A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK TO
REJECT ALL BIDS FOR THE MAGNOLIA PARK TENNIS COURT RESURFACING
AND SUNRISE PARK PICKLEBALL COURT RECONSTRUCTION PROJECT
(PROJECT NO. CIP2307), AUTHORIZE A BUDGET AMENDMENT IN THE AMOUNT
OF $802,712 AND FIND THE PROJECT EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES
SECTIONS 15301 (EXISTING FACILITIES) AND 15302 (REPLACEMENT OR
RECONSTRUCTION) (14 CAL. CODE REGS. §§ 15301 AND 15302)
WHEREAS, in Fiscal Year 22/23, the City Council approved $200,000 of Measure M
Park funds for the Sunrise Park Pickleball and Magnolia Park Tennis Court Resurfacing Project,
which included repainting and restriping of the Sunrise pickleball courts and the Magnolia park
tennis courts; and
WHEREAS, at the July 11, 2023 City Council meeting, staff recommended an additional
$2M in funding to the Project to complete a full reconstruction of both sets of pickleball courts at
Sunrise Park; and
WHEREAS,the Plans and Specifications for the project were prepared by SSA Landscape
Architects Inc. and approved by the City Engineer; and
WHEREAS, consistent with Public Contract Code, an invitation for bids was posted and
published on July 12, 2024 and July 19, 2024 and the engineer's estimate for construction ranged
from $2M- $2.3M; and
WHEREAS, Four (4) sealed bids were received at the bid opening on July 29, 2024, and
the range of bidders were all $450,000-$700,000 over the engineer's estimate and City's planned
budget for the project; and
WHEREAS, the City of Rohnert Park' s Standard Specifications, section 3.1 and
competitive bidding laws provide that the City retains discretion to reject all bids; and;
WHEREAS staff believes that rejecting all bids and modifying the scope of work would
bring the project's costs within the City's planned project budget; and
WHEREAS, staff recommends appropriating and transferring $250,000 from F7109
General Fund Funding; and
WHEREAS, in addition to the $250,000 transfer, staff has identified remaining funds in
the following projects that are near or approaching completion: East Cotati Paving CIP1717 for
$106,595, Honeybee Pool Renovation CIP1931 for $446,117; and
WHEREAS, staff recommends that the City Council authorize the Finance Director to
approve a Budget Amendment in the total amount of$802,712 to cover the funding shortfall; and
WHEREAS, upon receipt, staff recommends the City Council authorize the Finance
Director to appropriate the $20,000 donation from the Rohnert Park Tennis Club (RPTC) to the
project for work at Magnolia Tennis Courts; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert
Park that it does hereby authorize and approve as follows:
1. The above recitals are true and correct and material to this Resolution.
2. The City Council rejects all bids for the Magnolia Park Tennis Court and Sunrise Park
Pickleball Court Reconstruction Project CIP2307.
3. The Finance Director is hereby authorized to appropriate funds and approve a Budget
Amendment in the total amount of $802,712 (From Fund 7109) for the Magnolia Park
Tennis Court and Sunrise Park Pickleball Court Reconstruction Project CIP2307.
4. The City Manager is hereby authorized to accept and the Finance Director to appropriate
the donation from the Rohnert Park Tennis Club for the project for work at Magnolia Park.
5. The City Council determines that the Project is exempt from CEQA because the Project
involves renovation of existing facilities at the two City Parks, Sunrise Park and Magnolia
Park. Therefore, the Project is categorically exempt from the requirements of CEQA
pursuant to Sections 15301 (Existing Facilities) and 15302 (Replacement or
Reconstruction) of CEQA Guidelines. (14 Cal. Code Regs. §§ 15301, 15302).
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed
to execute documents pertaining to the same for and on behalf of the City of Rohnert Park, and the
City Attorney's office is authorized to make minor edits to the documents.
