2024/04/25 Downtown Design Review Board Resolution 2024-01 DOWNTOWN DESIGN REVIEW BOARD RESOLUTION NO.2024-01 A RESOLUTION OF THE DOWNTOWN DESIGN REVIEW BOARD OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING DESIGN REVIEW FOR EXTERIOR MODIFICATIONS TO AN EXISTING BUILDING FOR THE RELOCATION OF ORANGETHEORY FITNESS CENTER LOCATED AT 500 RALEY'S TOWNE CENTER(APN 143-051-054) WHEREAS,the applicant, Argonaut Investments Inc., filed Planning Application No. PLSR24-0001 for Design Review to allow exterior modifications to an existing building for the relocation of the Orangetheory Fitness Center located at 500 Raley's Towne Center, (APN 143- 051-054, in accordance with the City of Rohnert Park Municipal Code(RPMC); and WHEREAS, Planning Application No. PLSR24-0001 was processed in the time and manner described by state and local law; WHEREAS, on April 25, 2024, the Downtown Design Review Board reviewed Planning Application No. PLSR24-0001 at which time interested persons had an opportunity to testify either in support of or opposition to the project; and WHEREAS, at the April 25, 2024, Downtown Design Review Board meeting, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the Board considered all the facts relating to Planning Application No. PLSR24-0001; NOW, THEREFORE, BE IT RESOLVED THAT THE DOWNTOWN DESIGN REVIEW BOARD OF THE CITY OF ROHNERT PARK DOES RESOLVE,DETERMINE AND ORDER AS FOLLOWS: Section 1. The above recitations are true and correct. Section 2. Findings. The Downtown Design Review Board, in approving Planning Application No. PLSR24-0001 considered the following based on the staff report and attachments, the oral presentation and any oral and written comments presented at the meeting, and hereby makes the following findings: A. That the proposed development is consistent with the General Plan and any applicable specific plan. The project is consistent with the General Plan, including, but not limited to, the General Plan Land Use Map's designation of the site and many of the General Plan's goals and policies. • The General Plan Land Use Map applies the C-R Regional Commercial designation to the project area with the Downtown District Amenity Zone (DDAZ) Overlay. The designation accommodates a variety of compatible businesses, stores, institutions, service organizations, and residences in a pedestrian-oriented setting. • The following General Plan goals and policies are applicable to and implemented by the project: o LU-C: Promote a balanced land use program and increase the ability of people to live and work in the city. o LU-D: Provide for concentrations of activity and mixed-use and pedestrian-oriented development in selected areas. o Establish Central Rohnert Park as a complete community, with distinctive commercial areas and place, by: ■ Supporting Central Rohnert Park as a thriving business and employment district. B. The proposed development is consistent with all applicable standards of Section 17.06.740 (Permits and Procedures) and Chapter 17.25 (Administrative and Enforcement Procedures). The proposed project is an exterior remodel of an existing building that does not change the access points or building area and does not trigger compliance with the prescriptive standards of the form based code. The application was submitted in the manner required by Rohnert Park Municipal Code Section 17.06.700 et. seq. and includes all required information. C. The proposed development will not be detrimental to the public health, safety, or general welfare. The project and surrounding area supports walking, biking,transit,and clean and electric vehicles. This benefits the public health by encouraging exercise and reducing greenhouse gas emissions associated with vehicles that consume fossil fuels. Commercial and mixed-use centers in Central Rohnert Park are regional and neighborhood serving. They provide the community with basic goods and services. The project will focus on private improvements that support safe community access, and that will emphasize pedestrian and landscape improvements, including lighting that is high quality, durable and compatible with the building. D. The proposed development substantially complies with the City of Rohnert Park Design Guidelines (Design Guidelines)for Commercial, Mixed-Use and Multi-Family Buildings and the PDA. o Light fixtures should be selected to reflect the overall building and landscape theme. Creative fixture designs should promote the individual expression of businesses. E. The proposed development has an appropriate relationship to land use and development of adjacent properties, including topographic and other physical characteristics of the land. As the primary component,the Raley's Towne Shopping Center commercial center is located in the commercial core of the Downtown District Amenity Zone. The project's commercial activity use complements the existing commercial uses to the north and west. The project will play an important role in transforming the character of development in the Raley's Towne Center commercial center. The project's small-to moderate-scale urban form will appear unique within what is currently a suburbanized area,but the form is not inconsistent with the RPGP, the RPMC,the PDA, or the community's vision for the area, and it will not create conflicts with the surrounding development. F. The proposed development has a compatible architecture style with the character of the surrounding area, both to avoid repetition of identical design where not desired, and to ensure compatibility in design where desired. The updated look and feel of the Orangetheory Fitness Center will achieve architectural detailing proportioned to the building. The development will include attractive improvements on the street frontage including the varied usage of materials, landscaping and lighting that highlights the buildings' design and avoids glare to surrounding properties. The applicant has put forward a thoughtful design which will visually enhance the State Farm corridor and surrounding area. The addition of an outdoor seating area is proportioned to the existing building and provides a consistent storefront bay repetition. The project as proposed provides continuity in design and materials on all elevations. Section 3. Environmental Clearance. In accordance with the California Environmental Quality Act(CEQA), an Environmental Impact Report(EIR)was prepared for the Central Rohnert Park, Priority Development Area(PDA). The PDA EIR was previously certified by the City Council. Coinciding with the City's approval of the project's Final Development Plan, Conditional Use Permit, Tentative Map, and a Development Agreement between the City and Laulima Development, LLC, Planning completed a Consistency Analysis, finding the proposed project consistent with the PDA plan analyzed in the PDA EIR. Pursuant to Section 15162 of the CEQA Guidelines,no new environmental effects could occur as a result of the project and no new mitigation measures would be required. Impacts associated with Phase#1 are consistent with those previously identified and analyzed for the previous Station Avenue approvals. Therefore, no additional environmental review is required. The project will be required to comply with the mitigation measures set forth in the Consistency Analysis. The project complies with the Design Guidelines, including, but not limited to,the following concepts: • Projects must be well landscaped. Landscaping should enhance the building, screen unattractive areas, and create inviting spaces that contribute to a pleasant pedestrian environment. Landscaping species should be primarily drought tolerant. • Lighting should be used to emphasize pedestrian areas and to create a pleasant environment. On site and exterior building lighting should be compatible in quality and design and complement the building façade. Glare from light fixtures must be avoided. • Façade articulation should be achieved by using architectural elements that complement the character of the building. Articulation treatments should be consistent throughout the building. • All windows should be designed to correspond to the architectural style of the building. Window materials and type should maintain a consistent design vocabulary and quality throughout the building. Street facing windows should maintain transparency and visibility. The project also substantially complies with the PDA, including, but not limited to,the document's place making approach for the downtown area and applicable subarea description, and a few of its goals and policies. • The following PDA goals and policies are applicable to and implemented by the project: o Goal L-1: Establish Central Rohnert Park as a complete community, with distinctive mixed-use areas and places. o Goal L-6: Support the PDA as a thriving business and employment district. o Façade improvements, especially along pedestrian frontages, should be articulated through windows, entries and other openings facing a public street. o Retail, office and other uses in the Station Center subareas should be designed with active relationships to the street. Buildings and landscaping should be designed to support development themes of the community to create inviting outdoor spaces and vibrant places. NOW THEREFORE BE IT RESOLVED, that the Downtown Design Review Board does hereby approve Planning Application No. PLSR24-0001, approving design review for exterior modifications for the Orangetheory Fitness Center located at 500 Raley's Towne Center, subject to the Applicant Design Package, attached as Exhibit A,Conditions of Approval,attached as Exhibit B and the Mitigation Monitoring Program for the Rohnert Park Priority Development Area Plan,attached as Exhibit C. BE IT FURTHER RESOLVED,that said action shall not be deemed final until the appeal period has expired and that the appeal period shall be ten (10) working days from the date of said action. No building permits shall be issued until the appeal period has expired, providing there are no appeals. General Conditions 1. The Downtown Design Review approval shall expire one year from the Downtown Design Review Board's approval date, unless prior to the expiration an application for a building permit is filed and or an extension is requested and approved. All applicable provisions of the City of Rohnert Park Municipal Code(RPMC), are made a part of these conditions of approval in their entirety, as if fully contained herein. 2. The violation of any condition listed herein shall constitute a nuisance and a violation of the RPMC. In conformity with Chapter 1.16 of the RPMC,a violation of the RPMC may be an infraction or a misdemeanor and shall be punishable as provided by law. In addition to criminal penalties, the City may seek injunctive relief. The Applicant agrees to pay for all attorney's fees and costs, including, but not limited to, staff time incurred by the City in obtaining injunctive relief against the Applicant as a result of a failure of the Applicant to fully perform and adhere to all of the Conditions of Approval. 3. The Applicant agrees to defend, indemnify,hold harmless and release the City of Rohnert Park, its agents, officers, attorneys and employees from any claim, action or proceedings brought against any of the above, the purpose of which is to attack, set aside, void, or annul the approval of this application or certification of the environmental document which accompanies it. This indemnification obligation shall include but not be limited to, damages, costs,expenses, attorneys', or expert witness fees that may be asserted by any person or entity, including the Applicant, whether or not there is concurrent passive or active negligence on the part of the City, its agents,officers,attorneys or employees. Design Conditions 4. The Project is approved as shown in the Design Submittal package attached to the Downtown Design Review Board approval resolution except as conditioned or modified below. 1 5. All buildings shall be design in accordance with the most current version of the California Building Code, including the Green Building Code and as amended by the Rohnert Park Municipal Code. 6. Landscape plans shall be submitted with the civil improvement plans. Sidewalk alignment shall be shown on both the civil and landscape plans. Landscaping shall be designed in accordance with the State's most current Model Water Efficient Landscaping Ordinance (MWELO), or in accordance with water conservation standards which meet or exceed the requirements of the MWELO and the Rohnert Park Priority Development Area Landscape/Streetscape Design Standards. The Applicant shall submit a final landscaping and irrigation plan that identifies landscape material types and locations, irrigation, water usage calculations, and other information as required. The plan shall be submitted to and reviewed and approved by the Development Services Department prior to construction. All costs for review of the requirements of the MWELO shall be borne by the Applicant. All landscaping and irrigation subject to the MWELO shall be substantially complete prior to the issuance of a Certificate of Occupancy. 7. Any new trees within five(5) feet of the public right-of-way or within five(5) feet of any paved areas within the project shall have root barriers that are approved by the City Engineer. 8. The applicant and Contractor shall adhere to all project conditions of approval and all applicable Mitigation Monitoring Plan Conditions(Attached as Exhibit C to Resolution 2024-01). 9. The applicant's design submittal shall include a list of the equipment proposed for use during construction,the duration of the construction use and a description of paint and coating materials proposed for use for the purpose of determining compliance with Bay Area Air Quality Management(BAAQMD)significance thresholds for air quality and greenhouse gas emissions(see Mitigation Measures 3.1-2 and 3.1-7). The applicant shall fund the City's work to confirm compliance with BAAQMD significance thresholds. If BAAQMD thresholds are exceeded, Mitigation Measures 3.1-3, 3.1-4, 3.1-5 and 3.5-2 shall apply to the project as applicable. 10. The applicant's design submittal shall include a calculation of the earthwork associated with the project for the purpose of determining the need for a grading permit. 11. The following Air Pollution Control Notes shall be included on the applicant's design drawings: a. All exposed surfaces (e.g., parking areas, staging areas, soil piles, graded areas, and unpaved access roads) shall be watered two times per day. 2 b. All haul trucks transporting soil,sand, or other loose material off-site shall be covered. c. All visible mud or dirt track-out onto adjacent public roads shall be removed using wet power-vacuum street sweepers at least once per day. The use of dry power sweeping is prohibited. d. All vehicle speeds on unpaved roads shall be limited to 15 miles per hour. e. Idling times shall be minimized either by shutting equipment off when not in use or by reducing the maximum idling time to 5 minutes(as required by the California airborne toxics control measure, Title 13, Section 2485 of the California Code of Regulations). f. Clear signage shall be provided for construction workers at all access points. g. All construction equipment shall be maintained and properly tuned in accordance with manufacturer specifications. All equipment shall be checked by a certified visible emissions evaluator. h. All excavation,grading,and/or demolition activities shall be suspended when average wind speeds exceed 20 miles per hour. i. A publicly visible sign shall be posted at the soil transfer site within BAAQMD,with the telephone number and person at the City of Rohnert Park to contact regarding dust complaints. This person shall respond and take corrective action within 48 hours. BAAQMD's phone number also shall be visible, to ensure compliance with applicable regulations. 12. The following General Construction Notes shall be included on the applicant's design drawings: a. "Any excess materials is the property of the contractor and shall be disposed of away from the job side in accordance with applicable local, state and federal regulations." b. "During construction,the contractor shall be responsible for controlling noise, odors, dust and debris to minimize impacts on surrounding properties and roadways. Contractor shall be responsible that all construction equipment is equipped with manufacturers approved muffler's baffles. Failure to do so may result in the issuance of an order to stop work." c. "If at any time during earth disturbing activities a concentration of artifacts or a cultural deposit is encountered, work shall stop in the immediate area and the construction manager shall contact the City and a qualified archeologist." d. "If human remains are encountered anywhere on the project site, all work shall stop in the immediate area and the construction manager shall contact the City,the County Coroner and a qualified archeologist." 3 e. "If paleontological resources or unique geologic features are encountered during construction, all work shall stop in the immediate area and the construction manager shall contact the City and a qualified paleontologist." f. "Construction work hours shall be consistent with the Rohnert Park Municipal Code, Noise Ordinance. g. If hazardous materials are encountered during construction, the contractor will halt construction immediately,notify the City of Rohnert Park, and implement remediation(as directed by the City or its agent) in accordance with any requirements of the North Coast Regional Water Quality Control Board." h. "The contractor(s) shall be required to maintain traffic flow on affected roadways during non-working hours, and to minimize traffic restriction during construction. The contractor shall be required to follow traffic safety measures in accordance with the Cal Trans "Manual of Traffic Safety Controls for Construction and Maintenance Work Zones." The City of Rohnert Park emergency service providers shall be notified of proposed construction scheduled by the contractor(s) in writing and at least 24 hours in advance of its proposed schedule of work." i. Use of plastic monofilament netting(e.g., erosion control matting or wattles) for erosion control is prohibited. Appropriate fiber netting or similar natural materials (e.g., coconut coir matting) shall be used for erosion control or other purposes in sensitive areas, to reduce the potential for entrapping wildlife. j. "The Contractor is responsible for the removal of all USA markings created within the project limits, and in relation to the project. Replacement and restoration must meet the approval of the City Engineer." k. "The contractor shall maintain one clean set of marked plans showing all changes and"as built" information. This set of plans will be submitted to the City engineer upon completion of work." 1. "All utility covers shall meet final paving elevations. More than 0.25 inch of deviation between the top of the utility cover and the surrounding pavement in a six foot radius at any location shall be cause for rejection." m. "Any current or new curb and gutter and sidewalk non-compliant shall be replaced by the developer to the City Standard at the discretion of the City Engineer. n. "If a tree needs to be removed, applicant shall obtain a tree removal permit from the City's Planning Division" 4 Prior to the Issuance of Building or Grading Permits 13. The applicant shall secure an encroachment permit from the City prior to performing any work within the City right of way or easement. 14. If the site will require import or export of dirt, the applicant shall submit in writing the proposed haul routes for the trucks and equipment. The haul routes must be approved by the City prior to import/export work commencing. 15. If permanent BMPs are necessary, determined by the Santa Rosa and Sonoma County Storm Water Low Impact Development Technical Design Manual (latest edition),then the applicant shall enter into a Master Maintenance Agreement with the City of Rohnert Park. 16. The project applicant shall prepare and implement a traffic control plan for construction activities that may affect road rights-of-way, to facilitate travel of emergency vehicles on affected roadways. The traffic control plan must follow applicable City of Rohnert Park standards and must be approved and signed by a professional engineer. During Construction 17. All construction shall conform to the City's most current Manual of Standards, Details, and Specifications latest edition, all City Ordinances and State Map Act and the approved plans. 18. If any hazardous waste is encountered during the construction of this project, all work shall be immediately stopped and the Sonoma County Environmental Health Department, the Fire Department, the Police Department, and the Development Services Inspector shall be notified immediately. Work shall not proceed until clearance has been issued by all of these agencies. 19. The applicant shall be responsible to provide and maintain erosion and pollution control in accordance with the approved plans and permits. 20. The applicant shall keep adjoining public streets free and clean of project dirt, mud,materials, and debris during the construction period. 21. If grading is to take place between October 15 and April 15, both temporary and permanent erosion control measures, conforming to the project erosion control plans shall be in place before October 1st. Erosion control measures shall be monitored and maintained continuously throughout the storm season. 5 22. The following minimum Best Management Practices (BMPs) shall be required during construction: a. Construction crews shall be instructed in preventing and minimizing pollution on the job. b. Construction entrances/exits shall be stabilized to prevent tracking onto roadway. c. Exposed slopes shall be protected from erosion through preventative measures. d. Use brooms and shovels when possible to maintain a clean site e. Designate a concrete washout area. Maintain washout area and dispose of concrete waste on a regular basis. f. Establish a vehicle storage, maintenance, and refueling area. g. Protect drain inlets from receiving polluted storm water through the use of filters such as fabrics, gravel bags or straw wattles. h. Have necessary materials onsite before the rainy season. i. Inspect all BMPs before and after each storm event. Maintain BMPs on a regular basis and replace as necessary, through the entire course of construction. j. All construction implementation measures as outlined in the MMRP. 23. The Project shall comply with the City's Municipal Code, including hours of construction. All construction equipment shall be adequately muffled and properly tuned in accordance with manufacturer's specifications. All equipment shall be checked by a certified mechanic and determined to be running in proper condition prior to operation. 24. Hours of work shall be limited to between 8 a.m. to 6 p.m. Monday through Friday. Work on Saturday or Sunday will only be permitted with written permission from the City. Requests for extended hours must be submitted 72 hours in advance. 25. Throughout the construction of the project, the Bay Area Air Quality Management District's Basic Construction Control Measures for dust shall be maintained to the satisfaction of the City. At a minimum these measures include: 6 a. All exposed surfaces (e.g. parking areas, staging areas, soil piles, graded areas and unpaved access roads) shall be watered two times per day. b. Suspend dust-producing activities during periods when instantaneous gusts exceed 20 mph when dust control measures are unable to avoid visible dust plumes. 26. All building or grading permits issued for projects within the plan area shall include the following Basic Construction Control Measures (BAAQMD, 2017a)as a condition of the permit. a. Site accesses to a distance of 100 feet from the paved road shall be treated with a 6 to 12 inch compacted layer of woodchips,mulch or gravel. 7 b. Sandbags or other erosion control measures shall be installed to prevent silt runoff to public roadways from sites with a slope greater than I percent. c. Throughout the construction of the project, the Bay Area Air Quality Management District's Additional Construction Control Measures for Exhaust-Related Emissions shall be maintained to the satisfaction of the City. At a minimum these measures include: d. Idling time for diesel-powered construction equipment shall be limited to 2 minutes. e. Low-volatile organic compound(i.e. ROG) coatings shall be used beyond local requirements. f. All contractors shall use equipment that meets ARB's most recent certification for standard off-road heavy diesel engines. g. All contractors shall ensure that all 50 horsepower or greater diesel-powered equipment are powered with California Air Resources Board certified Tier 4 interim engines, except where the applicant establishes t to the satisfaction of the City that Tier 4 interim equipment is not available. In that case the applicant may upgrade another piece of equipment to compensate (from Tier 4 interim to Tier 4 final). h. All contractors shall evaluate the feasibility of using alternatively fueled vehicles and equipment during construction activities. 27. If the existing city streets are damaged during construction,the applicant shall be responsible for repair at no cost to the city. 28.
