1982/01/12 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES January 12, 1982 The Council of the City of Rohnert Park met this date in special adjourned session commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Vice -Mayor Hopkins presiding. Call to Order Vice -Mayor Hopkins called the meeting of the special session to order at approximately 7:23 p.m. Roll Call Present: (3) Councilmen Roberts, Stewart, and Hopkins Absent: (2) Councilman Hollingsworth and Mayor Cavalli (whose absence was due to illness) Staff present for all or part of the meeting: City Manager Callinan and City Attorney Flitner. Mechanical Play Devices City Manager Callinan gave a brief recap of the previous discussion held concerning mechanical play devices. City Manager Callinan recapped for Council his January 7, 1982 Council meeting memo pointing out the locations of the existing mechanical play devices which were presently in violation of the city's existing ordinance. David Walker, Attorney for Lommie's Restaurant was recognized and requested the Council allow Lommie's to continue operating their existing number of mechanical play devices until the Council has prepared and approved an ordinance concerning same. Discussion followed between Council and Mr. Walker of which the Council pointed out that Lommie's was currently operating the machines illegally according to the. city's existing ordinance. Discussion followed. Rob Hornbeck, 7369 Circle Drive was recognized and pointed out that Lommie's had been issued a business license by the city for the play devices. Discussion followed. Richard Tipton, Coin Amusement General Manager was recognized and expressed that he felt allowing a maximum of 5 machines to be turned on until a decision and ordinance was prepared was fair. Mr. Tipton indicated that he felt amusement centers were a thing of the future for entertainment. Upon inquiry he stated that he and his firm were not opposed to arcades if properly maintained and supervised and further expressed that he felt an establishment containing over 5 machines constituted an arcade. City Attorney Flitner pointed out to Council that those mechanical play devices currently in existence, except for the bowling alley and skating rink, were illegal according to city's existing ordinance. Mr. Flitner recommended the Council Page 2 January 12, 1982 consider regulation by use permit and zoning regulations. Mr. Flitner requested the Council take time to thoroughly examine the issue before taking any action. Discussion followed. It was the concensus'of the'Council to have staff and city attorney work on an ordinance regulating mechanical play devices for presentation at the next City Council meeting and in the meantime, that those establishments which illegally have mechanical play`devices may turn on no more °than 5 i they have more than .5 and no more than they currently possess below 5 machines with no new installations. Resolution No. 82 -13 RESOLUTION OF THE "CITY COUNCIL OF THE CITY OF ROHNERT PARK IMPOSING A MONITORIUM AND RESTRICTION ON THE INSTALLATION OF ANY ADDITIONAL MECHANICAL PLAY DEVICES AT LOCATIONS WITHIN THE CITY OF ROHNERT PARK ACID DIRECTING THE CITY ATTORNEY AND THE POLICE'CHIE'F TO ENFORCE EXISTING MUNICIPAL CODES RELATING TO ILLEGAL INSTALLATIONS City Attorney Flitner explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Stewart, and unanimously approved, reading of Resolution No. 82 -13 was waived and said resolution was adopted by title. General discussion followed between staff and Council concern - ing such things as establishing what type of establishments to allow mechanical play devices, zoning regulations, definition of play device, definition of arcade; allowing or not allowing arcades, use permits'and'licensing, etc. City Attorney Flitner recommended licensing owners of mechanical play devices in order to give the Councilman opportunity to review the character of the owner. Upon conclusion of the discussion the City Attorney and City Manager were instructed to prepare appropriate municipal code amendments to reflect the Council's feelings expressed during the discussion. Communications Communications per the attached outline were brought to the attention of the City�Coundil. No action was taken on any communication unless specifically noted in these minutes. Planning Commission City Manager Callinan referring to Council meeting memo dated Vacancy January 7, 1982 reminded Council of a vacancy to the Rohnert Park Planning Commission. It was the concensus of the Council to hold off making an appointment to the Planning Commission until the Council's next regularly scheduled meeting. Discussion was held concerning the possibility of a Council member filing a vacancy to city commissions until an appoint- ment is made to that commission. Fred Rohnert - Memorial City Manager Callinan reported that a memorial service for Service Mr. Fred Rohnert would be held at the City Offices on January 27; 1982 at 11.00 a.m. and encouraged the Council to attend. Page 3 January 12, 1982 Emergency Medical Councilman Roberts initiated discussion concerning the city Services possibly issuing public statements notifying the public of emergency medical stations in the city during disasters and emergencies. Mr. Roberts pointed out that nurses and doctors would then know where they might be able to report to lend assistance. Discussion followed.
