage, bicycle parking and an expanded outdoor seating area. The proposed remodel will create frontage features along State Farm Drive and improve the overall interface between shopping center and the public realm, which is a goal of the PDA Plan. The proposed remodel is illustrated and described in more detail below. Architectural Details: Exterior alterations include removal of the glass block double cloud feature. A new wall with a 16080 sliding glass door will be built in its place, which will include the return of the stucco soffit to this area. Installation of new decorative wrought iron railings with 30-inch tall light bollards and scored, etched and stained pavement treatments will create an inviting seating area and outdoor space. Modifications to the east elevation facing State Farm Drive will include infill of two existing windows, installation of a new double door facing the patio area, incorporation of a stucco reveal trim, a 5/8” thick opaque acrylic backer with the Orangetheory sign copy, decorative wrought iron railings with 30” tall light bollards to match the north elevation outdoor area and a tube steel logo/vine wall with ground up-lighting and a water jet steel logo plate. The proposed remodel will re-orient the building to take advantage of its frontage along State Farm Drive and will create an attractive outdoor gathering place adjacent to the existing pedestrian pathway that links the Raley’s Center to the City’s future downtown site. (See Figure 5 – Proposed Improvements) East Elevation along State Farm Drive Page 6 Figure 5 – Proposed Improvements The applicant is proposing a color palette in soft grays and whites to match the existing features of the shopping center. Fencing, lighting and trellis work is proposed to be “coreten” (natural rust) metal providing a modern accent to the remodel. Signage/Lighting: Proposed signage includes a 5/8” thick opaque acrylic backer with the Orangetheory sign copy placed above the double doors at the east elevation, which again enhances the building’s frontage on State Farm Drive, consistent with the City’s goals for the DDAZ. Additionally, a 2”x2”x1/8” water jet steel logo will be incorporated into the tube steel logo/vine wall with ground up lighting. On the west and north elevations, the applicant will be repurposing the existing, approved signage that it has in place at the current OrangeTheory location 600 Raley’s Town Center. These signs are 15 square feet each, custom illuminated channel letters in orange, avery red and oracal grey color tones. Wall -mounted accent lighting is provided throughout on each elevation and used in a consistent pattern. Light fixtures are directed downward to avoid glare or reflection into buildings, public streets or adjacent parcels. The bollard lighting proposed will be integrated into the new decorative wrought iron railings that creates an additional outdoor seating area. Figure 6 - Lighting, illustrates both the proposed wall mounted and bollard lighting fixtures. Page 7 Figure 6 - Lighting Landscaping: The Central Commercial subarea contemplates amenities and landscaping for an “urban” living style. A distinct landscape identity and unifying landscape theme is recommended to support and enhance the identity of Central Rohnert Park and the area’s streets and streetscapes. The proposed landscape plan consists of a variety of trees, shrubs and groundcover accents that are adaptive, and are drought to fairly drought tolerant varieties that are conducive to the environmental condition of the site. The landscape plan includes Liquidamber (2) and Common Peach trees (existing trees), Jack Spratt, and New Zealand Flax shrubs, with European Gray Sedge evergreen grass like plants. An accent flowering plant pallete will include Hot Lip Sage, and Society Garlic type varietals. A Happy Wanderer climbing plant on the proposed vine wall feature will complete the landscape improvements on the site. All irrigation systems shall be designed to meet the most current water conservation policies and available equipment and must be in accordance with the State’s Water Efficient Landscape Ordinance (WELO). (See Figure 7.) Figure 7 – Existing and Proposed Landscape Plan Page 8 ANALYSIS: As described above, the proposed Orangetheory Fitness Center remodel requires approval from the Downtown Design Review Board. Rohnert Park Municipal Code Section 17.06.740.D.6 specifically outlines the following findings that are required for a decision on a design review. Finding: The proposed development is consistent with the General Plan and any applicable specific plan. The proposed project includes exterior modifications, and new signage, lighting and landscaping, that improve the overall relationship between an existing building and its State Farm frontage. The proposed improvements will not result in changes to building area, setbacks, height or lot coverage. The use remains consistent with the Commercial-R (Regional) General Plan land use designation of the property, which is intended to provide sites for retail areas con- taining a wide variety of businesses, including: retail stores, eating and drinking establishments, commercial recreation, business and personal services that serve the community and outlying ar- eas within an eight to twenty-mile radius. The project is consistent with the General Plan. It is not part of a specific plan but is consistent with the Central Rohnert Park PDA Plan. Finding: The proposed development is consistent with all the applicable standards of this Sec- tion and Chapter 17.25 (Administrative and Enforcement Procedures). The proposed project is an exterior remodel of an existing building that does not change the access points or building area and does not trigger compliance with the prescriptive standards of the form based code. The application was submitted in the manner required by Rohnert Park Municipal Code Sec- tion 17.06.700 et. seq. and includes all required information. Finding: The proposed development will not be detrimental to the public health, safety, or gen- eral welfare. The proposed development includes features that enhance the building’s relation- ship to State Farm Drive and puts “eyes on the street” which improves public safety, compared to the existing facilities. The proposed developed includes landscape, lighting, outdoor private open space and bicycle parking which also serves to improves public health, safety and wel- fare, compared to the existing facilities. The project will not be detrimental to the public health safety and welfare. Finding: The proposed development substantially complies with the City of Rohnert Park Design Guidelines (Design Guidelines) for Commercial, Mixed-Use and Multi-Family Buildings and the Central Rohnert Park Priority Development Area Plan (PDA Plan). In the event of a conflict between the Design Guidelines and the PDA Plan, the guidelines in the PDA Plan shall apply. The Rohnert Park Design Guidelines, adopted by the City Council in 2012, Page 9 contain site and architectural recommendations for commercial, mixed-use centers. The project addresses these guidelines as follows: • Using architectural detailing consistent with the building style should be used to add variety to building facades specifically by the use of enhanced entraces, improved lighting and modern signage including the proposed vine wall. • Placing wall signage to complement the building’s façade composition especially by improving the signage along State Farm Drive and also by reusing signage from its existing facility that is consistent with the overall Raley’s Center. • Incorporation of an outdoor open space as part of the renovation. While the project does not need to comply with all prescriptive standards in the Form Based Code, it does comply with the PDA Plan guidelines which support support safe community access, pedestrian and landscape improvements and the incorporation of outdoor space. The Orangetheory Fitness Center proposal satisfies this criteria in the following areas: • Provides for windows, entries, and other openings to face a public street. • Provides a generous outdoor space enhanced with pedestrian furniture, lighting and landscaping to create a comfortable and inviting place. Landscaping is provided along walkways at building frontages or parking areas to provide a buffer for the outdoor spaces. • Incorporates on site amenities for bicycle parking. Finding: The proposed development has an appropriate relationship to land use and develop- ment of adjacent properties, including topographic and other physical characteristics of the land. The proposed project is the remodel of an existing building. It has an appropriate rela- tionship to the landuse and development of adjacent properties and does not change the topog- raphy or other physical characteristics of the underlying land. Finding: The proposed development has a compatible architectural style with the character of the surrounding area, both to avoid repetition of identical design where not desired, and to ensure compatibility in design where desired. The proposed project is the remodel of an existing building. It uses color to maintain compatibility with the existing shopping center while introducing new design elements to enhance the shopping center’s interface with State Farm Drive and to improve the availability of outdoor space. The applicant has put forward a thoughtful design which will visually enhance the State Farm Drive corridor as well as incorporate key elements of the PDA Plan related to landscaping, outdoor seating, gathering places and bicycle facilities. Staff is recommending approval with conditions in the resolution attached. ENVIRONMENTAL DETERMINATION: The City of Rohnert Park (City) approved the Central Rohnert Park Priority Development Area (PDA) Plan in March of 2016. The intent of the PDA Plan is to support transit-oriented and infill development in existing communities within the City, particularly adjacent to transit. In accordance with the California Environmental Quality Act (CEQA), the City prepared an EIR to analyze the impacts associated with implementation of the PDA Plan on a program-level basis. The PDA EIR was also certified in March 2016. Page 10 The proposed project is consistent with the PDA EIR and impacts associated with the project are relatively minor given its size and scope. The impacts can be mitigated by compliance with Mitigation Measure 3.1-1, 3.1-2, 3.1-3, 3.1-4. 3.1-5, 3.1-7, 3.2-2, 3.3-1, 3.3-2, 3.4-1, 3.5-1, 3.5-2, 3.6-2, 3.6-3, 3.7-1, 3.7-2 and 3.8-3, which focus on mitigating or preventing impacts from construction activity. The complete list of Mitigation Measures included in the PDA EIR and staff’s analysis of the their applicability is included as Exhibit C to the the proposed Planning Commission resolution. PUBLIC NOTIFICATION: The DDRB consists of a minimum of three members and a maximum of five members appointed by the Planning Commission. In lieu of creating a separate DDRB, the Planning Commission may serve as the DDRB. The Planning Commission has chosen to serve at the DDRB. While applications for the DDRB are not subject to a public hearing or noticing requirements, this meeting has been notices in the same manner as a Planning Commission meeting and a courtesy notice was mailed to properties/property owners contiguous to the project site. Commercial and mixed-use centers in Central Rohnert Park are regional and neighborhood serving. They provide the community with basic goods and services. The project will focus on private improvements that support safe community access, and that will emphasize pedestrian and landscape improvements, including lighting that is high quality, durable and compatible with the building. D. The proposed development substantially complies with the City of Rohnert Park Design Guidelines (Design Guidelines) for Commercial, Mixed-Use and Multi-Family Buildings and the PDA. The project complies with the Design Guidelines, including, but not limited to, the following concepts: • Projects must be well landscaped. Landscaping should enhance the building, screen unattractive areas, and create inviting spaces that contribute to a pleasant pedestrian environment. Landscaping species should be primarily drought tolerant. • Lighting should be used to emphasize pedestrian areas and to create a pleasant environment. On site and exterior building lighting should be compatible in quality and design and complement the building façade. Glare from light fixtures must be avoided. • Façade articulation should be achieved by using architectural elements that complement the character of the building. Articulation treatments should be consistent throughout the building. • All windows should be designed to correspond to the architectural style of the building. The project also substantially complies with the PDA, including, but not limited to, the document’s place making approach for the downtown area and applicable subarea description, and a few of its goals and policies. • The following PDA goals and policies are applicable to and implemented by the project: o Goal L-1: Establish Central Rohnert Park as a complete community, with distinctive mixed-use areas and places. o Goal L-6: Support the PDA as a thriving business and employment district. o Façade improvements, especially along pedestrian frontages, should be articulated through windows, entries and other openings facing a public street. o Retail, office and other uses in the Station Center subareas should be designed with active relationships to the street. As the primary component, the Raley’s Towne Shopping Center commercial center is located in the commercial core of the Downtown District Amenity Zone. The project’s commercial activity use complements the existing commercial uses to the north and west. The project will play an important role in transforming the character of development in the Raley’s Towne Center commercial center. The project’s small- to moderate-scale urban form will appear unique within what is currently a suburbanized area, but the form is not inconsistent with the RPGP, the RPMC, the PDA, or the community’s vision for the area, and it will not create conflicts with the surrounding development. F. The proposed development has a compatible architecture style with the character of the surrounding area, both to avoid repetition of identical design where not desired, and to ensure compatibility in design where desired. The updated look and feel of the Orangetheory Fitness Center will achieve architectural detailing proportioned to the building. The development will include attractive improvements on the street frontage including the varied usage of materials, landscaping and lighting that highlights the buildings’ design and avoids glare to surrounding properties. The applicant has put forward a thoughtful design which will visually enhance the State Farm corridor and surrounding area. The addition of an outdoor seating area is proportioned to the existing building and provides a consistent storefront bay repetition. The project as proposed provides continuity in design and materials on all elevations. Section 3. Environmental Clearance. In accordance with the California Environmental Quality Act (CEQA), an Environmental Impact Report (EIR) was prepared for the Central Rohnert Park, Priority Development Area (PDA). The PDA EIR was previously certified by the City Council. Coinciding with the City’s approval of the project’s Final Development Plan, Conditional Use Permit, Tentative Map, and a Development Agreement between the City and Laulima Development, LLC, Planning completed a Consistency Analysis, finding the proposed project consistent with the PDA plan analyzed in the PDA EIR. Pursuant to Section 15162 of the CEQA Guidelines, no new environmental effects could occur as a result of the project and no new mitigation measures would be required. Impacts associated with Phase #1 are consistent with those previously identified and analyzed for the previous Station Avenue approvals. Therefore, no additional environmental review is required. The project will be required to comply with the mitigation measures set forth in the Consistency Analysis. General Conditions 1. The Downtown Design Review approval shall expire one year from the Downtown Design Review Board’s approval date, unless prior to the expiration an application for a building permit is filed and or an extension is requested and approved. All applicable provisions of the City of Rohnert Park Municipal Code (RPMC), are made a part of these conditions of approval in their entirety, as if fully contained herein. 2. The violation of any condition listed herein shall constitute a nuisance and a violation of the RPMC. In conformity with Chapter 1.16 of the RPMC, a violation of the RPMC may be an infraction or a misdemeanor and shall be punishable as provided by law. In addition to criminal penalties, the City may seek injunctive relief. The Applicant agrees to pay for all attorney’s fees and costs, including, but not limited to, staff time incurred by the City in obtaining injunctive relief against the Applicant as a result of a failure of the Applicant to fully perform and adhere to all of the Conditions of Approval. 3. The Applicant agrees to defend, indemnify, hold harmless and release the City of Rohnert Park, its agents, officers, attorneys and employees from any claim, action or proceedings brought against any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this application or certification of the environmental document which accompanies it. This indemnification obligation shall include but not be limited to, damages, costs, expenses, attorneys’, or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents, officers, attorneys or employees. Design Conditions 4. The Project is approved as shown in the Design Submittal package attached to the Downtown Design Review Board approval resolution except as conditioned or modified below. 2 5. All buildings shall be design in accordance with the most current version of the California Building Code, including the Green Building Code and as amended by the Rohnert Park Municipal Code. 6. Landscape plans shall be submitted with the civil improvement plans. Sidewalk alignment shall be shown on both the civil and landscape plans. Landscaping shall be designed in accordance with the State’s most current Model Water Efficient Landscaping Ordinance (MWELO), or in accordance with water conservation standards which meet or exceed the requirements of the MWELO and the Rohnert Park Priority Development Area Landscape/Streetscape Design Standards. The Applicant shall submit a final landscaping and irrigation plan that identifies landscape material types and locations, irrigation, water usage calculations, and other information as required. The plan shall be submitted to and reviewed and approved by the Development Services Department prior to construction. All costs for review of the requirements of the MWELO shall be borne by the Applicant. All landscaping and irrigation subject to the MWELO shall be substantially complete prior to the issuance of a Certificate of Occupancy. 7. Any new trees within five (5) feet of the public right-of-way or within five (5) feet of any paved areas within the project shall have root barriers that are approved by the City Engineer. 8. The applicant and Contractor shall adhere to all project conditions of approval and all applicable Mitigation Monitoring Plan Conditions (Attached as Exhibit C to Resolution 2024-01). 9. The applicant’s design submittal shall include a list of the equipment proposed for use during construction, the duration of the construction use and a description of paint and coating materials proposed for use for the purpose of determining compliance with Bay Area Air Quality Management (BAAQMD) significance thresholds for air quality and greenhouse gas emissions (see Mitigation Measures 3.1-2 and 3.1-7). The applicant shall fund the City’s work to confirm compliance with BAAQMD significance thresholds. If BAAQMD thresholds are exceeded, Mitigation Measures 3.1-3, 3.1-4, 3.1-5 and 3.5-2 shall apply to the project as applicable. 10. The applicant’s design submittal shall include a calculation of the earthwork associated with the project for the purpose of determining the need for a grading permit. 11. The following Air Pollution Control Notes shall be included on the applicant’s design drawings: a. All exposed surfaces (e.g., parking areas, staging areas, soil piles, graded areas, and unpaved access roads) shall be watered two times per day. 3 b. All haul trucks transporting soil, sand, or other loose material off-site shall be covered. c. All visible mud or dirt track-out onto adjacent public roads shall be removed using wet power-vacuum street sweepers at least once per day. The use of dry power sweeping is prohibited. d. This person shall respond and take corrective action within 48 hours. BAAQMD's phone number also shall be visible, to ensure compliance with applicable regulations. 12. The following General Construction Notes shall be included on the applicant’s design drawings: a. "Any excess materials is the property of the contractor and shall be disposed of away from the job side in accordance with applicable local, state and federal regulations." b. "During construction, the contractor shall be responsible for controlling noise, odors, dust and debris to minimize impacts on surrounding properties and roadways. Contractor shall be responsible that all construction equipment is equipped with manufacturers approved muffler's baffles. Failure to do so may result in the issuance of an order to stop work." c. "If at any time during earth disturbing activities a concentration of artifacts or a cultural deposit is encountered, work shall stop in the immediate area and the construction manager shall contact the City and a qualified archeologist.” d. “If human remains are encountered anywhere on the project site, all work shall stop in the immediate area and the construction manager shall contact the City, the County Coroner and a qualified archeologist.” 4 e. “If paleontological resources or unique geologic features are encountered during construction, all work shall stop in the immediate area and the construction manager shall contact the City and a qualified paleontologist.” f. "Construction work hours shall be consistent with the Rohnert Park Municipal Code, Noise Ordinance. g. If hazardous materials are encountered during construction, the contractor will halt construction immediately, notify the City of Rohnert Park, and implement remediation (as directed by the City or its agent) in accordance with any requirements of the North Coast Regional Water Quality Control Board." h. "The contractor(s) shall be required to maintain traffic flow on affected roadways during non-working hours, and to minimize traffic restriction during construction. The contractor shall be required to follow traffic safety measures in accordance with the Cal Trans "Manual of Traffic Safety Controls for Construction and Maintenance Work Zones." The City of Rohnert Park emergency service providers shall be notified of proposed construction scheduled by the contractor(s) in writing and at least 24 hours in advance of its proposed schedule of work." i. Use of plastic monofilament netting (e.g., erosion control matting or wattles) for erosion control is prohibited. Appropriate fiber netting or similar natural materials (e.g., coconut coir matting) shall be used for erosion control or other purposes in sensitive areas, to reduce the potential for entrapping wildlife. j. "The Contractor is responsible for the removal of all USA markings created within the project limits, and in relation to the project. Replacement and restoration must meet the approval of the City Engineer." k. "The contractor shall maintain one clean set of marked plans showing all changes and “as built” information. This set of plans will be submitted to the City engineer upon completion of work.” l. "All utility covers shall meet final paving elevations. More than 0.25 inch of deviation between the top of the utility cover and the surrounding pavement in a six foot radius at any location shall be cause for rejection." m. “Any current or new curb and gutter and sidewalk non-compliant shall be replaced by the developer to the City Standard at the discretion of the City Engineer. n. “If a tree needs to be removed, applicant shall obtain a tree removal permit from the City’s Planning Division” 5 Prior to the Issuance of Building or Grading Permits 13. The applicant shall secure an encroachment permit from the City prior to performing any work within the City right of way or easement. 14. If the site will require import or export of dirt, the applicant shall submit in writing the proposed haul routes for the trucks and equipment. The haul routes must be approved by the City prior to import/export work commencing. 15. If permanent BMPs are necessary, determined by the Santa Rosa and Sonoma County Storm Water Low Impact Development Technical Design Manual (latest edition), then the applicant shall enter into a Master Maintenance Agreement with the City of Rohnert Park. 16. The project applicant shall prepare and implement a traffic control plan for construction activities that may affect road rights-of-way, to facilitate travel of emergency vehicles on affected roadways. The traffic control plan must follow applicable City of Rohnert Park standards and must be approved and signed by a professional engineer. During Construction 17. All construction shall conform to the City's most current Manual of Standards, Details, and Specifications latest edition, all City Ordinances and State Map Act and the approved plans. 18. If any hazardous waste is encountered during the construction of this project, all work shall be immediately stopped and the Sonoma County Environmental Health Department, the Fire Department, the Police Department, and the Development Services Inspector shall be notified immediately. Work shall not proceed until clearance has been issued by all of these agencies. 19. The applicant shall be responsible to provide and maintain erosion and pollution control in accordance with the approved plans and permits. 20. The applicant shall keep adjoining public streets free and clean of project dirt, mud, materials, and debris during the construction period. 21. If grading is to take place between October 15 and April 15, both temporary and permanent erosion control measures, conforming to the project erosion control plans shall be in place before October 1st. Erosion control measures shall be monitored and maintained continuously throughout the storm season. 6 22. The following minimum Best Management Practices (BMPs) shall be required during construction: a. Construction crews shall be instructed in preventing and minimizing pollution on the job. b. Construction entrances/exits shall be stabilized to prevent tracking onto roadway. c. Exposed slopes shall be protected from erosion through preventative measures. d. Use brooms and shovels when possible to maintain a clean site e. Designate a concrete washout area. Maintain washout area and dispose of concrete waste on a regular basis. f. Establish a vehicle storage, maintenance, and refueling area. g. Protect drain inlets from receiving polluted storm water through the use of filters such as fabrics, gravel bags or straw wattles. h. Have necessary materials onsite before the rainy season. i. Inspect all BMPs before and after each storm event. Maintain BMPs on a regular basis and replace as necessary, through the entire course of construction. j. All construction implementation measures as outlined in the MMRP. 23. The Project shall comply with the City's Municipal Code, including hours of construction. All construction equipment shall be adequately muffled and properly tuned in accordance with manufacturer's specifications. All equipment shall be checked by a certified mechanic and determined to be running in proper condition prior to operation. 24. Hours of work shall be limited to between 8 a.m. to 6 p.m. Monday through Friday. Work on Saturday or Sunday will only be permitted with written permission from the City. Requests for extended hours must be submitted 72 hours in advance. 25. Throughout the construction of the project, the Bay Area Air Quality Management District’s Basic Construction Control Measures for dust shall be maintained to the satisfaction of the City. At a minimum these measures include: 7 a. All exposed surfaces (e.g. parking areas, staging areas, soil piles, graded areas and unpaved access roads) shall be watered two times per day. b. All trucks transporting soil, sand or other loose material off-site shall be covered. c. All visible mud or dirt track-out onto adjacent public roads shall be removed using wet power-vacuum street sweepers at least once per day. The use of dry power sweeping is prohibited. d. All roadways, driveways and sidewalks to be paved shall be completed as soon as possible. e. All building or grading permits issued for projects within the plan area shall include the following Basic Construction Control Measures (BAAQMD, 2017a) as a condition of the permit. a. Site accesses to a distance of 100 feet from the paved road shall be treated with a 6 to 12 inch compacted layer of woodchips, mulch or gravel. 8 b. Sandbags or other erosion control measures shall be installed to prevent silt runoff to public roadways from sites with a slope greater than 1 percent. c. Throughout the construction of the project, the Bay Area Air Quality Management District’s Additional Construction Control Measures for Exhaust-Related Emissions shall be maintained to the satisfaction of the City. All contractors shall use equipment that meets ARB’s most recent certification for standard off-road heavy diesel engines. g. All contractors shall ensure that all 50 horsepower or greater diesel-powered equipment are powered with California Air Resources Board certified Tier 4 interim engines, except where the applicant establishes t to the satisfaction of the City that Tier 4 interim equipment is not available. In that case the applicant may upgrade another piece of equipment to compensate (from Tier 4 interim to Tier 4 final). h. All contractors shall evaluate the feasibility of using alternatively fueled vehicles and equipment during construction activities. 27. If the existing city streets are damaged during construction, the applicant shall be responsible for repair at no cost to the city. 28.
